HomeMy WebLinkAbout10/5/2010 - MinutesCommissioners Present: Ms. Martha Hooker Mr. Gary Jarrell Mr. Rodney McNeil Mr. Jason Peters Mr. David Radford Staff Present: Mr. John Murphy, Acting Secretary Mr. Paul Mahoney, County Attorney Ms. Tara Pattisall Ms. Susan Carter, Recording Secretary CALL TO ORDER: Mr. Jarrell called the Public Hearing to order at 7:00 p.m. Mr. Jarrell gave the invocation and led the pledge of allegiance. Approval of Agenda Ms. Hooker made a motion to approve the agenda, which passed 5 -0. Approval of Minutes Mr. Radford made a motion to approve the minutes of September 7, 2010, and September 21, 2010, which passed 5 -0. Public Hearing 1. The petition of Laura Bryant to obtain a Special Use Permit in a R -1, Low Density Residential, District to acquire a multiple dog permit for five (5) dogs on 1.005 acre, located at 4607 Fort Lewis Church Road, Catawba Magisterial District. Ms. Pattisall stated all dogs will be kept indoors. She stated adjoining neighbors signed a petition in favor of the petition. She also noted the request is in compliance with the comprehensive plan. She reviewed the history of the petition, noting the petitioner has combined two parcels in order to have a parcel large enough to allow her to request a special use permit. Ms. Hooker inquired if all of the dogs have been spayed or neutered. Ms. Bryant stated all five dogs have been spayed or neutered. Ms. Hooker inquired about the petitioner's yard. Ms. Pattisall stated the yard is fenced and the dogs will always be supervised when outdoors. Mr. McNeil asked if any complaints had been received regarding the dogs. Ms. Pattisall stated no complaints had been received. She noted all adjoining neighbors are in agreement with petitioner's request. Mr. Jarrell asked if petitioner plans to replace the dogs when they Page 1 of 3 ROANOKE COUNTY PLANNING COMMISSION MINUTES October 5, 2010 expire. Ms. Bryant stated she loves her dogs but does not intend to acquire more dogs. Mr. McNeil inquired about procedural issues. Mr. Murphy explained restrictions regarding the proposed special use permit. Ms. Hooker made a motion to recommend approval of the petition to the Board of Supervisors with the following condition: 1. The Multiple Dog Permit shall be for a maximum of five (5) dogs. Mr. Murphy called the roll and the motion passed (5 -0) with the following vote: AYES: Hooker, Jarrell, McNeil, Peters, Radford NAYES: None ABSTAIN: None 2. A proposed amendment to the Roanoke County Zoning Ordinance. The proposed amendment to Section 30 -23 -2 Nonconforming Uses of Buildings, Structures or Land would allow for the expansion of an existing nonconforming residential structure in a commercial or industrial zoning district. Mr. Murphy provided a brief history of the petition, noting the expansion would be on the existing structure. He discussed building code restrictions and fire safety regulations. Mr. McNeil inquired about property access and the setback requirements. Mr. Murphy explained setback requirements in various zoning designations. Mr. Radford made a motion to recommend approval of the ordinance to the Board of Supervisors Mr. Murphy called the roll and the motion passed (5 -0) with the following vote: AYES: Hooker, Jarrell, McNeil, Peters, Radford NAYES: None ABSTAIN: None Final Orders 1. The petition of Bobby B. Twine to rezone 6.54 acres from AR, Agricultural /Residential, District to AV, Agricultural/Village Center, District and to obtain a special use permit for the purpose of operating a construction yard, located at the intersection of Twine Hollow Road and Meacham Road, Catawba Magisterial District was approved with conditions by the Board of Supervisors at the Public Hearing on September 28, 2010. Commissioners' Comments There were none.
