EVENING SESSION
Mr. James called the meeting to order at 7:02 p.m.
Invocation
Mr. Henderson led the invocation and pledge of allegiance.
Remote Participation
Mr. Woltz attended via phone due to being unable to physically attend this meeting
because of business. He requested to participate in the meeting by telephone.
The remote attendance passed 3-0.
Approval of Minutes
Mr. Bower made a motion to approve the meeting minutes from April 2, 2024, and from
April 9, 2024. The motion passed 3-0-1 with Mr. Henderson abstaining.
Approval of Agenda
Mr. Bower made a motion to approve the consent agenda for June 4th, which passed 4-
0.

Public Hearings
1.The petition of Ramseys and Jesica Sandoval to obtain a special use permit to
operate a short-term rental on approximately 0.3794 acre of land zoned R-1, Low
Density Residential District, located at 5207 North Spring Drive, Catawba Magisterial
District. Ms. Camerlinck presented the current use, proposed use, and the future land
use designation.
Ramseys Sandoval, 5207 North Spring Drive, provided some background about
himself. He noted they started operating the short-term rental two years ago. He noted
that as soon as he received notice from Roanoke County, he ceased operating once he
found out they were not in compliance. He noted that they make a point to meet all their
guests. He noted that he went around the neighborhood and notified his neighbors to
ensure they would not have any issues with him conducting a short-term rental.
Mr. James opened the public hearing.
Marvin Leon Melton, 5148 Mason Park Drive, noted that his property does not adjoin
Mr. Sandoval's but is about 20 feet to the left. He noted that he has a concern about
real estate value and will it affect residential insurance rates. He noted that he read the
packet online and that it sounds very good but those are his two questions. In the future,
how do you ensure that you vet potential guests because it's a quiet residential
neighborhood.
Mr. Thompson noted that it may affect Mr. Sandoval's real estate value, but it would not
affect the neighborhood's value. Mr. Melton questioned the special use permit if that
applies to the whole street. Mr. Thompson explained that the special use permit runs
with the land, in this case with Mr. Sandoval's property if his request is approved.
However, if the use ceases for two years, then the special use permit expires. Mr. Woltz
noted that he has not seen short-term rentals negatively affect property values.
Johnnie Nash, 5210 North Spring Drive, explained that he is here in support of this
application. He lives directly across the street from the Sandovals. He noted that he did
not know until a year ago that they were operating a short-term rental. He did not notice
any extra noise or anything disruptive.
Mr. James closed the public hearing.
Mr. Sandoval noted that the platforms that he uses have ways of allowing the hosts
view who they allow to stay once they make a request to stay at their home. He noted
that they want to make sure they check all of their guests and their reviews before
approving them to stay at his home. He noted that if they see anything questionable,
they do reject people from staying at their home.
Mr. Henderson made a motion to approve the request for a special use permit with the
following conditions:

1. The short-term rental shall be limited to the lower level of the existing
residential dwelling (approximately 1,800 square feet).
2. The number of overnight guests shall not exceed six (6) people.
3. One (1) off-street parking space shall be provided for each guestroom in
addition to parking spaces required for the principal dwelling. All parking
shall be provided on-site and shall be located in driveways and other
designated approved parking areas.
4. The property owner shall provide and maintain in good working order
every smoke detector, carbon monoxide detector, and fire extinguisher
required by law. Exits required by law shall not be obstructed.
5. The property must maintain a residential appearance. No signage shall be
allowed with the short-term rental use.
6. No events such as parties, banquets, weddings, receptions, meetings, or
similar events shall be allowed with the short-term rental use.
7. A business license shall be obtained from the Commissioner of the
Revenue for the short-term rental use.
The motion passed 4-0.
2. The petition of ABoone Real Estate, Inc. to rezone approximately 16.27 acres of land
from R-3C, Medium Density Multi-Family Residential District with conditions, to C-2C,
High Intensity Commercial with conditions, to obtain a special use permit for mini-
warehouse on approximately 19.73 acres zoned C-2C, High Intensity Commercial
District with conditions, and to amend the proffered conditions on 32.323 acres of land
zoned C-2C, High Intensity Commercial District with conditions, and R-3C, Medium
Density Multi-Family Residential District with conditions, located in the 1300 and 1400
blocks of Edgebrook Road, Catawba Magisterial District. Ms. Dunbar presented the
current zoning that was proposed with the previous rezoning that happened in 2022.
She presented the proposed use, and the future land use designation.
Alexander Boone, 5760 Reserve Point Lane, noted that we have all spent a lot of time
on this application. He thanked Ms. Dunbar for the excellent job she did on her
presentation. He noted that hotel and townhomes were deemed to be good uses of the
property at the first public hearing for this property. He noted that as part of the process
he was speaking with Martha Hooker that it's unfortunate that rezonings need to be so
contentious. He asked her if there was another rezoning application that the community
would get behind would it be considerable to the Board of Supervisors. He noted that
this proposed location would be perfect for storage. Neighbors and those that spoke at
the first hearing were invited to comment on potential uses.
Mr. John Luger, 2717 Longview Ave SW, noted Virginia Varsity Transfer& Storage's
involvement with the application and noted the history of the business in the area and
his business model.
Mr. James opened the public hearing.

Tom Carpenter, 1564 Innsbrooke Drive, noted that he is not opposed to the proposed
storage facility. He noted that his concern is the buffer. He noted that the noise level
from 1-81 was a concern when he moved in. He noted his concern is how loud will it be
and what size will the barrier be. It's the future development in area "A" that concerns
him.
Mike Davis, 1601 Forest Highlands Court, noted that we started this meeting with a
prayer.He noted that the Bible tells us to lay up our gold and silver in heaven where it
will not rust. It was then followed by the pledge of allegiance. He looked up democracy
before coming here which is defined as "rule of the majority." He noted what if these ten
people imposed their wishes on over 200 people who opposed this. He noted that Mr.
Boone spoke of conservation. He noted concerns about cutting all the trees down. He
noted that the Planning Commission is going to help climate change. He asks how
many people would want a storage unit next to them. He noted that he and his wife
worked hard and got their treasure. He noted that these "dream killers" killed it.
Ms. Dunbar summarized the citizens comments that were received after the packet was
sent to the Planning Commission but was given to them prior to the public hearing. The
first mentioned the greenspace located on the subject parcel which is indicated not to
be disturbed, and the second questioned if the proffered conditions would remain on the
property if sold.
Ms. Dunbar clarified the differences between rezoning and special use permits. Mr.
Thompson spoke regarding the noise concerns mentioned by a citizen.
Mr. James closed the public hearing.
Mr. Henderson noted that this property is better for this group coming in that does great
things locally. He explained that he believes this is the right fit for this property.
Mr. Henderson made a motion to approve the request with the following proffered
conditions:
1. The townhomes and 2-story self-storage building shall be developed in
substantial conformance with the Edgebrook Park Overall Development Plan
(Exhibit B) dated March 22, 2024, prepared by Balzer and Associates, Inc. No
grading or development shall take place in the areas designated as existing
vegetation to remain as buffer, stream buffer or area to remain undisturbed as
shown on the Edgebrook Park Overall Development Plan dated March 22, 2024,
prepared by Balzer and Associates, Inc. Development of the remaining vacant
areas of Commercial Area A and Commercial B shall be done in accordance with
the applicable Roanoke County development regulations at the time of
development and restricted to the uses stated in Proffer#3.
2. The maximum building height for any structure shall be 45 feet.
3. The Property shall be limited to the following uses:
Commercial Area A- mini-warehouse (Self-Storage) Only

Commercial Area B — Office Uses— General Office; Medical Office;
Laboratory; Commercial Uses — Personal Services; Restaurant, General
(No Drive Through); Retail Sales; Veterinary Hospital/Clinic; and Mini-
warehouse (Self Storage)
The motion passed 4-0.

Comments of Planning Commissioners and Staff
There were none.
Final Orders
Sheetz, Inc. that the Planning Commission voted to recommend to the Board of
Supervisors was approved. The Salem Water Department that the Planning
Commission voted to recommend to the Board of Supervisors was approved.

Mr. James adjourned the meeting at 8:46 p.m.
