Approval of Minutes Mr. Bower made a motion to approve the minutes from January 2, 2024, which passed 3-0-1, with Mr. Woltz abstaining. Mr. McMurray made a motion to approve the minutes from January 16, 2024, which passed 4-0. Consent Agenda 1. The petition of Kevin Manor to obtain a special use permit to operate a short-term rental on approximately 1.23 acres of land zoned R-1, Low Density Residential District, located at 4127 Mockingbird Hill Road, Hollins Magisterial District. Ms. Skylar Camerlinck presented the location, floor plan, and future land use designation of the application. It was noted that there have been no neighborhood complaints submitted on this application. 2. The petition of Neil Aneja to obtain a special use permit to operate a short-term rental on approximately 0.30 acre of land zoned R-1, Low Density Residential District, located at 2726 White Pelican Lane, Cave Spring Magisterial District.Ms. Rebecca James ROANOKE COUNTY PLANNING COMMISSION MINUTES FEBRUARY 6,2024 presented the application and noted that this application was originally denied by the Board of Supervisors in November of 2022. The applicant had to wait a full year before being allowed to reapply. Ms. James noted that multiple code enforcement charges have been filed against Mr. Neil Aneja. He has been found guilty multiple times in circuit court for the operation of a short term rental, and he has not yet been served. Four charges have been filed-against the property owner, Shamar Kakar. It-was-noted that additional neighborhood complaints have been received this week in regards to the operation of short term rental. - Discussion of 2023 Planning Commission Annual Report Mr. Jones presented the revisions to-the 2023-Planning Commission Annual Report.- Mr. James made a motion to approve the 2023 Planning Commission Annual Report, with the change adding the previous calendar year to the zoning enforcement information, which passed 4-0. Discussion of 2024 Planning Commission Work Plan Mr. Thompson presented the revised draft of the 2024 Planning Commission Work Plan. Mr. Woltz made a motion to approve the 2024 Planning Commission Work Plan, which passed 4-0. Citizens Comments There were none. Comments of Planning Commissioners and Staff Mr. Thompson noted that AEP has a public hearing this evening, and explained that there were concerns presented from the LLC that owns the building that AllState leased. Ms. Cronise noted the upcoming meetings for Transportation projects: • February 15th, the second Starkey/Ogden Community Meeting will be held at the Roanoke County Administration Center on the Third Floor from 5:00-7:00 p.m. • February 28th, the West Main St. at Dow Hollow Road Intersection Improvements community meeting at Glenvar Library from 5:00-7:00 p.m. • March 7th, the Carson Road Safety Improvements community meeting at Bonsack Elementary School from 5:00-7:00 p.m. • March 18th, the Peters Creek Road/Williamson Road Multimodal Safety Improvements community meeting at the Hollins Library from 5:00-7:00 p.m. Mr. Thompson noted that the deadline for March land use application submissions is Friday, February 9th. Page2of5 ROANOKE COUNTY PLANNING COMMISSION MINUTES FEBRUARY 6, 2024 r Adjournment for Dinner Mr. James adjourned the meeting for dinner at 6:16 p.m. EVENING SESSION Mr. James called the meeting to order at 7:02 p.m. --- Invocation Mr. James led the invocation and pledge of allegiance. — --Public Hearings 1. The petition of Patricia M. Sink to rezone approximately 5.545 acres from AG-3, Agricultural/Rural Preserve District, to AV, AgriculturalNillage Center District, located at 3455 Pitzer Road, Vinton Magisterial District. Ms. Dunbar presented the project, zoning background, and future land use designation. Ms. Patricia Sink, 3431 Pitzer Road, explained that she has been thinking about selling this property. She noted that she would like to keep a majority portion of the land. She would like to only have to sell a small portion of the land with the house.. Mr-James asked if there were any other zoning designations that she considered. Ms. Sink noted that she believes that was the best solution that was discussed with staff. Mr. James opened the public hearing, and with no one wishing to speak closed the public hearing. Mr. James made a motion to approve the application, which passed 5-0. 2. The petition of Appalachian Power Company to rezone approximately 3.255 acres from C-2, High Intensity Commercial District, to 1-2, High Intensity Industrial District, located at 1835 Loch Haven Drive, Catawba Magisterial District. Ms. Alyssa Dunbar presented the project, zoning background, and future land use designation. Mr. Brian Cossman, 2524 Langhorn Road, spoke on behalf of Appalachian Power Company. He noted that staff did a great job presenting the project. He explained the intended use is to have traffic pick up a trailer that is in the covered storage area, and at the end of the day pull the trailer back in into the covered storage area. Mr. James questioned why the building is oriented the way that it is. Mr. Cossman noted that they have not seen a concept plan where the building is oriented differently. He noted that is is necessary to have doors on both sides of the building to have drive through traffic. Mr. Henderson asked the eave height of the building. It was noted that it was 16 feet. It was noted that there was a discrepancy in the application, so the taller height of 25 feet would be assumed. Mr. James opened the public hearing. Mr. Cowan, represented the LLC of the company that owns the AllState building, and noted that they believe this will be a negative investment in Roanoke County. He noted Page3of5 ROANOKE COUNTY PLANNING COMMISSION MINUTES FEBRUARY 6, 2024 that it is not consistent with the future land use designation. He noted that they are looking to sublease the building, and that they have concerns about having an Industrial zoned building in their front yard. He noted that they hope that there is another site where this building could be placed. He explained that this will have a substantial impact on the view of their building. Mr. James closed the public hearing. Mr. Bower questioned what type of fence would surround the site. Mr. Cossman noted that they would use what is typical for an Appalachian Power Company site which is a ----- - . chain link-fence--with-three-rows-of barbed-wire at-the top witha height-of 8-feet. - Mr. Bower.questioned if this would be classified as a construction yard. Mr. Thompson explained that this is classified as a construction yard, and is by right in 1-2. Mr. Bower questioned the use of the word "violation" in Mr. Cowan's letter. Mr. Cowan noted that it would be an "inconsistency"with the Roanoke County Comprehensive Plan and not a "violation". Mr. Henderson discussed the proffered conditions with staff. Mr. Bower noted that Mr. Cowan makes some great points. However, they have two companies that are great for Roanoke County, but he does not see a reason that the two cannot coexist. He believes that it will be a good thing for the County. Mr. James noted that he had some initial concerns with the project. He noted that there are two wonderful businesses. He explained that his concerns were addressed. Mr. Henderson made a motion to approve the application, with the following proffered conditions: 1. The site shall be developed in general conformance with the "Concept Plan for AEP Mobile Transformer— Roanoke, Virginia" prepared by Hurt and Proffitt dated December 5, 2023 subject to any changes required by the County of Roanoke, Virginia, Department of Transportation, or the Western Virginia Water Authority during the site plan review process. 2.The Type B Landscape Buffer adjacent to the western property line shall consist of two rows of large evergreen trees, eight (8) feet in height above ground when planted, in place of the deciduous trees and evergreen shrubs. 3. The Type B Landscape Buffer screening requirement adjacent to the western property line shall be constructed of an opaque vinyl material. The motion passed 5-0. Citizens Comments There were none. She will be starting in March. He noted that we are also in the process of hiring a Planner I.
