ROANOKE COUNTY PLANNING COMMISSION MINUTES

WORK SESSION:
Session opened at4:00p.m. by Ms. Hooker.
Approval of Agenda
Mr. Thomasonmoved to approve the agendaas amended. Motion
passed 5-0.
Approval of Consent Agenda
Mr.Azar moved to approve the consent agenda. Motion passed 5-0.
Approval of Minutes
Mr.Azar moved to approve the June 7, 2005minutes. Motion passed 5-0.
Update on Spot Blight Abatement Petition
Mr. Joel Baker provided pictures of improvements made to the interior of
the property. He stated floor covering has notbeen installedand that
drainage will be improved by grading and reseeding of yard. He stated he
is currently pleased with progress of renovationsbut that someadditional
improvements are still needed. He recommended removing the existing
storage building from the premises. Mr. McNeil asked about occupancy.
Mr. Baker discussed protocol regarding occupancy in relation to Spot
Blight Abatementprocess.

Comments
Mr. Thomason expressed concern regarding repeatedly continuing
Seaside Heights petition. Mr. Holladay provided an update regarding the
traffic study submitted by petitioner. He noted Ms. Mary Ellen Goodlatte,
Esquire, now represents the petitioner. Mr. Azar stated he would like to
review staff findings to date. Mr. McNeil asked about VDOT’s findings.
Mr. Holladay stated VDOT has been reviewing the traffic study.

PUBLIC HEARING:
Ms.Hookercalled the meeting to order at 7:00 p.m. She gave the
invocation and led the pledge of allegiance.
1. The petition of Seaside Heights, LLC,to rezone .98 acres from C1,
Office District to C-2, General Commercial District and to obtain a
Special Use Permit on 2.22 acres for the operation of a fast food
restaurant and drive-thru located at the intersections of Brambleton
Avenue, Colonial Avenue and Merriman Road, Cave Spring
(Continued until August 2, 2005)
Magisterial District.
2.The petition of the Board of Supervisors concerning Proposed
Amendments to the Zoning Ordinance –Private Kennels, by
changing the title of this use, increasing the number of dogs,
eliminating the minimum lot size standard, and deleting this use
from the R-2 zoning classification.Mr. David Holladay, Roanoke
County PlanningDepartment,presented the staff report.He
reviewed the proposed Zoning Ordinance Amendment.
Mr. McNeil inquired about how the amendment will affect
R-1 and R-2 zoned areas. Mr. Holladay explained the amendments
as theywill apply to each zoning designation.
Mr.Azarthen made the motion to recommend approval of the
request:

3The petition of Church of the Holy Spirit to obtain a Special Use
.
Permit to expand a religious assemblyfacility on 15.24 acres,
located at 6011 Merriman Road, Cave Spring Magisterial District.
Ms.Kate Youngbluth, Roanoke County Planning Department,
presented the staff report. Mr. Azarinquired about Development
Review findings regarding stormwater issues. Ms. Youngbluth
reviewed an email from staff regarding this issue. Ms. Hooker
expressed concern about a retention pond being overgrown. Ms.
Youngbluth noted engineering staff is aware of overgrowth.
Mr. Ed Natt, Esquire, spoke representing the petitioner.He
discussed storm management issues. He stated Mr. Jim Dillon,
contractor, is currently taking steps to correct this issue. He stated
they will address the silt fences. Hestated the petitioners know

they will need to take significant steps regarding erosion and
sediment control. Mr. Natt explained the site planto the
commission.He provided a brief history of the church. He stated
the traffic count appeared excessive. Mr. Holladay noted it is and
‘in and out’ count. Mr. Natt discussed membershipof the church.
He stated the orientation of the building may change in order to
take advantage of the surrounding views. He stated the church has
acquired sufficient pledgesfrom the congregation to complete the
entire project. Mr. McNeil inquired about aremedy for stormwater
runoff. Mr. Natt stated they have not completed final development
planswhich would include stormwater management. He stated the
church wants toacquire requested SUP first. Mr. McNeil inquired
about the retention pond. Mr. Natt said itis currently in the design
stage. Mr. Azar expressed concern that existing problem has not
been addressed. Mr. Natt stated they were unaware of problem
until recently. He stated they are currently taking steps to improve
this problem. He stated the congregation did not want to spend any
funds onthe project until it is approved by the county. He stated
they will do what is requiredby the county.He noted a recent
youth activity may have caused some E & S problems on the
property. Mr. Thomason encouraged the petitioners to correct
stormwater runoff problems. Mr. Jarrell asked about asmall pond
of water in one of the photos. Mr. Natt stated the photo is of the
areaof arecent youth activity.Mr. Jarrell expressed concern
regarding stormwater management. Ms. Hooker stated some silt
fencing ismissing. Mr. Natt stated the petitionerswill need to
check into this issue. He stated they will have Mr. Dillon contact
county staff regarding regulations.
Ms. Glendora Raplee, 5971 Cartwright Drive, expressedconcern
about runoff. She noted the church has been a good neighbor.
Mr. McNeil stated the stormwater management issueswill needto
becorrected.
Mr. McNeil then made the motion to recommend approval of the
SUP request with the following conditions:
1.Merriman Road will be the only access to the site.
2.A total of 22 parking spaces, shown on [the 2-1/94] concept
plan nearest rear yard border of 5959 Barbara Circle, will not
be constructed, resulting in a minimum 40 foot buffer.
3.The parking plan and the development plan shall be in
substantial conformity with the Site Plan prepared by Balzer
and Associates, Inc. under the date of April 18, 2005.

Final Orders
1.The petition of Fralin & Waldron, Inc. to rezone approximately 50
acres from AG-3, Agriculture/Rural Preserve District to R-1, Low
Density Residential District for the construction of single family
dwellings, located northwest of the 5800 block of Crumpacker Drive
and 6200 block of Apple Harvest Drive, Hollins Magisterial District
was approved by the Board of Supervisors at the Public
Hearing on June 28, 2005.
2.The petition of Daniel W. Doss to obtain a Special Use Permit for
the operation of a used automobile dealership on .467 acres,
was
located at 6717 Williamson Road, Hollins Magisterial District
approved by the Board of Supervisors at the Public Hearing on
June 28, 2005.
Comments
Ms. Hooker requested anupdate on the Regional Jail at a Planning
Commission worksession.
There being no additional business, the meeting was adjourned at7:45
p.m.
