HomeMy WebLinkAbout10/1/2013 - MinutesMs. Martha Hooker Mr. Gary Jarrell Mr. Gene Marrano (arrived after approval of agenda) Mr. Jason Peters Commissioners Absent: Mr. Jim Woltz Staff Present: Mr. Philip Thompson Mr. Ruth Ellen Kuhnel, County Attorney Ms. Megan Cronise Ms. Becky Mahoney Ms. Susan McCoy, Recording Secretary Work Session: Mr. Peters called the work session to order at 4:01 p.m. Approval of Agenda Ms. Hooker made a motion to approve the agenda, which passed 3-0. Appro of Minutes The Commissioners agreed to delay action on the minutes until the evening session. Consent Agenda Ms. Mahoney provided an overview of the petition of Frank R. Radford and Mary E. Radford, including a brief history, existing zoning, and future land use of the property. Mr. Peters inquired about permitted signage. Ms. Mahoney discussed this issue. Ms. Pattisall provided an update of the of the State Central Bank petition, including the proposed removal of proffered trails and streetlights. She stated although no houses have been completed, one house is currently under construction in the subdivision. The Commissioners and Ms. Pattisall discussed the ownership of the property. Ms. Pattisall discussed the Loblolly Mill Master Plan and current proffered conditions, including density and underground utilities. Mr. Thompson, Ms. Pattisall, and the Commissioners discussed removing the proffered trails from the plan. Ms. Pattisall noted removing the proffer regarding trails from the master plan does not prohibit the development of trails. The Commissioners and Ms. Pattisall discussed County lighting standards. Ms. Cronise provided a PowerPoint presentation regarding the petition of Barry and Donna Tucker, including an overview of the petition, surrounding zoning, and future land ROANOKE COUNTY PLANNING COMMISSION MINUTES OCTOBER 1, 2013 use designation. She stated staff has not received any citizen concerns regarding this petition. Ms. Cronise and the Commissioners discussed the bed and breakfast use and design standards. Mr. Jarrell made a motion to approve the consent agenda, which passed 4 -0. Commissioners' and Staff Comments There were none. With no further comments, Mr. Peters adjourned the work session at 4:27 p.m. for site viewing. EVENING SESSION Mr. Peters called the Public Hearing to order at 7:01 p.m. He gave the invocation and led the pledge of allegiance. Ms. Hooker made a motion to approve the minutes of September 17, 2013, which passed 4 -0. The Commission delayed the approval of the September 3, 2013, until all Commissioners are present. The petition of Richard L. Atkinson and Kay S. Atkinson to rezone approximately 4.068 acres from R -1, Low Density Residential, District to AR, Agricultural /Residential, District, located at 4835 Poor Mountain Road, Catawba Magisterial District. Ms. Pattisall presented the staff report, including surrounding zoning and future land use designation. She reviewed the history of the petition and the suggested proffered conditions. She and the Commissioners discussed permitted uses in AR zoning. Mr. Thompson reviewed the zoning and future land use history of the area, noting it was previously zoned heavy industrial. Ms. Hooker inquired about the location of the waterline in the area. Mr. Thompson discussed this issue. Mr. Peters opened the public hearing for public comment. With no citizens requesting to speak, Mr. Peters closed the public hearing. Ms. Hooker made a motion to recommend approval of the rezoning with the following proffered conditions: 1. There shall be no more than 7 pigs allowed on the property. 2. All animal waste shall be disposed of in a way that will not create a health hazard or nuisance to adjacent property owners. Mr. Thompson called the roll and the motion passed (4 -0) with the following vote: AYES: H Hooker, Jarrell, M Page 2 of 4 ROANOKE COUNTY PLANNING COMMISSION MINUTES OCTOBER 1, 2013 Final Orders 1. The petition of Brambleton Baptist Church to obtain a Special Use Permit in a C- 1, Office, District for the operation of a religious assembly on approximately 0.58 acre, located at 4313 Old Cave Spring Road, Windsor Hills Magisterial District was approved by the Board of Supervisors at a Public Hearing on September 24, 2013. 2. The petition of 3 B Properties LLC, to amend the proffered conditions on property approximately 0.343 acre in size and zoned C -2C, General Commercial, District with conditions, located at 4345 Brambleton Avenue, Windsor Hills District was approved by the Board of Supervisors at a Public Hearing on September 24, 2013. Citizen Comments There were none. With no citizens requesting to speak, Mr. Peters closed the citizen comment period. Commissioners' and Staff Comments Mr. Thompson provided an update regarding the Plantation Road improvements. He stated community meetings to receive input from citizens are scheduled to begin in November. Mr. Jarrell made a motion to cancel the October 15, 2013 Planning Commission Work Session, which passed 4 -0. Mr. Thompson noted the next Planning Commission meeting would be held on Monday, November 4, 2013. Mr. Thompson briefly reviewed the petitions received for December public hearings, which include applications made by the Board of Supervisors and Gary and Tamera Tickle. The Commissioners, Ms. Kuhnel, and Mr. Thompson discussed the bylaws regarding absences of the Commissioners. Mr. Thompson and the Commissioners discussed participating on the Capital Improvement Program (CIP) Committee. Mr. Thompson requested the Commissioners contact staff if they are interested in serving on the committee.
