Call to Order
Ms. Hooker called the meeting to order at 7:00 p.m. Mr. Marrano gave the invocation and
led the pledge of allegiance.
Approval of A genda
Mr. Woltz made a motion to approve the agenda, which passed 5-0.
Approval of Minutes
Mr. Jarrell made a motion to approve the minutes of January 7, 2014, which passed 5-0.
Consent Agenda
There are no petitions scheduled for public hearing on March 4, 2014.
Public Hearings
1. The petition, of Carol Lachowicz to rezone approximately 15.72 acres from PRD,
Planned Residential Development, District to AG-3, Agricultural/Rural Preserve,
District, located in the 7600 block of Apple Grove Lane, Windsor Hills Magisterial
District. Ms. Pattisall presented the staff report including a brief history and
current zoning of the property. Mr. Marrano inquired about density potential. Ms.
Pattisall discussed this issue. Mr. James inquired about land use designation.
Ms. Pattisall stated the property needs to have an agricultural zoning designation
in order to qualify for land use status and receive tax reduction.
Ms. Hooker opened the public hearing for public comment.
With no citizens requesting to speak, Ms. Hooker closed the public hearing.

Mr. Woltz made a motion to recommend approval of the rezoning.
Mr. Holladay called the roll and the motion passed (5 -0) with the following vote:

2. The petition of Daniel Smith to obtain a special use permit for a restaurant, drive -
in or fast food (snow cone stand) in a C -1, Low Intensity Commercial, District, on
approximately 0.33 acre located at 3540 Brambleton Avenue, Cave Spring
Magisterial District. Ms. Mahoney presented the staff report including current
and proposed zoning, surrounding commercial development, and existing access
to the property. She stated the owners of the property operate Melody Makers
onsite. She stated the petitioner will provide walk -up service only, with no
additional access or signage needed.
Mr. Marrano inquired about parking regulations. Ms. Mahoney discussed parking
availability and regulations. Mr. Marrano inquired about nearby restaurants. Ms.
Mahoney discussed this issue. Mr. Marrano inquired about signage and
screening plans. Ms. Mahoney discussed signage and screening regulations.
Mr. Marrano inquired about providing skirting for the trailer. Mr. James inquired
about electrical access for the trailer. Ms. Mahoney deferred both of these
issues to the petitioner.
Ms. Sarah Smith, 6085 Oriole Lane, stated skirting could be provided for the
trailer. She also discussed power and water source options. Mr. Marrano
inquired if it would be a seasonal business. Ms. Smith affirmed it would be a
seasonal business. She stated City of Salem and Roanoke City have snow cone
stands similar to the proposed stand.
Ms. Hooker opened the public hearing for public comment.
Mr. David Topping, 5314 Golden Eagle Lane, stated he owns the adjacent office
complex. He stated he is concerned that increased noise will disturb the tenants
located in his building. He stated currently Melody Makers uses his parking lot
for overflow parking, noting he has not given permission to them to park in his lot.
Mr. Brian Pauley, 3537 Bunker Hill, stated he has lived in the residence for 20
years. He stated his property adjoins the rear property line of Melody Makers'
property, noting a buffer was never installed between the properties. He inquired
about public restroom facilities and trash collection, noting seven to eight picnic
tables are currently on the property. He inquired about the addition of a turning
lane, noting it is difficult to access residential streets due increased traffic in this
area. He requested that consideration be given regarding impact to the
residential community. Mr. Pauley stated he also maintains his next door
neighbor's property who is elderly.

With no other citizens requesting to speak, Ms. Hooker closed the public hearing.
Mr. Marrano inquired about a traffic impact analysis (TIA). Ms. Mahoney stated
VDOT did not require a TIA due to limited use and less intense size of the
proposed business. Mr. Marrano inquired about buffering requirements. Ms.
Mahoney and the Commissioners reviewed buffering and landscaping
requirements and options. Ms. Mahoney noted noise ordinance issues are
enforced by the police department. Mr. Marrano inquired about restroom
requirements. Mr. Holladay stated a restroom facility would not be required. Mr.
Marrano inquired about refuse collection issues. Ms. Mahoney deferred to the
petitioner.
Ms. Maria Smith, owner of Melody Makers, stated they will have two regular trash
receptacles for refuse. She also stated the six picnic tables are currently used by
the students during outside projects. Ms. Sara Smith stated they are willing to
provide buffering as requested by the Commission. Ms. Maria Smith discussed
the hours of operation for both Melody Makers and the proposed snow cone
stand. She stated she was unaware that vehicles had been using the adjacent
parking lot for overflow parking. Mr. James inquired about side lot buffering. Mr.
Holladay and the Commissioners discussed side lot buffering and installing
fencing as a buffer. Mr. Marrano discussed the by -right uses for this property.
Mr. Marrano made a motion to recommend approval of the special use permit
with the following conditions:
1. The site shall be developed in general conformance with the concept plan.
2. The restaurant, drive -in or fast food use shall not exceed 300 square feet.
Mr. Holladay called the roll and the motion passed (5 -0) with the following vote:

Commissioners' and Staff Comments
Mr. Holladay discussed topics to be discussed at the February 18, 2014 Planning
Commission Work Session.
Mr. Holladay discussed the March 4, 2014 Planning Commission meeting, noting since
there are no petitions scheduled for public hearing, it will be a work session only.

Mr. Marrano encouraged everyone to donate blood due to the blood shortage.
Mr. James and Mr. Jarrell discussed the Plantation Road meeting, noting it was well
conducted and constructive citizen input was received.
Mr. Holladay and the Commissioners discussed the benefit of the recent stormwater
informational sessions.
Ms. Hooker suggested changing the districts to include Northside in the Hollins Plan.
With no further business or comments, Ms. Hooker adjourned the meeting at 7:51 p.m.
