Approval of Minutes Mr. Radford moved to approve the minutes of August 5, 2008, and August 19, 2008, which passed 4 -0. Approval of Consent Agenda Ms. Hooker made a motion to approve the Consent Agenda, which passed 4 -0. Mr. Patriarca went over the petition of Mel Wheeler, Inc. The proposed new one hundred seventy (170) foot tower would be atop Poor Mountain within a cluster of existing towers. A photo simulation was included in the consent agenda packet. A balloon test will be conducted for the next meeting. There is no known opposition. Ms. Gilkeson gave a PowerPoint presentation of the proposed parking lot enlargement at Bonsack Baptist Church. The church is requesting sixty (60) new spaces over four (4) acres, to include a stormwater management pond. There are no new entrances proposed. Buffer requirements will be met. Mr. Thompson proposed the wrap -up of the Hollins Area Plan at the next meeting. Staff Comments Mr. Patriarca updated the commissioners on new information received from Starkey Medical. Page 1 of 4 ROANOKE COUNTY PLANNING COMMISSION MINUTES September 2, 2008 There was discussion of commercial vehicles being used as signage. "Signs" painted on or attached to a vehicle are two separate issues. This can be addressed during zoning ordinance review (first quarter, 2009). Site viewing for the evening was a driving tour of the Route 221 Plan study area. Site Viewing With no further comments, Mr. McNeil adjourned the work session at 4:31 p.m. EVENING SESSION; Mr. McNeil called the Public Hearing to order at 7:02 p.m. Mr. Azar gave the invocation and led the pledge of allegiance. The petition of Starkey Medical, PC to modify existing proffered conditions in a C-1C, Office District with Conditions, on 1.241 acres located at 5681 Starkey Road, Cave Spring Magisterial District was presented by Mr. Patriarca. Staff is recommending seven (7) conditions. Information was still coming in up until the time of the hearing. Staff requested a continuance until the October 7, 2008, meeting to allow sufficient time for review. Virginia Department of Transportation (VDOT) will need to review the information as well. Mr. Ray Craighead of Craighead and Associates, the architect, spoke on the petition. He stated the owner purchased the property with the intent of improvement and wishes to keep the "residential feel" of the property. Mr. Craighead stated the proposed building is a new, stand -alone structure, not an addition to the current one. The proposed building would have the same trim kits, windows, and roof lines and pitches to match the existing one. It would be approximately 1' 34" above the floodplain. Mr. Craighead preferred not to proffer landscaping. He voiced concern that he may not be able to obtain specified vegetation. He stated he had not had the opportunity to meet with staff to determine what existing vegetation could be retained. He could present a landscaping plan at site plan review. The building will be used for medical and general office use only. The proposed upper level would be medical offices. The existing building is used for their school of aesthetics. Floor plans have not changed from what was presented at the community meeting. The plan provides for thirty -four (34) parking spaces. By calculation, thirty -one (31) are required. Stormwater management has not yet been determined. He thought this would be handled at site plan review. It will probably be an underground retention system, which could possibly be used for irrigation also. Mr. Craighead agreed with the height and setback for signage; however, he was concerned that up- lighting may cause glare problems on Starkey Road. He stated neighboring businesses have back -lit signs. No sign plans were provided. There was discussion of the size of the sign. Mr. Patriarca verified that sign and landscaping proffers were derived from the original application submitted by the Petitioner. Mr. Craighead was agreeable to fifteen (15) foot light post(s), but wanted to place them on a pedestal for protection. He would prefer an eighteen (18) foot maximum height. No lighting plans were submitted. No refined, definitive site plan had been submitted at the time of the meeting. The commissioners felt there needed to be more coordination between the Petitioner and staff. More time was needed for submission and review of plans. Page 2 of 4 ROANOKE; COUNTY PLANNING COMMISSION MINUTES September 2, 2008 Mr. Roy Mitchell of 5680 Starkey Road, Roanoke, spoke on the petition. He lives directly in front of the Starkey Medical property. He voiced his concern that drawings distributed at the community meeting indicated the proposed building would be 4,750 square feet. This has increased by 39 %. He was also concerned that the parking lot layout was not definitive. He felt there were "gray" areas and staff could not make a complete assessment without all the necessary information. Mr. Dan Barnes, attorney representing Mr. and Mrs. Warren Coburn, spoke. The Coburn's live adjacent to the Starkey Medical property. Their property is landlocked and they make use of the easement road. Mr. Barnes stated that it appeared Starkey Medical clients would also use the easement. He stated any commercial entrance must meet VDOT standards and was concerned that a second entrance would cause confusion. He also stated the emergency entrance should not be in the right -of -way. The Petitioner holds the deed to the road; however, the Coburn's hold an easement, which the Petitioner cannot impede. Mr. Warren Coburn of 5669 Starkey Road, Roanoke, spoke on the petition. Mr. Coburn stated fifteen (15) feet is an acceptable width for a driveway, but not a road. He noted that when the property was originally rezoned in 1989, that Staff Report indicated a heavily traveled road with an average daily traffic count of 3,764. In 2006, this number exceeded 7,800. Since that time, there have been three (3) additional subdivisions built, with another under construction. The 1989 Staff Report also stated the north entrance to the property should be used for residential purposes only. Mr. Coburn suggested a thirty (30) foot buffer to his property. He also voiced concern that the parking arrangements were not definitive. Ms. Michelle Meinhardt of 4903 Starkey Road, Roanoke, spoke on her petition. She is the property owner. She clarified that there are currently two (2) full -time and two (2) part -time practitioners, which is considered as three (3) total. She would like to add a fourth practitioner in the future. Mr. Craighead stated the additional square footage from the plans distributed at the community meeting were the second floor of the new building. He also stated they do not intend on using the right -of -way and the emergency exit would be at least one (1) foot from the easement road. Mr. McNeil made a motion to continue the hearing until the October 7, 2008, meeting. Mr. Azar requested the Petitioner provide sign and lighting designs at the next meeting. Mr. Thompson called the roll and the motion passed 4 -0. AYES: Azar, Hooker, Radford, McNeil NAYES: None ABSENT: Jarrell 2. The petition of Kroger Limited Partnership to obtain a Special Use Permit in a C -2, General Commercial District, to operate a drive -in and fast food restaurant on 18.02 acres located at 3940 Valley Gateway Boulevard, Vinton Magisterial District was presented by Ms. Wood. There will be no seated dining or drive - through facility. The request is for Domino's Pizza delivery and pick -up only. Ms. Annette Morgan of 6919 Lynn Drive, Roanoke, for Kroger Partnership Ltd., and Mr. Tom Wallace of 2652 Cornwallis Avenue, Roanoke, for Domino's Pizza, spoke on the petition. Mr. Wallace is moving his business from the city into the county. Access will be via existing entrances to the development. Parking is within the general parking area for the shopping center. Signage is determined by Kroger's operation easement, which will be limited to one panel on Kroger's monument sign at the entrance to the development and one sign on the building above the restaurant. Page 3 of 4 ROANOKE COUNTY PLANNING COMMISSION MINUTES September 2, 2008 With no citizen comments, Mr. McNeil closed the public hearing. Mr. Azar requested two (2) additional conditions: 1) No temporary signs, 2) No parking of commercial vehicles (i.e. box trucks) with Domino's advertising. This would not include signs atop general delivery vehicles. He moved to approve the petition, with four (4) conditions, for a favorable recommendation to the Board of Supervisors. Mr. Thompson called the roll and the motion passed 4 -0. AYES: Azar, Hooker, Radford, McNeil NAYES: None ABSENT: Jarrell Final Orders The petition of George Kemp to obtain a Special Use Permit in a C -2, General Commercial District, to operate a drive -in and fast food restaurant on 1.56 acres located at 3100 -B Peters Creek Road, Catawba Magisterial District, was approved with conditions by the Board of Supervisors at their public hearing on August 26, 2008. The petition of Bill Hinton to obtain a Special Use Permit in a C -2, General Commercial District, to operate a car wash on 1.11 acres located at 4035 Challenger Avenue, Vinton Magisterial District, was approved with conditions by the Board of Supervisors at their public hearing on August 26, 2008. Staff Comments Mr. Thompson updated the commission on the Board of Supervisors' work session regarding parking of recreation vehicles on corner lots. The Board may be providing a draft ordinance to take to public hearing and for voting on by the Planning Commission. They feel owners of corner lots are being penalized. The County Attorney is working on the ordinance. There are concerns with staff possibly having to access private property to measure distances. There may also be limits set on the length of vehicles /trailers.
