Approval of Minutes Mr. Jarrell made a motion to approve both the March 2, 2010, minutes which passed 5- 0 and March 16, 2010, which passed 4-0-1, with Ms. Hooker abstaining. Approval of Consent 8genda Ms. Cronise provided an overview and update of the Timberbrook Properties petition. She stated the petitioner has submitted a traffic impact analysis. She stated although the petitioner has verbally requested to postpone the petition, he has not submitted a written request. Mr. Radford inquired about the petitioner's response to the request for additional information. Ms. Cronise discussed this issue. Mr. Murphy stated the layout submitted of the development has not been proffered by the petitioner. Mr. Thompson explained since the layout has not proffered, the petitioner could revise the layout. He also reviewed the Clearbrook Village Overlay District (CVOD) regulations. Mr. McNeil inquired about the CVOD. Mr. Thompson stated architectural guidelines are not included in the CVOD. Ms. Cronise reviewed the design guidelines. Mr. Azar Page 1 of 4 ROANOKE COUNTY PLANNING COMMISSION MINUTES APRIL 6, 2010 expressed concern regarding the need for more detailed information. Ms. Cronise discussed the options for mitigation of the stream which crosses the property. Mr. Murphy reviewed the CVOD and stated the petitioner's parcel is within a secondary area of the CVOD. Mr. Obenshain explained that the request includes adding the property to the CVOD. Ms. Cronise stated important features to consider include the watercourse, Blue Ridge Parkway, and guidelines for connectivity. Ms. Cronise reviewed the CVOD guidelines. She stated the concept plan is based on potential tenants. Mr. McNeil stated commercial sites should have the same accountability as residential development within the CVOD. Mr. Radford inquired about DEQ regulations regarding management of the stream. Ms. Cronise discussed mitigation options for the stream. Ms. Hooker noted some mitigation options would be disregarding the citizens' guideline requests. Ms. Cronise stated a Community Meeting will be held on April 12, 2010. Mr. Thompson stated a second community meeting could be scheduled if needed. The Planning Commission chose not approve the May, 2010, consent agenda. (Break for dinner 5:04 p.m. to 6:10 p.m.) Zoning Ordinance Amendments Ms. Micklow discussed draft Solar Energy Systems Ordinance, including a brief history and overview of solar energy. She reviewed setbacks, height, and lot coverage of systems. Mr. Radford suggested height requirements should be the same for all zoning designations. Ms. Micklow reviewed Draft Parking Structures Ordinance, including setbacks, height restrictions, landscaping, and lighting. She discussed planting requirements if portions of structure are shaded or underground. Ms. Wood reviewed proposed General Text Amendments, Section 30 -28 Definitions, including corral, pasture, and underground structures; Section 30 -29 Use Types Generally, including university campuses; and Section 30- 100 -2, to include coverage and below grade structure requirements. Mr. Thompson suggested including other livestock within the corral and pasture definitions. Ms. Wood reviewed the current ordinance and proposed changes regarding accessory apartments. Mr. Azar inquired about existing driveways. Ms. Wood explained existing driveways would be excluded from the revision ordinance. Staff and commissioners discussed whether or not the owner should be permitted to live in the accessory dwelling. The commissioners agreed not to allow more than one separate driveway for access to the primary dwelling and the accessory apartment. Mr. McNeil suggested limiting the size of the accessory dwelling to 800 square feet. He expressed concern about allowing this use without a special use permit in R -1 districts. Ms. Wood stated regulations regarding subdivision of property would be applicable. Mr. Jarrell inquired about requirements regarding single ownership of the principal dwelling. Ms. Wood discussed the owner /occupied requirement. Staff and commissioners discussed requiring the owner to occupy the principal dwelling. Mr. Thompson explained the Page 2 of 4 ROANOKE COUNTY PLANNING COMMISSION MINUTES APRIL 6, 2010 commission could require a special use permit if the apartment is detached. Mr. Radford explained some principal owners do not want to live in the principal dwelling if space needs change. Mr. Jarrell concurred, noting the owner would be on site to oversee the property. Mr. Thompson discussed enforcement difficulty regarding this issue. Mr. Azar suggested allowing two bedrooms. Mr. McNeil expressed concern regarding future problems with two houses being placed on R -1 lots. Mr. Azar stated only square footage should be limited. Mr. Jarrell noted building ownership may be a trust or multiple individuals. Mr. Obenshain discussed this issue. Ms. Blankenship provided an update on proposed wind energy ordinance, including height, lot size, and setbacks for systems. She reviewed wind ordinances from other localities. Mr. McNeil inquired about measurement of the height of the systems. Ms. Blankenship discussed this issue. Mr. Thompson stated currently there are no standards defined for hybrid systems. Mr. Radford suggested adding the class chart to the ordinance. Staff and commissioners discussed this issue. Ms. Blankenship stated it may be beneficial for the commissioners to visit sites of existing residential turbines. Staff and commissioners also discussed inviting a representative from James Madison University to answer questions on wind energy. Other Comments Mr. Thompson stated the commission is scheduled to tour Koppers Industries, Inc. and the Glenvar area on April 20, 2010, beginning at 6:00 pm. Mr. Patriarca stated a work session to discuss Peters Creek Area Corridor Study is tentatively planned for May. Ms. Cronise stated a community meeting regarding Timberbrook Properties IX, LLC, and Fincastle Equipment Company, LC, will be held on April 12, 2010, at 7:00 pm. in the Clearbrook Elementary School gymnasium.
