Approval of Agenda Ms. Hooker moved to approve the agenda. Motion passed 4 -0. Approval of Minutes Mr. McNeil moved to approve the May 1, 2007, PCPH minutes. Motion passed 3 -0 -1 with Ms. Hooker abstaining. Mr. McNeil moved to approve the May 15, 2007, PCWS minutes. Motion passed 4 -0. Approval of Consent Agenda Mr. Holladay provided a brief overview of the Girl Scouts of Virginia Skyline Council, Inc., petition. Staff and the commissioners discussed various aspects of the petition. Ms. Hooker moved to approve the consent agenda. Motion passed 4 -0. Comments Mr. Thompson invited the commission to the free "Complete the Streets" workshop being held on June 14th. Mr. Thompson and the commissioners also discussed site viewing preferences. Site Viewing The meeting was adjourned for site viewing at 4:20 p.m. PUBLIC HEARING: Mr. Jarrell called the meeting to order at 7:00 p.m. Mr. Thomason gave the invocation and led the pledge of allegiance. The petition of Timothy and Rhonda Coleman to rezone 35.21 acres from 1 -2, Industrial District, to AG -3, Agricultural /Rural Preserve District, for the construction of a single family dwelling, located at 5242 Beason Lane, Catawba Magisterial District. Ms. Megan Cronise, Roanoke County Planning Department, presented the staff report. Ms. Rhonda Coleman spoke regarding the petition. She stated that in order to refinance and renovate the house, zoning will need to be changed. Ms. Hooker agreed with the proposed use. Ms. Hooker then made the motion to recommend approval of the rezoning request: AYES: Azar, McNeil, Thomason, Hooker, Jarrell NAYS: None ABSENT: None Motion passed 5 -0. 2. The petition of Roanoke County Library Services and Roanoke County Board of Supervisors to rezone approximately 28.71 acres from R -1, Low Density Residential District, to C -2, General Commercial District, to construct a public library, and to obtain a Special Use Permit in order to allow a drive -in restaurant within the public library, located at 5690 Merriman Road, Cave Spring Magisterial District. Mr. David Holladay, Roanoke County Planning Department, presented the staff report. Ms. Diana Rosapepe, Director of Library Services, spoke regarding the petition. She provided a powerpoint presentation. She and Ms. Diane Hyatt provided an explanation of the concept plans. Mr. Marshall Young provided a copy of an email to Ms. Young from Roanoke County regarding the property. He stated they had been told the property would be used as a park area. Ms. Judy Hawks, 5314 Amanda Lane, expressed concern regarding traffic. She also suggested details should be submitted prior to approving the petition. She expressed concern that a complete traffic study had not been submitted. Mr. McNeil discussed the need for the proposed library since the current facility is too small. He expressed concern regarding increased traffic, but noted traffic will need to be managed in order 2 to support growth. Mr. Azar inquired about the drive -in restaurant definition. Mr. Holladay discussed the definition. Mr. Azar expressed concern regarding future use of coffee -shop space. Mr. Holladay discussed possibly restricting the space to 1500 feet. He stated the petitioner wants flexibility for the coffee shop. Ms. Hooker noted the current library also has traffic issues. She stated the traffic improvements will be determined by VDOT. Mr. Azar expressed concern regarding non - conforming use of the property. He also expressed concern regarding incomplete traffic analysis information. He stated the coffee shop should serve the patrons of the library exclusively. Ms. Hooker expressed concern regarding traffic; however, she stated the use is a good fit for the area. Mr. McNeil then made the motion to recommend approval of the rezoning request: AYES: Azar, McNeil, Thomason, Hooker, Jarrell NAYS: None ABSENT: None Motion passed 5 -0. Mr. McNeil then made the motion to recommend approval of the SUP request with the following conditions: The site shall be developed in substantial conformance with the concept plan by OWPR Architects and Engineers, entitled Roanoke County Public Library, South County Library, dated April 13, 2007. 2. The cafe /coffee shop shall not exceed 2,000 square feet, and the drive- through service shall be generally located as shown on the above referenced site plan, with the drive -- through aisle designed to avoid conflict with pedestrian traffic and the main entrance. AYES: McNeil, Thomason, Hooker NAYS: Azar, Jarrell ABSENT: None Motion passed 3 -2. 3. The petition of LaSonja McKinstry to obtain a Special Use Permit to operate a family day care home on 0.22 acre, located at 2627 Creekwood Drive, Catawba Magisterial District. Ms. Becky Mahoney, Roanoke County Planning Department, presented the staff report. She also discussed letters of reference received in support of the petitioner. 3 Mr. McNeil inquired about minimum lot size requirements. Ms. Mahoney stated no minimum lot size is required for this use. Ms. Hooker inquired about the petitioner's current location. Ms. McKinstry stated she is currently taking care of children in other homes. Mr. Thomason inquired about the maximum number of children who will be in the home. Ms. McKinstry stated she will be taking care of eight children, none of which are members of her family. She stated she is currently requesting eight children but could request up to twelve. Mr. Jarrell inquired about her current licensing. She stated she has applied for licensing with the state. Mr. Azar inquired about state requirements. Ms. McKinstry explained the state will evaluate her home prior to licensing. She stated her mother will be assisting her in the daycare. She discussed her previous experience caring for children. Mr. Azar inquired about hours of operation. Ms. McKinstry stated her hours of operation will be 7:00 a.m. to 6:06 p.m. Mr. Azar suggested staggering pick -up and drop -off times in order to control traffic. Ms. McKinstry stated traffic would be minimal. Ms. Phyllis Jenelle stated she is a resident of the neighborhood. She expressed concern regarding having only one way into and out of the neighborhood. She stated children also play in the street. She stated the area is zoned for single family residences. She expressed concern regarding school bus safety in the area. Ms. Hooker stated the petitioner's backyard is fenced. She also noted the petitioner is making arrangements to minimize traffic. She stated she is impressed with the letters of recommendation. Mr. Azar inquired about invoking time restrictions on the SUP for future review by the Planning Commission. He expressed concern the commercial use will encroach on the neighborhood. Ms. Hooker stated staff will address complaints received on the daycare. Mr. Jarrell noted the state would suspend the license if they determine violations exist. Mr. Azar expressed concern regarding traffic safety during peak hours. Ms. Hooker noted traffic would be minimal since some children are from the same family. Mr. Mahoney noted enforcement is complaint driven. He explained the state would deal with violation Issues and revocation of the license. He discussed issues regarding placing time limits on the SUP. Mr. McNeil suggested tying the SUP to the state license. Mr. Mahoney discussed state revocation of the license. Mr. Holladay explained that use and design standards are part of the state licensing requirements. Ms. Hooker then made the motion to recommend approval of the SUP request with the following condition: 1. A maximum of eight (8) children shall be allowed. AYES: Azar, McNeil, Thomason, Hooker, Jarrell NAYS: None ABSENT: None Motion passed 5 -0. 4 Final Orders The petition of Ted Alan Leneave to obtain a Special Use Permit to construct an accessory apartment on 0.89 acre, located at 2132 River Oaks Drive, Catawba Magisterial District was approved by the Board of Supervisors at the Public Hearing on May 22, 2007. 2. The petition of Richard and Judy Taylor Wagner to rezone 0.369 acre from R -1, Low Density Residential District, to C -1, Office District for the operation of a beauty salon, located at 3722 Colonial Avenue, Cave Spring Magisterial District was denied by the Board of Supervisors at the Public Hearing on May 22, 2007. 3. The petition of Jatin Patel to rezone 0.844 acre from C -2C, General Commercial District with Conditions, to C -2, General Commercial District, to remove proffered conditions on properly located near the 8000 block of Plantation Road, Hollins Magisterial District was approved by the Board of Supervisors at the Public Hearing on May 22, 2007. 4. The petition of Roanoke County Board of Supervisors, Roanoke County Economic Development Authority, Novozymes Biologicals, Inc., and Tecton Products, LLC, to rezone 25.3 acres from R -1, Low Density Residential, to PTD, Planned Technology Development and to amend the covenants, conditions, and Master Plan on 454.25 acres zoned PTD, Planned Technology District, at the Center for Research and Technology (CRT), located near the 5300 block of Glenmary Drive, Catawba Magisterial District was approved by the Board of Supervisors at the Public Hearing on May 22, 2007. Comments Mr. McNeil discussed staff reports omitting staff recommendations. Mr. Thompson announced Ms. Amanda Komar has resigned from the Planning Department. There being no additional business, the meeting was adjourned at 8:39 p.m. 5 public library, located at 5690 Merriman Road, Cave Spring Magisterial District was approved by the Board of Supervisors at the Public Hearing on June 26, 2007. 3. Comments The commissioners and staff discussed the traffic impact analysis requirements. Mr. McNeil requested the transportation manager brief the commission on the traffic impact analysis guidelines.
