Consent Agenda:
1: 'The petition of LovABLE Services, Inc. to obtain a special use permit to operate a

Magisterial District. Mr. Nathan Grim presented an:overview of the petition, the
current:use, proposed use, and future land:use designation.::Mr. Bower asked if
Chris' Custard is looking to expand or if they are looking to move their business.
Mr. Grim noted that they are looking to move their:business.

Public Hearings
1.The petition of April Joyce Hernandez Lemus to rezone approximately 12.61 acres
from R-1, Low Density Residential District, to AR, Agricultural/Residential District,
located at 1807 Mayfield Drive, Vinton Magisterial District. Ms. Skylar Camerlinck
presented an overview of the petition, the current use, proposed use, and future land
use designation. She noted that this came to the County through a code enforcement
complaint. She noted that the applicant chose to move forward with the rezoning
process to attempt to continue its agricultural activity. Mr. Bower noted that the email
received by a citizen states that the property is not contiguous. Ms. Camerlinck noted
that the parcel is contiguous. Mr. James asked if it was known before the County was
comprehensively rezoned in 1992 that this parcel was used for agricultural purposes,
which Ms. Camerlinck confirmed.
Ms. Lemus noted that they currently have 16 cattle. She noted that calves have been
born since they first applied for the rezoning. She noted that they intend to sell those
cattle off as soon as they have been weened. She noted that the pastures are rotated to
help reduce chemicals in the cattle that they use to fill their freezers. She noted that
they have chickens as well as two turkeys. She noted that they do not currently have
pigs. She noted that they purchase 3-4 pigs in the spring and raise them until they are
ready to harvest them and fill their freezers. She noted that they have one horse. The
gentleman who owned the parcel before them sold them their horse. She noted that if
she knew any of this was going to happen, she never would have purchased the parcel
in the first place. She noted that the gentleman who owned the southern parcel had
cattle on the property. However, he has since passed so she cannot prove that it was
operated as agricultural without ceasing. She noted that they have two sheep, and a
donkey. She noted that she does not intend to keep sheep, they will end up in her
freezer because they are too much work. Mr. Bower asked who built the barn shown in
the pictures. Ms. Lemus noted that the barn has been there since they lived on the
property. Mr. Bower questioned if the fences were there when they purchased the
property, which Ms. Lemus confirmed they have mended fences but not added
additional fencing.
Mr. Bower opened the public hearing, and with no one wishing to speak, closed the
public hearing.
Mr. James asked Mr. Thompson and Ms. Lower to speak to measure in place to help
ensure that this property does not have further issues that could cause complaints from
neighbors. Mr. Thompson noted that there is the Erosion and Sediment Control
ordinance, the Animal and Fowl ordinance, if animals are treated properly animal control
could get involved. He noted that there may also be options at the state level for
enforcement.
Mr. James made a motion to approve the petition as it has been requested, which
passed 4-0.

2. The petition of B2X Online, Inc., to obtain a special use permit to construct a
broadcasting tower approximately 80 feet tall on approximately 6.972 acres of land
zoned AR, Agricultural/ Residential District, located at 9731 Tinsley Lane, Windsor Hills
Magisterial District. Ms. Alyssa Dunbar presented an overview of the petition, the
current use, proposed use, and future land use designation.
Warren Kane, 5508 Drive, noted that he is owner and CEO of B2X Online. He noted
that the photo shown is from the Catawba expansion. Mr. Bower questioned why we
need 80 feet instead of 50 feet. Mr. Kane noted that the 80 feet is to get above the tree
line that is around 70 feet. He noted that their product works best when it has direct
sight.
Mr. Bower opened the public hearing, and with no one wishing to speak, closed the
public hearing.
Mr. Woltz made a motion to approve the application with one condition:
1. The broadband transmitter pole shall not exceed eighty (80) feet above ground
level in height.
The motion passed 4-0.
3. Proposed Comprehensive Plan Amendment. The proposed amendment would
incorporate the Roanoke County Safe Streets and Roads for All Comprehensive Safety
Action Plan as a component of the Roanoke County 200 Plan. The Comprehensive
Safety Action Plan outlines targeted strategies to improve road safety, reduce crashes,
and promote a culture of responsible driving. Ms. Megan Cronise gave a presentation of
the proposed study and amendment.
Mr. Bower opened the public hearing, and with no one wishing to speak, closed the
public hearing.
Mr. Bower made a motion recommending adoption of an amendment to the Roanoke
County 200 Plan to incorporate the Roanoke County Safe Streets and Roads for All
Comprehensive Safety Action Plan into the Roanoke County 200 Plan.
The motion passed 4-0.

Comments of Planning Commissioners and Planning Staff
Mr. Thompson reminded the Planning Commission or the East Roanoke River
Greenway Gap Feasibility Study meeting on February 10th from 5:00-7:00 p.m. at Mount
Pleasant Elementary School.
