Motion passed 5-0. Approval of Minutes Mr.Azarmoved to approve December 7, 2004 Planning Commission Public HearingMinutes. Motion passed 5-0. Approval of Consent Agenda Mr.Thomason moved to approve the consent agenda. Motion passed 5-0. Approval of Planning Commission Meeting Dates Mr. Thomason moved to approve the meeting dates. Motion passed 5-0. Site Viewing The meeting was adjourned for site viewing at 4:21p.m. 1 PUBLIC HEARING: Ms.Martha Hookercalled the meeting to order at 7:00p.m. Mr. Azargave the invocation and led the pledge of allegiance. 1.The petition of Nextel Partners, Inc., to obtain a Special Use Permit to construct a 199 ft. broadcast tower, located at 432 Bandy Drive, near Windy (Continued from December 7, Gap Mountain, Vinton Magisterial District. 2004) Mr.Azarthen made a motion to continuetherequest for 60 days: Mr. NateHolland, Nextel Partners, Inc.,spoke representing the petitioner. He stated they had performed necessary testing. He stated he plans to discuss with county officials the possibility of using the county tower as soon as possible. He requested reducing the continuance to 30 days. Mr. Azar asked staff if 30 days would be sufficient. Mr. Murphy stated he had not been informed of specific issues Mr. Holland needed to discuss with county officials. Mr. Azar reaffirmed his motion to continue the request 60 days: AYES:Thomason, Azar, Hooker, McNeil, Jarrell NAYS:None ABSENT:None 2.The petition of Seaside Heights, LLC,to rezone .98 acres from C1, Office District to C-2, General Commercial District and to obtain a Special Use Permit on 2.22 acres for the operation of a fast food restaurant and drive- thru located at the intersections of Brambleton Avenue, Colonial Avenue (Continued from and Merriman Road, Cave Spring Magisterial District. Montgomery and Catherine R.Montgomery to obtain a Special Use Permit to construct a private stable, located at 861 Texas (Withdrawn at the request of Hollow Road, Catawba MagisterialDistrict. the petitioner) 2 4.The petition of M & M Developers, LLC, to rezone 17.034 acresfrom R4C, High Density Residential District with Conditions to R4C, High Density Residential District with Amended Conditions for thedevelopment of single family housinglocated at Plantation Road at theintersection of Hershberger Road, Hollins Magisterial District.Ms. Scheid, Roanoke County Planning Department, presented the staff report. Mr. Jarrell inquired aboutboundary limits of the property. Mr. Sean Horne, Balzer & Associates, spoke representing the petitioner. He stated the property extends to the centerline of Tinker Creek. Mr. Jarrell inquired about greenspace on the property. Mr. Horne explained the area which would be greenspace. He introduced Mr. Jake Quesenberry, Balzer & Associates,and Mr. Chad McGhee, owner of the property.Mr. Horne stated the proposed development will decrease the number of units which can currently be built on this property. He stated they will be Charleston style homes ranging in price from approximately $200,000 to $275,000. He provided an illustrated handout to the commissioners. He stated the area is considered urban core and residential. He stated the greenspace will be located along Tinker Creek. He stated the cemetery was flagged off after a study of the area was completed. He stated they are coordinating with VDOT regarding roadways. Mr. Jarrell inquired about traffic impact to the area. Mr. Horne stated the impact will be less with this development. Mr. Jarrell inquired about fire hydrants. Mr. Horne stated they will follow Western Virginia Water Authority (WVWA) standards. He stated they have received availability letters from WVWA.Mr. Jarrell inquired about the entrance to the property. Mr. Horne explained the proposed location of the entrance to the property. He stated they have been coordinating with VDOT. Mr. Azar inquired about cemetery access. Mr. Horne explained there is an existing easement on a steep slope of the property. He stated the petitioner is willing to provide a more accessible entrance to the cemetery. Mr. Azar inquired about parking availability in the development. Mr. Horne explained there would be on-street parking. Mr. McNeil asked if the petitioner had provided a parking allowance on the road. Mr. Horne explained the road would consist of 28 feet of pavement with curb and gutter. He stated theyintendto construct sidewalks. Mr. McNeil asked if the current easement allowing access to the cemetery would remain open. Mr. Horne affirmed the current easement would remain open. Mr. McNeil inquired about the greenway. Mr. Horne stated construction would not be allowed on the greenway. Mr. Thomason asked about increased traffic. Mr. Horne stated he has been coordinating with VDOT on these issues. He stated VDOT is aware of the traffic numbers. Ms.Hooker asked about build-out. Mr. Horne explained the current plan. Mr. McNeil asked about setbackallowancesif garages are included. Mr. Horne explained setbacks. He noted building will be based on topography. Mr. Chad McGhee stated all garages will be two (2) car garages with driveways. He noted the width of the arterial road will be 32 feet. He stated every house will have a driveway. Mr. Jarrell expressed concern regarding the creek. Mr. Horne stated they will not be disturbing the creek. 3 Mr. Jarrellthen made a favorable recommendation to approve the rezoning with the following conditions: 1.The developer hereby proffers substantial compliance with the Charleston Estates Master Plan dated November 23, 2004. 2.A greenspace easement shall be dedicated as shown on the Charleston Estates Plan dated November 23, 2004. 3.The developer shall dedicate a15 ft. easement to providepublicaccess to the existingcemetery. AYES:Thomason, Azar, Hooker, McNeil, Jarrell NAYS:None ABSENT:None 5. The petition of the Roanoke County Planning Commission to amend Section 30-74-4 (A)of the Roanoke County Zoning Ordinance. The purpose of the proposed amendment isto change the reference date for the Flood Insurance Study for Roanoke County prepared by the Federal Emergency Management Agency. The reference date will reflect the new Flood Insurance Study date of February 4, 2005, as amended. Mr. George Simpson, Assistant Director of Community Development Department, presented the request. He presented the revised flood map which will be in effect as of February 4, 2005. He explained this revision will allow FEMA to offer federally backed flood insurance to properties within Roanoke County. Mr.McNeilthen made a favorable recommendation to approve the amendment: AYES:Thomason, Azar, Hooker, McNeil, Jarrell NAYS:None ABSENT:None Citizens Comments There were no citizen comments. Comments Ms. Scheid stated the Planning Commission will begin working on the2005 Work Plan at their worksession on January 18, 2005.
