Motion passed 3-0. Approval of Minutes Mr.Jarrellmoved to approve the February 1, 2005minutes. Motion passed 3-0. Approval of Consent Agenda Mr.McNeil moved to approve the consent agenda. Motion passed 3-0. Adjournment for Site Viewing The meeting was adjourned for site viewing at 3:46 p.m. Joint Worksession with BOS Planning Commission and staff participated in discussion regardingthe Comprehensive PlanRevisions. Discussion of Community Plan Implementation Strategies Planning Commission and staff discussed Implementation Strategies and Workplan. Planning Commission established priorities for the 2005 Work Plan as follows: Stormwater Management Ordinance; Resource Protection ordinances including steep slopes, ridgetops, landscape and clear-cutting; Capital Improvement Plan including the Village Center and Neighborhood Commercial ordinances; revisions to the Cluster ordinance; and revisions to the Land Development Standards. 1 PUBLIC HEARING: Ms.Hookercalled the meeting to order at 7:03p.m. Mr. McNeilgave the invocation and led the pledge of allegiance. 1.The petition of Nextel Partners, Inc., to obtain a Special Use Permit to construct a 199 ft. broadcast tower, located at 432 Bandy Drive, near (Continued to March 1, WindyGap Mountain, Vinton Magisterial District. 2005)Ms. Janet Scheid,Roanoke County Planning Department, presented the staff report. Sheprovided an overview of the history of the petition. She stated the petitioner reported they were unable to fly the balloonat 199 ft. today due to windy conditions. Mr. Nate Holland spoke representing the petitioner. He stated high winds would not have allowed a true representation of the height of the tower. He requested the petition be continued for one month. Mr. Azar expressed concern regarding the impact an additional tower would have on Roanoke County’s 911 service. Mr. Holland stated a study was performed which showed there would be no interference with Roanoke County’s service. Mr. Azar inquired about road maintenance. Mr. Holland stated Nextel and nearby residents could not agree on a maintenance program. Mr. Azar asked Mr. Holland if the petitioner would be willing to sign a document agreeing to repair any damage made to the road by Nextel. Mr. Holland stated Nextel would be willing to sign such an agreement. Mr.Azarthen made a recommendation to continue the petition for 30 days: AYES:Azar, Hooker, McNeil, Jarrell NAYS:None ABSENT:Thomason 2.The petition of Seaside Heights, LLC,to rezone .98 acres from C1, Office District to C-2, General Commercial District and to obtain a Special Use Permit on 2.22 acres for the operation of a fast food restaurant and drive- thru located at the intersections of Brambleton Avenue, Colonial Avenue (Continuedby and Merriman Road, Cave Spring Magisterial District. request of the petitioner) 3.Request of the Roanoke County Building Commissioner to consider spot blight abatement of property at 3821 Colony Lane, Cave Spring Magisterial District.Mr. Joel Baker, Building Commissioner, stated the owner’s son had brought him a contract to repair the home. He stated the repairs are to be completedwithin 90 days. He stated he would provide the commission with a status report in 60 days.Mr. McNeil asked if the 2 project could be completed in 90 days. Mr. Baker stated90 days was a reasonable amount of time to completethe repairs.Mr. Jarrell asked to see the contract. Mr. Baker provided the commissioners with copies of the contract. He noted that the County’s desire has always been to have the owners repairthe house. He stated if the repairs are not complete within 90 days the County may require the petitioner to post a bondin order to continue the petition. Ms. Mary Stanley, 3820 Colony Lane, stated the property has been an eyesore for many years. Shestated the County has allowed the ownerto have the property in that condition. She expressed dissatisfaction with the County’s code enforcement. She stated the condition of the property is embarrassing to the surrounding property owners. Mr. Jarrell asked about the condition of the yard. Ms. Stanley stated the ditch is fullof debrisand rats and snakes have been seen on the property. Mr. McNeil explained the Spot Blight Abatement procedure is new to the County. He explained the procedurewas created in response to citizen complaints on this property. Ms. Stanley stated this property has not had running water since 1998. Mr. Bobby Cockram, 3815 Colony Lane, stated he resides next door to the blighted property. He stated the house burned over two years ago which created a hole in the roof. He stated water has been standing in the basementand itis unsafe. He stated his taxes increase even though the house has not been repaired. He stated he is embarrassed by the condition of thehouse. Ms. Margaret Sharpe, 3651 Cedar Lane, requested more detailed information regarding the 90 day continuance. Ms. Hooker deferred the question to Mr. Baker for more detailed information. Ms. Sharpe stated she represents the Green Valley neighborhood organization. She expressed concern regarding structural soundness of the house. She also expressed concern regarding keeping the property in satisfactory condition after the current repairs have been completed. Mr. Baker explained the policy and procedure. He stated the new policy is a direct result of the problems incurred from this property. He stated the County is trying to fairly protect the property owner and neighbors with this policy. Ms. Sharpe asked if the property will be inspected. Mr. Baker stated it will be inspected by County inspectors who are experienced with restoration of damaged homes. Mr. Cockram asked if the property has been inspected for damage prior to the repairs. Mr. Baker stated County inspectors have previously been in the house to inspect fire damage. Mr. Cockram expressed concern regarding water damage in the basement. Ms. Hooker stated inspectors will determine if there is any structural damage. Mr. Baker explained the 3 inspection procedures. Mr. Azar encouraged citizens to contact Mr. Baker if repairs are not made. Mr. Jarrell asked about the contractor’s rating. Mr. Baker stated he is a Class B contractor. Mr. Jarrell inquired about the payment method for repairs. Mr. Baker stated the owner has secured a homeequity loanto pay for repairs. Mr.McNeilthen made a recommendation to continue the requestfor 90 dayswith a status report being providedby the Roanoke County Building Commissioner in 60 days: AYES:Azar, Hooker, McNeil, Jarrell NAYS:None ABSENT:Thomason 4.The petition of Wayne and Martha Pike to obtain a Special Use Permit for a private kennel on 4.38 acres, located at 4509 Red Barn Lane, Vinton Magisterial District. Mr. David Holladay, Roanoke County Planning Department, presented the staff report. Mr. Wayne Pike and Mrs. Martha Pike spoke regarding the petition. Mr. Pike stated they have four small terriers which are part of their family. He stated their yard consists of 6,000 square feet of fenced area. Mr. Azar inquired if the petitioners’ agree with the design standards for private kennels. Both Mr. and Mrs. Pike agreed to the design standards. Mr. McNeil asked if they understood the request would be limited to four dogs. Ms. Pike stated they just want to be allowed to keep the dogs they have. Mr. Azarthen made a favorable recommendation to approve the rezoning with the following conditions: 1. The private kennel shall be for a maximum of four dogs. 2. The Special Use Permit shall be issued to Wayne and Martha Pike only, and shall not be transferable to any other subsequent property owner. AYES:Azar, Hooker, McNeil, Jarrell NAYS:None ABSENT:Thomason 4 Citizens Comments Ms. Sharpstated Mr. Bill Richardson, Code Enforcement Officer, has been helpful with the Colony Lane Spot Blight issue. She provided a history of enforcement on the property. She commended zoning staff on theirefforts to correct the problem. Comments There were nocomments. Final Orders 1.The request of Mid-Atlantic Realty, Inc. to rezone 0.68 acre from I-1 Industrial with Conditions to C-2 General Commercial with Conditions in order to construct a retail building located at the northwest corner of was Peters Creek Road and Cove Road, Catawba Magisterial District approved with conditions by the Board of Supervisors at the Public Hearing on February 22, 2005. 2.The petition of Jerome Donald Henschel, PC Architecture to obtain a Special Use Permit to construct a 24,400 square foot, multi-purpose, family life facility for the Ebenezer Baptist Church, located at 7049 was approved with Thirlane Road, Catawba Magisterial District conditions by the Board of Supervisors at the Public Hearing on February 22, 2005. 3.The petition of Cellco Partnership d/b/a Verizon Wireless to obtain a Special Use Permit to construct a 199 ft. broadcast tower and ancillary facilities, located at 3233 Catawba Valley Drive, Catawba Magisterial was approved with conditions by the Board of Supervisors at District the Public Hearing on February 22, 2005.
