Approval of Minutes Mr. Peters made a motion to approve the minutes of November 15, 2010, which passed 5-0. Consent Ag . nda Ms. Micklow provided a brief overview regarding the petition of Jatin Patel, including existing conditions such as slope, adjacent land uses, and current zoning. She reviewed proposed use and concept plan. Mr. McNeil inquired about public access. Mr. Thompson reviewed this issue and the history of the property. Mr. Jarrell inquired if a drive-thru would be constructed. Ms. Micklow stated currently there are no plans to provide a drive-thru at this location. Ms. Wood discussed the petition of Fountain Head Land Company, LLC, including a brief history, purpose of the petition, conceptual layout, golf cart crossing plan, and signage. She reviewed the proposed concept plan and current progress. Mr. Peters inquired about status of tunnel. Mr. Jarrell noted construction of a tunnel would be expensive. Mr. McNeil inquired about signage. Mr. Thompson discussed area speed limit reduction. Mr. Peters expressed concern regarding speed limit enforcement on Pitzer Road. Mr. Radford inquired about phases of development of the proposed lots. Ms. Wood stated that the developer is unsure if all lots will perk. Mr. Jarrell asked about providing water to properties. Mr. Murphy stated the development will have individual wells and septic systems. Mr. McNeil expressed concern regarding the liability of the golf cart crossing. Mr. Mahoney discussed legal provisions regarding liability issues. Mr. McNeil suggested requiring insurance information prior to public hearing. Mr. Thompson noted the petition includes two separate requests, amend PRD and amend proffer regarding golf cart tunnel. Mr. Thompson briefly discussed proposed private road standards. Commissioners discussed speed limit issues. Mr. Thompson stated planning staff will have a meeting on December 9, 2010, with Roanoke County Schools to discussed standards. Mr. Jarrell suggested having provision to allow police department to ticket vehicles within private road subdivisions. Mr. Mahoney reviewed policies and statutes regarding this issue. Mr. McNeil suggested using fire department recommendations to determine road width regulations. Mr. Thompson and Mr. Mahoney discussed the Roanoke County Fire Apparatus Code. Mr. McNeil expressed concern regarding safety issues. Ms. Cronise discussed revisions regarding width requirements. Mr. Peters reviewed results acquired using Vinton fire trucks on private roads within Vinton. He noted houses are close within many subdivisions. Mr. Radford discussed regulations for housing construction. Commissioners discussed road width requirements. Mr. Peters inquired about advantage of allowing private roads. Ms. Cronise stated grade flexibility is the primary advantage for development of areas. Mr. Radford made a motion to approve the January 4, 2011, consent agenda, which passed 5 -0. Commissioner and Staff Comments Ms. Wood stated Fountain Head Land Company, LLC, Community Meeting will be held at Mount Pleasant Elementary School on December 9, 2010, at 6:30 p.m. With no further comments, Mr. Jarrell adjourned the work session at 4:47 p.m. EVENING SESSION: Mr. Jarrell called the Public Hearing to order at 7:00 p.m. Mr. Peters gave the invocation and led the pledge of allegiance. 1. The petition of Timberbrook Properties IX, LLC, and Fincastle Equipment Company, LC, to rezone 9.096 acres from AR, Agricultural Residential, District to C- 2C /CVOD, General Commercial /Clearbrook Village Overlay, District with conditions in order to construct a general commercial, retail sales and restaurant project, located on the northeastern side of Clearbrook Lane and across from the intersection of Clearbrook Lane and Clearbrook Village Lane, Cave Spring Magisterial District. Ms. Lindsay Blankenship presented the staff report which Page 2of8 ROANOKE COUNTY PLANNING COMMISSION MINUTES December 6, 2010 included revised proffers, concept plan, and results of traffic impact analysis (TIA). She discussed reduction of visual impact to residents and the Blue Ridge Parkway. Mr. McNeil inquired about Clearbrook Village Overlay District (CVOD) guidelines. Ms. Blankenship explained that two secondary parcels are currently not part of CVOD but if rezoned would become part of the overlay district. Ms. Hooker inquired about lighting. Ms. Blankenship reviewed the CVOD restrictions for lighting. Ms. Maryellen Goodlatte, Esquire, reviewed the site plan including property access. She discussed the importance of making the property marketable. She reviewed the TIA, noting the study was performed assuming fast food restaurants would occupy front parcels. She stated since primary concern expressed by the community is cut - through traffic, VDOT stated they will install signage prohibiting through truck traffic. She discussed buffering, building exterior, and lighting. She stated stormwater runoff should not be greater than it is prior to development. She discussed plans for the retention pond including the release rate. She noted the proposed use conforms to the Comprehensive Plan. Mr. McNeil expressed concern regarding stormwater runoff. He suggested using Type D, Option 2 buffering restrictions for the adjoining area along Amanda Lane. Ms. Hooker requested information regarding lighting restrictions. Mr. Thompson discussed this issue. Mr. McNeil inquired about buffering. Ms. Goodlatte discussed buffering stating the petitioner agrees to use Type D, Option 2 for a 10% increase of buffering along Amanda Lane. Mr. Jarrell opened the public hearing for public comment. With no citizens requesting to speak, he then closed the public hearing. Mr. McNeil made a motion to approve the rezoning petition with the following proffers, as amended: The primary access to the site (at the intersection of Clearbrook Lane and Clearbrook Village Lane) shall be designed so as to incorporate a sidewalk, pedestrian scale design features and landscaping in order to serve as a community focal point. A 15' planting area shall be installed along Clearbrook Lane and planted with native plants from the list provided in Appendix D of the Roanoke County Design Guidelines for the Clearbrook Village Commercial Overlay District and including shade trees, shrubs and flowering ornamental trees. 2. Subject to such modifications as pedestrian safety requires, pedestrian paths shall connect all buildings on the property. 3. All buildings shall be designed to be compatible with one another. All facades of buildings shall be of similar design, compatible materials and similar detailing. Exterior building colors shall be brown, beige, tan and /or white so as to complement the exterior Page 3of8 ROANOKE COUNTY PLANNING COMMISSION MINUTES December 6, 2010 color scheme for the retail development situated on Tax Parcel # 88.03 -01 -09.00 (i.e. Wal- Mart). 4. Plazas, hardscape, landscaped areas and site amenities shall also be compatible to the established building character and may include outdoor seating areas, varied paving materials to add contrast and texture, and decorative containers with seasonal landscape. 5. Roofline treatment shall be of compatible design on all buildings. No flat roofs visible from U.S. 220 shall be permitted on any building on the property. Rooftop mechanical units shall be shielded from view from U.S. 220 and Clearbrook Village Lane. 6. Required screening of service and trash areas shall be with finish materials matching the exterior finish material of the building for which it serves. 7. Acceptable building finishes include: a. brick b. wood, vinyl or composite wood substitute lap siding and trim C. stucco or exterior insulated finish system (EIFS) d. stone face colored concrete block e. stone or cast stone f. standing seam metal, copper, composite slate tile or asphalt shingle roof 8. The following building finishes are prohibited: a. Unpainted or bare metal panels b. Bare exposed concrete that is not exposed aggregate, hammered, sand blasted or covered with a cement based acrylic coating C. Unfinished wood other than cedar, mahogany, teak or redwood 9. Site Lighting: a. All lighting shall be shielded "cut off' types to internalize illumination and avoid spillover to adjacent residential properties. b. Sidewalks shall be illuminated with decorative pedestrian - scaled pole or building mounted luminaries. C. Plazas shall be illuminated similar to sidewalks but may include additional feature lighting for attractions and outdoor dining. Page 4of8 ROANOKE COUNTY PLANNING COMMISSION MINUTES December 6, 2010 d. Landscape lighting shall be employed to enhance site entrance and feature areas. e. No exposed fluorescent lighting shall be permitted. 10. Site Signage: a. The main freestanding tenant identification sign shall be near the intersection of Clearbrook Lane and Clearbrook Village Lane and shall be monument style utilizing materials approved as acceptable building materials and shall not have more than two sides. b. Signage color palette will be compatible with above named exterior building colors and shall complement the buildings' architectural style. 11. A Type D, Option 2 buffer shall be installed along the eastern boundary line of the property, as it adjoins Tax Parcels #88.04 -1 -31 and #88.04 -1 -32. The width of any other required buffer yard shall be increased by 10 %. All existing vegetation within a required buffer yard shall be preserved to the greatest extent possible. Existing vegetation within a required buffer yard shall be a substitute for otherwise required screening if it complies with the standards of the required buffer yard. Mr. Thompson called the roll and the motion passed (5 -0) with the following vote: AYES: Hooker, Jarrell, McNeil, Peters, Radford NAYES: None ABSTAIN: None 2. The petition of Kingery Bros. Associates to obtain a Special Use Permit in a AV, Agricultural/ Village Center, District for the purpose of operating a construction yard on 3.81 acres, located near the 6000 block of Franklin Road, Cave Spring Magisterial District. Mr. Patriarca presented the staff report, including a brief history of the property. He noted the current use of a construction yard is not authorized by the county. He stated the petitioner is willing to plant additional evergreen trees for screening. He reviewed the community meeting, stating the citizens were concerned about the length of time this use would be allowed and screening of property. He reviewed the suggested conditions for the request. Mr. McNeil inquired if petitioner agrees to conditions. Mr. Kingery stated he has reduced his operation and is trying to sell equipment currently on the property. He stated he will do what is necessary and plans to sell property in two years. Mr. Radford inquired if petitioner agrees with planting trees which are represented on the site plan. Mr. Kingery stated he agrees with maintaining currently trees and adding more trees. Mr. McNeil inquired about buffering requirements. Mr. Patriarca discussed various options for buffering. Mr. Thompson discussed suggested conditions regarding this issue. Mr. Peters Page 5of8 ROANOKE COUNTY PLANNING COMMISSION MINUTES December 6, 2010 inquired about citizen input. Mr. Patriarca stated citizen expressed concern regarding view from Route 220. Mr. Kingery stated he could plants trees between existing trees which would increase density of buffer. Mr. Patriarca stated staff recommends petitioner retain current trees and provide additional buffering in order to provide more screening of the property from Route 220. Mr. Jarrell opened the public hearing for public comment. With no citizens requesting to speak, he then closed the public hearing. Mr. McNeil made a motion to recommend approval of the petition to the Board of Supervisors with the following conditions: 1. The special use permit for the use of a construction yard shall expire on January 14, 2014. If the property is transferred out of the ownership of Kingery Brothers Associates prior to the expiration of the special use permit on January 14, 2014, the special use permit for the use of a construction yard shall be void. 2. No junk or debris as defined by County Code shall be permitted to be stored on site. 3. One row of large evergreen trees shall be planted along the western property line as shown on the concept plan to provide additional screening between the construction yard and neighboring residential areas. 4. There shall be no signage permitted for the construction yard. 5. No additional lighting shall be erected or installed for the construction yard. 6. Hours of operation for the construction yard shall be limited to 7:00 a.m. to 7:00 p.m. Monday through Saturday. Mr. Thompson called the roll and the motion passed (5 -0) with the following vote: AYES: Hooker, Jarrell, McNeil, Peters, Radford NAYES: None ABSTAIN: None 3. The petition of Fellowship Community Church to obtain a Special Use Permit in a C -2, General Commercial, District to operate a religious assembly on 4.088 acres, located at 7210 Williamson Road, Hollins Magisterial District. Ms. Tara Pattisall presented the staff report and reviewed the suggested conditions. Mr. Jarrell inquired about area included in rezoning. Ms. Pattisall explained conditions are limited to specific area. Mr. Radford inquired about land use and tax status of this property. Ms. Pattisall discussed future land use designation of this area. Mr. Ken Nienke, Pastor, Fellowship Community Church, stated approximately 35 families will be attending this church. Mr. McNeil inquired about activities. Mr. Nienke discussed this issue. He stated they have searched for a suitable site. Ms. Hooker agreed limited options are available for this use in the area. Mr. Jarrell opened the public hearing for public comment. Page 6of8 ROANOKE COUNTY PLANNING COMMISSION MINUTES December 6, 2010 Ms. Lisa Nucamendi, 6717 Oleander Circle, stated the church carries a positive impact for the community. She stated she is the owner of Alejandro's Mexican Grill which adjoins this property. With no other citizens requesting to speak, Mr. Jarrell then closed the public hearing. Mr. Jarrell made a motion to recommend approval of the petition to the Board of Supervisors with the following condition: 1. The religious assembly use shall not exceed 8,900 square feet. Mr. Thompson called the roll and the motion passed (5 -0) with the following vote: AYES: Hooker, Jarrell, McNeil, Peters, Radford NAYES: None ABSTAIN: None Final Orders 1. The petition of Laura Bryant to obtain a Special Use Permit in a R -1, Low Density Residential, District to acquire a multiple dog permit for five (5) dogs on 1.005 acre, located at 4607 Fort Lewis Church Road, Catawba Magisterial District was approved with condition by the Board of Supervisors at the Public Hearing on October 26, 2010. Citizen Comments Mr. Eldon Karr, 8011 Poor Mountain Road, requested that the county establish a technical advisory committee in order to be more technically informed regarding wind energy and land use. Commissioners' and Staff Comments Mr. Thompson announced Ms. Scheid will be retiring at the end of 2010. He stated Ms. Blankenship will be filling the Greenway Coordinator position. Mr. Thompson reported on the November 30, 2010, meeting with the Town of Vinton Planning Commission, Board of Zoning Appeals, and Town Council regarding the Vinton Corridor Plan, the Revitalization Plan, and Transportation Plan. He invited the commissioners to the Roanoke County Holiday Luncheon which will be held on December 15, 2010. Mr. Thompson stated a Fountain Head Land Company Community Meeting will be held on December 9th at 6:30 p.m. at the Mount Pleasant Elementary School.
