Approval of Minutes Mr. Bower made a motion to approve the minutes from March 5, 2024, and the minutes from March 19, 2024, which passed 4-0. Consent Agenda 1.The petition of Ramseys and Jesica Sandoval to obtain a special use permit to operate a short-term rental on approximately 0.3794 acre of land zoned R-1, Low Density Residential District, located at 5207 North Spring Drive, Catawba Magisterial District. Ms. Camerlinck presented the current use, proposed use, and the future land use designation. 2.The petition of ABoone Real Estate, Inc. to rezone approximately 16.27 acres of land from R-3C, Medium Density Multi-Family Residential District with conditions, to C-2C, High Intensity Commercial with conditions, to obtain a special use permit for mini-warehouse on approximately 19.73 acres zoned C- 2C, High Intensity Commercial District with conditions, and to amend the proffered conditions on 32.323 acres of land zoned C-2C, High Intensity Commercial District with conditions, and R-3C, Medium Density Multi-Family Residential District with conditions, located in the 1300 and 1400 blocks of ROANOKE COUNTY PLANNING COMMISSION MINUTES APRIL 2,2024 Edgebrook Road, Catawba Magisterial District. Ms. Dunbar presented the current zoning that was proposed with the previous rezoning that happened in 2022. She presented the proposed use, and the future land use designation. Mr. McMurray made a motion to approve the consent agenda, which passed 4-0. Citizens Comments There were none. Comments of Planning Commissioners and Staff Mr. Thompson noted that a citizen comment was received regarding the Sheetz, Inc. application. The comment was emailed to the Planning Commission prior to its meeting, and physical copies were provided at the meeting. Mr. Woltz requested to participate in the May 7th Planning Commission Public Hearing remotely due to personal business. His request was not challenged by the other Planning Commissioners. Mr. Thompson reviewed the agenda for the joint work session with the Board of Supervisors on April 9th. Adjournment for Site Visit Mr. James adjourned the meeting at 4:37 p.m. EVENING SESSION Mr. James called the meeting to order at 7:00 p.m. Invocation Mr. Woltz led the invocation and pledge of allegiance. Public Hearings 1. The petition of the City of Salem Water Department to obtain a special use permit for a major utility service (water tank) on approximately 0.38 acre of land zoned R-1, Low Density Residential District, located at 1490 Hearth Lane, Catawba Magisterial District. Ms. Camerlinck made a presentation on the proposed project. She reviewed the existing conditions, the proposed project, zoning, future land use designation, and suggested conditions. James verified that the Western Virginia Water Authority is still using that property to meter water for the City of Salem. Mr. Larado Robinson, Director of Water and Sewer with the City of Salem, noted that currently all of the water to serve areas of the City of Salem is supplied by Western Virginia Water Authority. The proposed water tank would allow the City of Salem to fill the water tank to service customers in that area. Mr. Woltz questioned if this project is to supply water to HopeTree. Mr. Robinson noted that this project was being developed before HopeTree was in the area, but yes, the water tank would eventually service HopeTree. He noted their plan to pave a portion of the private road to beautify the Page 2 of 5 ROANOKE COUNTY PLANNING COMMISSION MINUTES APRIL 2, 2024 property. Mr. James verified that the people this water tank would service currently have water. Mr. James questioned if this water tank were to be built, would they still be served by the Western Virginia Water Authority. It was noted that it is not likely that this water tank would service any citizens in Roanoke County. Mr. James opened the public hearing. Melvin Sink, 1446 Hearth Lane, had questions about construction and the road. Questions about maintaining the road and the water tank. He noted that he heard questions about paving the road beside it. He noted the reason he is so concerned is that it is a private road. He noted that the part that goes to his house, he has done all of the work of maintaining it. He noted that he took it upon himself to maintain it the best that he could. He questioned how much of the road would they pave and maintain. Would this now be considered a city or state-maintained road with part of it being paved. He noted that the existing water tank looks like a hazard, and it should have been replaced years ago. He noted that he has no issue with the proposal for a new water tank. His concerns are making it look nice and concerns about the road. Don Nichol, 1424 Red Lane extension, noted that he lives in the home right next to the water tank. His main concern is similar to the concerns mentioned by Mr. Sink. He is all for the replacement of the water tank, but has concerns about during the construction and the fencing around the water tank. His concern is mainly the proximity to his home while construction is going on, and the overlapping due to there not being a lot of property on his lot between his home and the proposed water tank. Mr. James closed the public hearing. Mr. Robinson noted that in terms of the paving, their intent is to pave the road to have better access to the water tank. Mr. Woltz questioned if they would agree to pave Hearth Lane where the road splits, to which Mr. Robinson agreed. Mr. Robinson noted that most of their water tanks have chain link fence surrounding them. He explained that they are still exploring their options, but he hopes they will be able to at least do a vinyl coated chain link fence to make it less.noticeable. Mr. Robinson noted that they will work with Mr. Nichol to ensure that he still has somewhere to park whether that is an easement or something else. Mr. Woltz made a motion to approve the application with the following conditions: 1. The site shall be developed in general conformance with the Planting Plan prepared by Thompson & Litton. 2. The water tank shall not exceed 75 feet in height. 3. Hearth Lane shall be paved from Red Lane Extension to where the gravel access road spits from Hearth Lane on the property. The motion passed 4-0. The petition of Sheetz, Inc. to remove the proffered conditions on approximately 0.978 acre of land zoned C-2C, High Intensity Commercial with conditions, located at 4143 Franklin Road, Cave Spring Magisterial District. Ms. Dunbar made a presentation that reviewed existing conditions, the proposed use, and future land use designation. Max Wiegard Esq., 9001 East Bird St., noted that he is representing Sheetz. He noted that Sheetz is a family-owned business, and reviewed the concept plan for the proposed development. He noted that there are no other methods to remove the conditions on the property, and that is why they are requesting a rezoning. Mr. David Capparuccini, Traffic Engineer, explained that Traffic Impact Analysis was done using the numbers that would be generated post improvements proposed by the Virginia Department of Transportation (VDOT). They were required by VDOT to factor in the upcoming improvements. Ms. Ashley Mothena, Assistant Resident Engineer with VDOT, noted that the improvements that VDOT is proposing will address the traffic concerns mentioned in the letter received from Mr. Jim Mullen. Mr. James opened the public hearing, and with no one wishing to speak closed the public hearing. Mr. McMurray made a motion to approve the request to remove the proffered conditions on the property, which passed 4-0. Citizens Comments There were none. Comments of Planning Commissioners and Staff Mr. McMurray noted that it was exciting to see an application for development in his district. Final Orders Mr. Kevin Manor's application for a special use permit to operate a short-term rental was approved by the Board of Supervisors at its March 26th meeting.
