PLANNING COMMISSION
WORK SESSION MINUTES

CALL TO ORDER:
Mr. Jarrell called the meeting to order at 6:00 p.m.
Approval of Agenda
Mr. McNeil made a motion to approve the agenda, which passed 4 -0.
Approval of Minutes
Ms. Hooker made a motion to approve the October 5, 2010, minutes which passed 4 -0.
Mr. Radford made a motion to approve the October 19, 2010, minutes which passed
4 -0.
Consent Agenda
Ms. Blankenship provided a PowerPoint presentation for the Timberbrook Properties,
IX, LLC, and Fincastle Equipment Company, LC, including a brief history of the petition,
existing conditions, future land use, and an updated concept plan. She stated proffers
have not been finalized. She discussed buffer yards and existing site conditions. Mr.
McNeil inquired about stormwater runoff, detention ponds, and signage for truck traffic.

Mr. Thompson discussed these issues, noting signage will be determined by VDOT.
Mr. McNeil inquired about the Clearbrook Overlay guidelines. Mr. Thompson explained
zoning ordinance restrictions regarding retail development. Mr. McNeil noted the traffic
impact analysis was based on the highest traffic count. Mr. McNeil and Mr. Radford
inquired about the existing stream on the property. Ms. Blankenship discussed this
issue. Mr. Simpson stated the stream is a jurisdictional matter. Ms. Cronise also
discussed runoff issues on Amanda Lane. Mr. Jarrell inquired about increased
buffering. Ms. Blankenship noted increased buffering would shield surrounding
residences.
Mr. Patriarca provided a PowerPoint presentation regarding Kingery Bros. Associates
including the proposed layout, buffering, and existing conditions. He reported on
citizens concerns expressed at the community meeting, including appearance,
buffering, and screening of property. He reviewed the proposed conditions, including
storage, landscaping, lighting, and signage. Mr. Peters inquired about the location of
storage. Mr. Patriarca discussed the natural screening of property. Mr. McNeil noted
the petitioner has been a long term resident and business owner of the county. Mr.
Patriarca stated VDOT information indicates minimal traffic will be generated from the
site use. Mr. McNeil suggested stipulating that additional material cannot be dumped
on site.
Mr. Thompson provided a brief overview of the Fellowship Community Church petition
which included a description of the current and proposed use of the property. Mr.
McNeil inquired about size of space included in the request. Mr. Thompson stated staff
could specify the amount of space as a condition of the special use permit.
Mr. Peters made a motion to approve the December 6, 2010, consent agenda which
passed 5 -0.
Wind Energy Regulations
Mr. Thompson provided a brief overview of the proposed ordinance, including the
revisions. Mr. Peters inquired about SCC regulations. Mr. Obenshain and Ms.
Blankenship explained that state regulations are based on output of the system. Mr.
Thompson and commissioners discussed proposed setback restrictions. The
commissioners agreed setbacks could be made site specific during the SUP process.
Mr. Thompson discussed noise regulations, noting only three SUP's have required
decibel level limitations since 1989. Mr. McNeil suggested setting standard and adjust
during SUP process. Mr. Jarrell noted noise level impact would be dependent upon the
location of the system. Mr. Peters noted determining the decibel level would require
hiring an acoustical engineer. He suggested setting the level low and requiring
approval from the county to increase the level. Mr. Obenshain stated a qualified expert
would be needed for litigation. Ms. Blankenship reviewed regulations of other localities.
The commissioners discussed setting a standard and then making the regulation site
specific with the SUP. Mr. Peters made a motion to set the maximum noise level at 60
decibels. Mr. McNeil seconded the motion.

Ms. Hooker expressed concern regarding allowing 365 days to remove a system which
is in disrepair. Mr. Radford noted the property may have multiple turbines. Ms. Hooker
suggested allowing six months to remove the system. Mr. Peters expressed concern
regarding enforcement. Mr. Thompson briefly discussed the application process,
noting further discussion is needed at next work session.
Private Road Standards
Staff and commissioners discussed roadway grades, including issues involving
emergency vehicle access and operation. Ms. Cronise reviewed the proposed design
standards. Mr. Woodrum stated VDOT's standard is currently 15% grade, noting snow
removal was a consideration when revising VDOT regulations. Mr. Huffman stated
some grades may be acceptable if the property levels out after reaching the top of the
grade. Mr. Maxey stated the fire trucks are designed for 6% grade. Mr. McNeil stated
setting a maximum grade is needed. Ms. Cronise discussed design exception
regulations.
Mr. Thompson discussed lighting and parking. Mr. Simpson discussed safety issues.
Mr. McNeil suggested designing an agreement allowing law enforcement to penalize
parking offenders. Mr. Obenshain noted this issue will require discussion with the police
department. Mr. Radford expressed concern regarding certifying process of 'as builts.'
Mr. Simpson and Mr. Epperley discussed this issue. Mr. Radford discussed the need
for requiring a third party inspector. Ms. Cronise stated regulations were based on
VDOT standards. Mr. Woodrum stated the developer has the responsibility to acquire
inspections. Mr. McNeil stated the purpose of the standards is to insure the quality of
roads which are being built. Ms. Cronise discussed bonds which are offered by the
developer to insure quality. Mr. Obenshain discussed liability issues.
Mr. Thompson and commissioners discussed timeline for public hearing.
Mr. Huffman and Mr. Maxey provided a PowerPoint presentation which included medic
units, pumper trucks, response to emergencies, and fire loss. They discussed how
parking on narrow roadways impedes emergency vehicle access. Mr. Thompson
noted the board of supervisors adopted the Fire Apparatus Resolution which regulates
road width for access. Mr. McNeil expressed concern regarding safety.
2011 Meeting Schedule
Mr. Peters made a motion to approve the 2011 Planning Commission Meeting Dates
which passed 5 -0.
Other Comments
Mr. Thompson briefly reviewed upcoming petitions.
With no further business or comments, Mr. Jarrell adjourned the meeting at 9:10 p.m.
