Approval of Agenda Mr.McNeilmoved to approve the agenda. Motion passed 3-0. Approval of Minutes Ms.Hookermoved to approve the November 7, 2006 PCPH minutes. Motion passed 3-0. Comments Mr. Thompson presented the Planning Commission Secretary’s Report datedDecember 5, 2006.He provided updates to the commissioners regarding Administration, Planning, Transportation, and Zoningissues. Site Viewing The meeting was adjourned for site viewing at4:49p.m. 1 PUBLIC HEARING: Mr.Azarcalled the meeting to order at 7:00 p.m. Mr.Jarrellgave the invocation and led the pledge of allegiance. 1.The petition of Hidden Valley Villas, LLC torezone 24.46 acres from R-1, Low Density Residential, to R-3,Medium Density Multi- Family Residential, in order to construct multi-family dwellingsat a maximum density of 5.15 dwelling units per acre, located at 4800 (Continued until Keagy Road, Windsor Hills Magisterial District. January 2, 2007at the request of the petitioner) 2.The petition of Lexington Falls, LLC, torezone approximately 2.35 acres from C-1, Office District, and R-3, Medium Density Multi- Family Residential,to C-2, General Commercial District, and to obtain a Special Use Permitin order to construct a drive-thru restaurant, located at 6065 Peters Creek Road, Hollins Magisterial District.Ms. Megan Cronise, Roanoke County Planning Department, presented the staff report.She suggested changing the zoning on parcel #2 to C-1, Office District.Mr. Azarasked if the petitioner was aware of the proposed change in rezoning of C-1of the back parcel.Ms. Cronise affirmed the petitioner is aware of the proposed change to C-1 for parcel #2. Mr. Sean Horne, Balzer & Associates, spoke representing the petitioner. He stated the petitioner plans to construct and operate a Bojangles restaurantwith a drive-thru. He explained the revised site plan. He discussed access points, landscaping, buffering, stormwater management, lighting,and signage.He stated the petitioner agrees with rezoning parcel #2to C-1.Mr. Azar inquired about C-1uses.Mr. Thompson discussed by-right uses. Mr. Jarrell expressed concern regarding increased traffic on Burlington Road. Mr. Horne noted the amount of traffic will depend upon the future use of parcel #2. He stated the rezoning will bring the propertyinto conformity with surrounding properties. Mr. Jarrell asked if Burlington Road meetsVDOT standards. Ms. Cronise statedit doesnot currently meetVDOT standards. Mr. Thompson noted VDOT would address this issue during their review process. He stated VDOT previously indicated that Burlington Road would need to be upgraded if development impactedBurlington Road traffic. Mr. McNeil inquired if a cut-thru would be constructed between the two parcels. Mr. Thompson explained if this occurs it would need to be rezoned since the site plan is being proffered. Mr. Horne clarified the proffers apply to the front parcel only. Ms. Hooker inquired about signageand lighting. Ms. Cronise discussed design guidelines for both signage and lighting. Mr. Azar stated since the property is outside the Williamson Road Hollins Village Design Guidelines, they shouldbe flexible with requirements. He suggested continuing the request to allow the petitioner and staff more time to discuss detailsof the conditions. He stated churches are allowed to have the type of signage lighting the petitioner has requested. Ms. Hooker stated neighboring businesses would be held to the Williamson Road Hollins Village Design Guidelinesstandard. Mr.Azar stated the petitioner needs 2 to have specific conditions. Mr. Horne described the preferred signage lighting. Mr. Seymour stated he would like to keep some of the plantings currently on the property. Mr. Jarrell inquired about types of lighting requested. Mr. Horne explained advantages and disadvantages of types of lighting. He stated the type of lighting requested is part of the petitioner’s corporate image. Mr. Seymour stated he wants lighting which will insure patron safety. Mr. Jarrell presented some pictures of code violations on the petitioner’s property. Mr. Seymour stated they will bringthe property into compliance. Mr. McNeil stated the lighting is agreeable. Ms. Hooker inquired about height of lighting poles. Mr. Horne discussed proposed lighting. Mr. James Douthat, 2625 Ridgewood Drive, spoke in support of the petition. He stated he owns adjoining property. He stated aligning the access with Dwight Road will allow stacking of cars off the roadway.He stated he also supports rezoning parcel #2 to C-1. Mr. Dave Newhouse, 1347 Vivian Avenue, expressed traffic safety concerns when re-entering Peters Creek Road. He suggested using signage allowing right turnsonly out of the parcel. Mr. Jarrell inquired about the installation of a traffic light if adjoining property is developed. Mr. Horne stated this will depend on requirements of buildout on the property. Mr. Azar noted VDOT will make this determination. Mr. Jarrell then made the motion to recommend approval of the rezoning request with the following proffered conditions: 1)The developer hereby proffers general conformance with the “Bojangles Restaurant –Concept Masterplan”, prepared by Balzer and Associates, Inc. dated 10-27-06, revised 11-15-06, and last revised 11-27-06, submitted with rezoning and special use permit application 31-12/2006 with no deviation from the shared entrance with the property to the north as shown. AYES:Azar, McNeil, Hooker, Jarrell NAYS:None ABSENT:Thomason Motion passed 4-0. The commissioners, staff, and petitioner discussed revisions to suggested conditions for the SUP. Mr. Jarrell then made the motion to recommend approval of the SUPwith the following conditions: 1) A monument-style sign shall be constructed measuring no greater than 5 feet tall and 7 feet wide. The sign face shall be 3 surrounded by brick to match the building and shall include architectural features such as a pre-cast concrete cap and base. 2) Signage placed on the building shall occupy less than five percent of the building façade area. 3) Off-premises signs shall be prohibited. 4) The building shall be constructed in a style substantially conforming to Exhibit B, an accepted proffered exterior from the approved November 2005 Seaside Heights, LLC rezoning and special use permit for a Bojangles drive-in restaurant (case numbers 32-12/2004 and 33-12/2004), except that from grade to eave, all walls shall be constructed with at least two colors of red or brown brick instead of white brick. 5) Additional landscaping shall be provided.In particular, the dumpster enclosure shall be screened by tree and shrub plantings, additional trees shall be planted in the parking lot, a perimeter planting bed shall be designed in front of the parking spaces facing Peters Creek Road, additional landscaping shall be planted around the picnic area to further delineate it as a site feature, and all plants used shall conform to the Plant Palette listed in the Williamson Road Hollins Village Design Guidelines. 6) Light poles shall be black, gray, or grayish-brown. Light fixtures shall be directed downward and inward into the site, shall be no taller than 15 feet in height, and shall not be cobra-head or shoebox-style fixtures. 7) Decorative building lighting shall be used and fixtures shall be recessed wherever possible. 8) The picnic area shall be moved northward away from the dumpster. A crosswalk shall be constructed to lead customers from the nearest building entrance across the parking lot and an identifiable pathshall continue from the parking lot to the picnic area. 9) The sides and rear of the dumpster enclosure shall be brick construction to match the building. Final Orders Mr. Philip Thompson presented the Final Orders. 1.The petition of Wayne Fralinto obtain a Special Use Permit for the construction of a mini-warehouse facility on 14.76 acres, located at was approved by 5627 Williamson Road, Hollins Magisterial District the Board of Supervisors at the Public Hearing onNovember 14, 2006. 4 2.The petition of Chris McMurry to obtain a Special Use Permit to construct townhouses on 1.264 acres at a maximum density of 9.5 dwelling units per acre, located near the intersection of Route 648 was approved by the and Route 11, Hollins Magisterial District Board of Supervisors at the Public Hearing onNovember 14, 2006. Comments Mr. Jarrell made the motion to cancel the December 19, 2006 Planning Commission Worksession. AYES:Azar, McNeil, Hooker, Jarrell NAYS:None ABSENT:Thomason Motion passed 4-0. Mr. Azar expressed his appreciation to the commissioners and staff membersfor their service during his term as the 2006 Planning Commission Chairman. Mr. Thompson stated the 2007 Planning Commission officers willbe elected at the Planning Commission meeting on January 2, 2007.
