Call to Order
Mr. James called the meeting to order at 6:00 p.m.
Joint Work Session with the Board of Supervisors regarding short-term rental
regulations
Mr. Philip Thompson noted that now is a good time to review Roanoke County's short-
term rental regulations. The regulations have been in place for three years, and there
have been different results. He explained that staff reviewed the regulations on short-

term rentals in different jurisdictions. He also noted how there have been legislative bills
that have been passed by the General Assembly.
He noted that if there is not a use defined in the Roanoke County Zoning ordinance then
that use is prohibited. Thus, before short-term rentals were added to the zoning
ordinance it was prohibited.
In 2020, the Planning Commission met to create regulations regarding short-term
rentals. Its decision was to allow short-term rentals with a Special Use Permit in R-1 and
R-2 along with use and design standards to receive information on each short-term
rental. Mr. Thomspon reviewed the current short-term rental regulations and the eight
(8) short-term rental special use permit applications that have come before the Planning
Commission and Board of Supervisors. He noted that out of the eight (8) applications,
only two (2) have been denied.
Mr. Thompson explained that staff reviewed the regulations on short-term rentals in
other jurisdictions. The findings were that Roanoke County is one of the more lenient
communities throughout the state. He noted that many jurisdictions have two separate
uses. One where the property owner lives on the property, that is often referred to as a
homestay or homestay (hosted). The second is that the property owner does not live on
the property. The commonality of standards are: acreage requirement and the zoning
districts. There are parking standards, limits on the number of bedrooms and people,
maximum rental period, owner must reside on the premises, there is an authorized
agent, events are prohibited, screening requirements, check-in and check-out times,
smoke detectors/carbon monoxide detectors/fire extinguishers required, number of pets
allowed, information required for renters, and record keeping (number of short-term
rentals). Permits and inspections vary. There are annual and multi-year permits, zoning
permits, HOA/POA approval, registry number included in short-term rental
advertisements/Air BnB. He noted some require initial inspections, while others require
annual inspections. Violations, have fines for unregistered short-term rentals, three or
more violations equates to a termination of the short-term rental.
He reviewed General Assembly Bills that apply to short-term rentals, and how that could
affect Roanoke County should amendments be made to the zoning ordinance. He
reviewed the short-term rental enforcement that Planning has done since November of
2022. Mr. Thompson explained the potential avenues for moving forward on this topic.
Through discussion, the Planning Commission and the Board of Supervisors decided to
proceed with adding additional conditions to future special use permits as needed. They
also agreed to proceed with investigating methods to assist with tracking taxes collected
regarding special use permits.
