WORK SESSION:
Session opened at 4:00p.m.
Approval of Agenda
Mr.Azarmoved to approve the agenda. Motion passed 4-0.
Approval of Minutes
Mr.Thomason moved to approve the October 4, 2005 PCPH andOctober 18,
2005 PCWS minutesas amended. Motion passed 4-0.
Approval of Consent Agenda
Mr.Azarmoved to approve the consent agenda. Motion passed 4-0.
Comments
Mr. Steve Noble inquired about the status of the existing Master Plan for Explore
Park. Mr. Holladay stated it would be replaced by the requested rezoning if
approved. Mr. Noble asked if there was any requirement that Virginia Living
Histories lease the entire acreage being rezoned, i.e., 773 acres or if he could
lease some smaller portion of land. When told there was no requirement that the
entire 773 acres be leased Mr. Noble inquired what would happen with any
remaining property, not leased, but rezoned to Explore Park District. Mr. Frank
Porter expressed concern regarding allowing the rezoning ofExplore Park.

Ms. Martha Hooker called the meeting to order at 7:00p.m. Mr. Steve Azargave
the invocation and led the pledge of allegiance.
Resolution Requesting the Roanoke County Planning Commission to
Consider Amendments to Section 30-71, EP Explore Park District, of the
Roanoke County Code. Ms. Hooker presented the proposed resolution.
Mr. McNeil made the motion to approve the Resolution as presented:

PUBLIC HEARING:
1.The petition of Grant Avenue Development, Inc. to rezone 1.3014 acres
from C-1, Office District and .0786 acres from C2C General Commercial
District with Conditions to C-2C, General Commercial District with
Conditions and to obtain a Special Use Permit for the construction of a
fast food restaurant with drive-thru, located at 3814 Challenger Avenue,
Hollins Magisterial District. Ms. Kate Youngbluth, Roanoke County
Planning Department, presented the staff report and a powerpoint
presentation.
Mr. Ed Natt, spoke representing the petitioner. He introduced Mr. Dan
Lovern, Regional Manager of Arby’s. He statedthat Mr. Mark Dunn, Grant
Avenue Development, was unable to attend the meeting. He reviewed the
site plan. He discussed the citizen concerns voiced at the community
meeting.He explained the topography, landscape buffering, signage,
and lighting proposed forthe property. He noted the in his opinion the
requestis in line with the Comprehensive Plan if the profferedconditions
are included.Mr. Nattstated the main concerns of the citizens are
lighting and traffic. He discussed the peak hours of operation of the
facility in relation to peak hours and traffic flow normally on West Ruritan
Roadandstated they would support loweringthe 55 mph speed limiton
Route 460 for safety reasons.He introduced Mr. Paul Brown of T.P.
Parker. Mr. Azar inquired about buffering. Mr. Natt stated a 30 ft.
landscape buffer and 6 ft. fence would be installed. Ms. Hooker asked
about the right of way. Mr. Ford suggested the applicant contact VDOT
regarding the right of way. The petitioners stated they have submitted
traffic information to VDOTbut not to Mr. Ford. Ms. Hooker asked about
stacking of vehicles.

Mr. Al Moyer, 1879 West Ruritan Road, stated the traffic count averages
reported by the petitioner are deceptive. He expressed concern regarding
traffic safety. He stated the proposed use is not appropriate. He
expressed concern regarding potential accidents near the crest of the hill.
He expressed safety concerns regarding the ingress and egressacross
the “ACleaner World”parking lot. He stated his family typically makes
approximately 12 trips on West Ruritan Road daily.
Mr. Robert Patton, 1452 West Ruritan Road, stated this location is not a
good place for a fast food restaurant. He stated Route 460 East has
enough fast food restaurants. He requested that the Planning
Commission deny the rezoning.
Mr. Chris Craft spoke in favor of the petition. He stated if drivers would go
the speed limit or less, problems could be avoided. He statedthey can
find safe ways to have the restaurantat this location. He stated revenue
needs to be kept in the county.
Mr. Travis Lang, 2503 Bloomfield Road, expressed concern that more
accidents would occur due to traffic back-up. He stated thereareno
turninglanesoff of Route 460Eastnear thisarea. He expressed concern
regarding trash generated from the restaurant. He also expressed
concern regarding an increase in accidents behind “A Cleaner World.”
Mr. McNeil suggested the petitioner fund a turning lane. Mr. Ford stated
that VDOT would welcome the offer of fundsandsuggested discussing
this issue with VDOT. Mr. Azar expressed aboutthe petition since Mr.
Ford hasnot received thetraffic studiesfrom the petitioner. Mr.
Thomason stated answers are needed from VDOT before making a
decision on thispetition. Mr. Ford suggested the petitionerconsult with
both VDOT and county staff.
Mr. Azar stated dialogue with all interested parties is needed. He
suggested continuing the request 60 days in order for staff to fully
research the request. Mr. Natt requested the continuance be reduced to
30 days. Mr. Azar then amended his motionto grant a continuance for 30
dayswith the following conditionsand proffer:
Conditions:
1) The subject property, 3814 Challenger Avenue, shall have no direct
access to or from Route 460.
2) Up to 10’ of right of way shall be dedicated by the developer to VDOT
on WestRuritan Road for a right turn lane onto Route 460.

3)The cross access easement shown on “Concept Plan for GRANT
AVENUE DEVELOPMENT” under the date of August 30, 2005 revised
October 25, 2005 between 3806 Challenger Avenue and the subject
property shall be developed in substantial conformance with the
concept plan to allow cross access between the two sites, West
Ruritan Road and Trail Drive.
4)The hours of operation shall conclude no later than 11:30 PM.
5)The top of any light fixture shall not exceed 15 feet in height.
6)Dumpsters shall not be emptied between the hours of 10:00PM and
7:00AM.
7)The proposed sign shall be no greater than 18 feet in height from grade.
8)The building design and color scheme shall be in general conformity
with the Photos dated October 25, 2005.
9)The subject property will be developed in substantialconformity with the
“’Concept Plan for GRANT AVENUE DEVELOPMENT” requesting the
Rezoning and Special Use Permit of Parcel C-1 to Construct an Arby’s
Restaurant” submitted by T.P. Parker & Son, Engineers, Surveyors and
Planners, under the revised date of October 25, 2005 and with the
subsequent revisions made during the Planning Commission hearing
dated November 1, 2005.

1)The hours of operation shall commence no earlier than 10:00 AM on
each morning.

Comments
Mr. Azar encouraged staff tonotify thecommissioners if the petitioner has not
provided information needed to completely analyzethe petition.
Final Orders
1.The Request of the Roanoke County Building Commissioner to consider
spot blight abatement of property at 3821 Colony Lane, Cave Spring
was approved by the Board of Supervisors at the
Magisterial District
Public Hearing on October 25, 2005.

2.The petition of R. Fralin Development Corporation to rezone
approximately 9.95 acres from R-1, Single Family Residential District to
PRD, Planned Residential District with conditions to construct 60
townhomes at a density not to exceed 6.1 units per acre, located at the
corner of Newland Road and Peters Creek Road, Hollins Magisterial
was approved by the Board of Supervisors at the Public
District
Hearing on October 25, 2005.
3.The petition of the Board of Supervisors to amend the Roanoke County
Zoning Ordinance, Section 30-29-5 commercial use types to include a
new definition for “adult business”, and Section 30-54-2(B)2 C-2 General
Commercial to add adult business as a use allowed only by special use
permit and Section 30-85-__ to add additional use and design standards
was approved by the Board of Supervisors at the
for adult businesses

4.The petition of Winter Properties Partnership, LLC to obtain a Special Use
Permit to construct mini-warehouses on 1.503 acres, located at 2205
was approved by the
Washington Avenue, Vinton Magisterial District
Board of Supervisors at the Public Hearing on October 25, 2005.
There being no additional business, the meeting was adjourned at 8:10p.m.
