Approval of Minutes Mr. Marrano made a motion to approve the minutes of September 3, 2013, and October 1, 2013, which passed 4-0. Consent Agenda Ms. Mahoney provided an overview of the petition of Gary and Tamera Tickle, including the property history, current zoning, and future land use designation. She discussed the operation of the proposed car wash, noting it would be automated and employ one to five people. Mr. Holladay provided a brief overview of the Roanoke County Board of Supervisors petition, including the property history and current zoning. Mr. Holladay, Mr. Thompson, and the Commissioners discussed property access and screening options. Mr. Holladay stated a Community Meeting is tentatively scheduled for November 19, 2013. Ms. Hooker made a motion to approve the consent agenda, which passed 4-0. Commissioners' and Staff Comments There were none. EVENING SESSION Mr. Peters called the Public Hearing to order at 7:00 p.m. Ms. Hooker gave the invocation and led the pledge of allegiance. The petition of Frank R. Radford and Mary E. Radford to amend the proffered conditions on property approximately 0.6764 acre in size and zoned C -2C, General Commercial, District with conditions, located at 2210 Electric Road, Windsor Hills Magisterial District. Ms. Mahoney presented the staff report, which included a brief history of the petition, current zoning of the property, and proposed signage. She stated the purpose of the petition is to remove the proffered condition limiting signage on the property. Mr. Marrano inquired about signage regulations. Ms. Mahoney discussed applicable signage standards. Mr. Peters opened the public hearing for public comment. With no citizens requesting to speak, Mr. Peters closed the public hearing. Mr. Marrano made a motion to recommend approval of the removal of proffered condition #4 regarding signage. Mr. Thompson called the roll and the motion passed (4 -0) with the following vote: AYES: Hooker, Jarrell, Marrano, Peters NAYES: None ABSENT: Woltz 2. The petition of State Central Bank to amend the proffered conditions and Planning and Design documents for Loblolly Mill by removing the sections dealing with trails and lighting. The Loblolly Mill Planned Residential Development is located on Sterling Road which measures approximately 104.4 acres, Vinton Magisterial District. Ms. Pattisall stated the petitioner has requested to postpone the petition. Mr. Thompson, Ms. Kuhnel, and the Commissioners discussed this issue, noting the petition will be postponed until all required documents are completed and submitted by the petitioner. 3. The petition of Barry and Donna Tucker to obtain a Special Use Permit in a R -1, Low Density Residential, District for the operation of a bed and breakfast on approximately 1.054 acres, located at 6716 Timberline Circle in the Falcon Ridge Estates Subdivision, Windsor Hills Magisterial District. Ms. Cronise presented the staff report, noting no changes will be made to the property and bookings and payments will be made through AirBnB.com. She discussed the suggested condition limiting the number of guest rooms allowed. Ms. Cronise stated a restriction regarding this issue could be added as a condition. Mr. Marrano inquired about tax collection. Ms. Cronise discussed this issue. Mr. Marrano inquired about absentee landlords. Ms. Cronise discussed this issue and reviewed the bed and breakfast use and design standards. Mr. Peters opened the public hearing for public comment. Ms. Geri Walters, 6769 Parkway Drive, stated she was concerned the proposed use may open the neighborhood for other businesses. She stated the petitioner has been conducting business in the home, noting she had viewed a listing on the AirBnB.com website. Ms. Patrice Katz, 6710 Timberline Circle, and Ms. Kim Richards, 6742 Parkway Drive, spoke representing the Falcon Ridge Homeowners' Association. They stated that they do not want the business in the neighborhood, noting it would open the door for other businesses. They inquired about background checks of the potential guests, noting they are concerned about security, criminal activity, and the safety of the children in the neighborhood. They also stated the resale value of their homes would be adversely affected. They discussed the HOA bylaws, noting residents purchased their homes based on the bylaws. They stated eighteen residents have written letters against the petition. With no other citizens requesting to speak, Mr. Peters closed the public hearing. Mr. Tucker stated people using AirBnB.com are required to be approved by the company. Ms. Tucker stated information is required for the safety of the host. Mr. Peters asked if the petitioners have been operating the business. Ms. Tucker stated they set -up their website and someone booked their home prior to their knowledge of the regulations. She stated they suppressed the website when they realized the requirements for this use. She discussed the space available for rental. Mr. Marrano inquired if the petitioners would be willing to limit the number of visitors per month. Mr. and Ms. Tucker were agreeable to the limitation of visitors. Mr. Marrano inquired about parking for guests. The petitioners affirmed guests would park in the driveway. Ms. Cronise discussed bed and breakfast use and design standards and conditions. She also discussed home occupation regulations and by -right uses in residential areas. Mr. Jarrell stated more research and information is needed regarding this type of rental. Mr. Marrano stated the use is low impact and will provide more tax revenue for the County. Mr. Peters stated more time is needed to research the use. He discussed safety concerns regarding children in the neighborhood. Ms. Hooker and Mr. Marrano both noted other bed and breakfast facilities are in residential areas. Mr. Thompson, Ms. Cronise, and the Commissioners discussed allowable uses in residential areas. Mr. Thompson called the roll and the motion failed (2 -2) with the following vote: AYES: Hooker, Marrano NAYES: Jarrell, Peters ABSENT: Woltz Mr. Peters made a motion to postpone action on the special use permit until the December 2, 2013 Planning Commission Public Hearing: Mr. Thompson called the roll and the motion passed (4 -0) with the following vote: AYES: Hooker, Jarrell, Marrano, Peters NAYES: None ABSENT: Woltz Ms. Tucker apologized to her neighbors, stating she did not realize the neighbors were against the request. Final Orders 1. The petition of Richard L. Atkinson and Kay S. Atkinson to rezone approximately 4.068 acres from R -1, Low Density Residential, District to AR, Agricultural /Residential, District, located at 4835 Poor Mountain Road, Catawba Magisterial District was approved by the Board of Supervisors at a Public Hearing on October 22, 2013. Citizen Comments There were none. With no citizens requesting to speak, Mr. Peters closed the citizen comment period. Commissioners' and Staff Comments Ms. Hooker wished Mr. Peters and Mr. Jarrell well wishes in the Board of Supervisors election, noting it has been a pleasure serving with them on the Planning Commission.
