Approval of Agenda Mr.Azarmoved to approve the agenda. Motion passed 5-0. Approval of Minutes Mr.Thomasonmoved to approve the March 1, 2005PCPH minutes. Motion passed 5-0. Approval of Consent Agenda Mr.Jarrellmoved to approve the consent agenda. Motion passed 5-0. Site Viewing The meeting was adjourned for site viewing at 4:10p.m. 1 PUBLIC HEARING: Ms.Hookercalled the meeting to order at 7:05p.m. Mr.Jarrellgave the invocation and led the pledge of allegiance. 1.The petition of Nextel Partners, Inc., to obtain a Special Use Permit to construct a 199 ft. broadcast tower, located at 432 Bandy Drive, near Windy Gap Mountain, Vinton Magisterial District. Mr. John Murphy, Roanoke County Planning Department, presented the staff report. He summarized the history of the petition. Mr. Nathan Holland reported on the balloon test and provided an overview of the request. Mr. Azar requested a condition be added allowing Roanoke County to locate the 911 antenna on the broadcast tower at no charge to the county. Mr. Holland agreed to the condition. He noted the tower will provide less impact sinceit is a monopole design, will not be required to be lighted and the area is wooded. Mr. Azar then made the motion to recommend approval of the special use permit with the following conditions: 1. No lighting and/or markings shall be permitted on the broadcast towerunless required by the FAA. 2. The broadcast tower, hardware and antennas shall be constructed of non-reflective materials to reduce visibility and reduce light reflection 3. Nextel Partners, Inc. shall allowRoanoke County to attach antennas to the broadcast tower, for public safety purposes, at no charge. AYES:Thomason, Hooker, Azar, McNeil, Jarrell NAYS:None ABSENT:None 2.The petition of Seaside Heights, LLC,to rezone .98 acres from C1, Office District to C-2, General Commercial District and to obtain a Special Use Permit on 2.22 acres for the operation of a fast food restaurant and drive- thru located at the intersections of Brambleton Avenue, Colonial Avenue (Continued by and Merriman Road, Cave Spring Magisterial District. request of the petitioner) 3.The petition of Christopher L. Irvine to rezone .52 acres from R-1, Low Density Residential District to C-1C, Office District with conditions for the operation of a general office, located at 3663 Colonial Avenue, Cave Spring Magisterial District. Mr. Tim Beard, Roanoke County Planning Department, presented the staff report.Mr. McNeil asked if VDOT will requireclosingoneof the two front entrances. Mr. Beard stated staff would recommend closing oneside of the horseshoe entrance since it is against design guidelines. Mr. McNeil inquired about runoff from grading for commercial entrance. Mr. Beard noted there is a well defined ditch in front of the house. He stated staff does not anticipate grading in the rear 2 of the property. Mr. Jarrell inquired about proffer #4 and potential changes in the area.Mr. Beard stated funds have been allocated for drainage improvements in the area. Mr. Christopher Irvine spoke regarding the petition. He stated he would be conducting a contracting business from this location. He described his current business operation. He stated the only things he would be adding to the location would be computers and desks for two employees, he and his secretary. Hestated he may possibly add an employee in future. He stated he requires minimal signage. He requested to place a sign near the front door for identification purposes. He stated his business would be very quiet. Mr. McNeilasked if the petitioner agrees with proffers. Mr. Irvine stated he has already signed the suggested proffers. Ms. Hooker noted the buffering will cover a large portion of the sideyard. Mr. Beard noted the buffering requirements are stipulated in the ordinance. Mr. McNeil notedneighbors did not make any negative commentsabout the rezoning during the hearing. Mr. McNeilthen made the motion to recommend approval of the rezoning with the following conditions: 1.Use of the property will be limited to a general office for Irvine Access Floors, Incorporated with no showroom, shopping or storage of materials onsite. 2.The existing one-story brick building shall not be enlarged and parking shall not exceed that required by ordinance. 3.Stormwater management on the property shall be achieved only by bio-retention methods including subsurface percolation if necessary. 4.No new asphalt or other comparable impervious surfaces shall be constructed behind the rear wall of the existing building. 5.Hours of operation shall be limited to8:00 am to 6:00 pm, Monday through Friday with no weekend operating hours. 6.Applicable Colonial Avenue Corridor Design Guidelines shall be in effect with the word “shall” replacing the word “should” as determined during the site plan review process. The petition of KTP, LLC to obtain a Special Use Permit for the construction of mini-warehouses on 5.602 acres, located at 1918 Washington Avenue, Vinton Magisterial District. Mr. David Holladay, Roanoke County Planning Department, presented the staff report. Mr. Alex Perkins spoke regarding the petition. He described buffering, visibility, and aesthetics of the facility. He stated mini-warehouses will create little impact on traffic. Mr. Azar stated he would like more detailed information regarding buffering of the site. He asked about removing the 3 nearby billboard. Mr. Perkins stated he is unsure of the signage lease agreement with Carilion. He stated if possible, he will remove the billboard. He displayed an aerial photo of a similar facility. He discussed visibility of facilityand said the facility will be attractive. He stated he will have on site management from 9:00-5:00 Monday through Friday and 9:00 -noon on Saturday. He stated the entrance will be from behind the shopping center. He noted the impact on the existing daycare would be minimal. He stated they will have a six foot security fence. Mr. Azar stated he would like to have a Community Meeting to acquire input from neighbors. Mr. Thomason expressed concern regarding stormwater management with the addition of facility. Mr. Perkins stated the map shows the current contours of the property.He stated the property will be bowl shaped. He stated engineers will design the stormwater management provisions. He stated no neighbors will be impacted. He noted he cannot acquire a building permit without the stormwater management design. Mr. Azar stated he feels there is a need for a Community Meeting. He stated he is not opposed to the petition but requires more information than that which has been provided. He requested a more comprehensive site planincluding buffering,advertising and signage layouts, and stormwater management provisions. Mr. Thomason concurred more information is needed regarding stormwater management. Mr. Azarthen made the motion to continue the petition for 30 days: AYES:Thomason, Hooker, Azar, McNeil, Jarrell NAYS:None ABSENT:None 5.The petition of Alan and Gayle Jamison to rezone 79.09 acres from I-2, Industrial District to AG-3, Agricultural/Rural Preserve District in order to construct a single family residence, located at 4518 Morgan Conner Lane, Catawba Magisterial District. Mr. David Holladay, Roanoke County Planning Department, presented the staff report. Ms. Hooker reviewed area zoning history. Mr. Holladay stated that although the 1-2 zoningappearedappropriate on paper, upon closer inspection of the property and the topography, the I-2change appears less desirable.Mr. McNeil asked if the property is rezoned, how many homes can be built by right. Mr. Holladay explained the development of a public street would be required in order to develop the property. He stated potentially approximately 30 homes could be constructed on this property if rezoned to AG-3and with the construction of a public road. Mr. McNeil expressed concern regarding changing industrial zoned areas back to 4 agricultural since very little industrial property isavailable. Ms. Hooker concurred. Mr. Alan Jamison spoke regarding the petition. Ms. Hooker asked about future use of the property. Mr. Jamison stated he plans to build a single family home and repair fencing around property. Ms. Hooker asked staff about subdividing the property. Mr. Holladay stated the petitioners would need to purchase surrounding property and acquire approval from Norfolk Southern in order to build a public road. Mr. Thomason asked about potential development of property. Mr.Holladay stated the petition could develop the property under AG-3 standards. He discussed surrounding properties. Mr. McNeil asked about the most restrictive zoning regarding density. Ms. Scheid stated AG-3 is the most restrictive agricultural zoning currently available in the county. Ms. Edith Morgan, 4541 Morgan Conner Lane, asked about development of the property. Ms. Scheid explained the construction of a public road would be required in order to build a subdivision. Ms. Morgan stated her family has maintained the access road. Mr. William Joseph Morgan,4541 Morgan Conner Lane, stated since neither water/sewer lines ortrash pick-upisavailable on their private road, the property is unsuitable for the development of a subdivision. Mr. Homer Duncan, 4571 Morgan Conner Lane, stated the nearby railroad crossing is dangerous. He stated he has no objection to building one home. He stated he has assisted pulling several vehicles off of the railroad tracks. Ms. Doris Conner, 4437 MayfairDrive, stated she is unaware of anyone having been stuck on the railroad tracks. Mr. V. G. Conner, Jr., 4437 Mayfair Drive, stated he has maintained the access road. He stated he has owned the property since 1937. He stated the Morgans have tried topurchase a small portion of his property. He stated he wants to sell the property to assist with his retirement. Mr. McNeil expressed concern regarding future use of the property. Mr. Azar expressed concern regarding loss of industrial zoned property. He stated he is less concerned with the development of a subdivision due to the prohibitive cost of constructing a public road. Mr. Jarrell expressed concern regarding access to the property. Ms. Hooker inquired about deeded access to the property. Mr. Holladay stated tax maps are not plat line maps but only general representation of the property. Mr. McNeil remarked right of way is not the issue before the commission. Ms. Hooker expressed concern regarding elimination of industrial zoned property. She 5 stated steep gradesand restrictive access will make substantialchanges to the propertydifficult. Ms. Hookerthen made the motion to recommend approval of the rezoning: AYES:Thomason, Hooker, Azar, Jarrell NAYS:McNeil ABSENT:None 6.The petition of James C. and Laura B. Parrish to obtain a Special Use Permit for the construction of an accessory apartment, located at 3216 Lawndale Road, Windsor Hills Magisterial District. Ms. Tammi Wood, Roanoke County Planning Department, presented the staff report. Mr. Thomason asked staffif thepetitionersunderstood the restrictions of the proposed special use permit. Ms. Wood stated the petitioners have been informed of the restrictions and requirements. Mr. Thomason also asked the petitioners if they understood the conditions. Ms. Parrish stated she and Mr. Parrish wereaware of the conditions and agreed to comply with county regulations. Mr. Thomasonthen made the motion to recommend approval of the special use permit with the following conditions: 1.The location of the accessory apartment shall be limited to the basement of the principal structure. 2.All parking shall be restricted to the proposed driveway. 3.Approval of the Special Use Permit is contingent on the property owner’s residing on the property upon the effective date of the final inspection. AYES:Thomason, Hooker, Azar, McNeil, Jarrell NAYS:None ABSENT:None Citizens Comments There were no citizen comments. Comments Mr. Jarrell inquired about the Colonial Avenue Spot Blight Abatement case. Ms. Scheid stated she will inquire about the progress being made regarding repairs to the property. She noted Mr. Joel Baker is scheduled to provide a progress report at the Planning Commission meeting on May 3, 2005. Mr. Thomason commended everyone on completion and BOS approval of the Comprehensive Plan. Ms. Hooker inquired about subdivision development 6 regulations. Ms. Scheid and Mr. Murphy provided more detailed information regarding site plan review and approval. Mr. McNeil asked about specific subdivision requirements. Mr. Murphy explained requirements for both minor and major subdivision developments. Final Orders 1.The petition of Wayne and Martha Pike to obtain a Special Use Permit for a private kennel on 4.38 acres, located at 4509 Red Barn Lane, Vinton was approved with conditions by the Board of Magisterial District Supervisors at the Public Hearing on March 22, 2005. 2.Public Hearing to receive public comments on a proposal to adopt a revised Community (Comprehensive) Plan for Roanoke County, Virginia. The proposed Community Plan is comprised of both text and maps. Once recommended by the Planning Commission and adopted by the Board of Supervisors, the plan will serve as a general guidefor the long range use and development of all land within Roanoke County. The proposed plan has been prepared in accordance with guidelines contained in Sections 15.2-2223 and 2224 of the Code of Virginia, and Section 30-8-1 of the was approved by the Board of Roanoke County Zoning Ordinance Supervisors at the Public Hearing on March 22, 2005.
