Approval of Agenda Mr.Thomasonmoved to approve theagenda. Motion passed 3-0. Approval of Minutes Mr.McNeilmoved to approve both the May 2, 2006PCPH minutesand May 16, 2006PCWS minutes. Motion passed 3-0. Approval of Consent Agenda Mr.McNeilmoved to approve the consent agenda. Motion passed 3-0. Comments Mr. Covey introduced Mr. Tarek Moneir, Deputy Director of Community Development. Ms. Scheid introduced Ms. Megan Cronise, Planner II. Mr. McNeil inquired about a memo from Mr. Paul Mahoney regarding proffers. Mr. Mahoneyexplainedhis opinion regarding the statutes which govern proffers. He stated the Dillon Rule determines the extent to which the county can address land use. Mr. McNeil suggested acquiring VDOT approval prior to presenting a proffer to the Planning Commission. Staff reviewed the site plan review process. Ms. Hooker noted the importance of appropriate land use. Site Viewing The meeting was adjourned for site viewing at4:31p.m. 1 PUBLIC HEARING: Mr.Azarcalled the meeting to order at 7:03p.m. Ms. Hookergave the invocation and led the pledge of allegiance. 1. The petition of Cherney Development Company, Inc. to rezone 4.75 acres from R-3C, Medium Density Multi-Family Residential District with conditions, to R3, Medium Density Multi-Family Residential District for the construction of a townhouse-condominium residential development, located on Route 419 near its intersection with Stoneybrook Drive and (Withdrawn by request of the Bridle Lane, Windsor Hill District. petitioner) 2.The petition of Bethel Assembly of God to obtain a Special Use Permit for the operation of a religious assembly, located at 6430 Kelley Street, (Continued until July 10, 2006 per request CatawbaMagisterial District. of the petitioner) 3.The petition ofBeacon Baptist Churchto rezone 4.8acres fromC-2C, General Commercial Districtwith conditions, to C2,General Commercial Districtand obtain a special use permit for the operation of a religious assembly,located at 7342 Plantation Road,Hollins Magisterial District. Ms. BeckyMahoney, Roanoke County Planning Department, presented the staff report. Mr. Tim Kirchoff, Pastor of Beacon Baptist Church, spoke regarding the petitionand provided a brief description of the request. Ms. Hooker asked if the bridge would be renovated. Mr. Kirchoff stated the bridge has not been an issue. Mr. Thomason noted the building will need some repair. Mr. McNeil inquired about site plan. Mr. Kirchoff discussed the buffering, parking area andthe one-lane bridge. Mr. Azar inquired about hours and membership of the church. Mr. Kirchoff confirmed hours of operation, noting occasionally the church would have programs during the week. He stated the Sunday worship services would average approximately 50 parishioners. Ms. Hooker statedtheproposed use would be less intense than previous use. Mr. McNeil expressed concern regarding issuing an SUP. Mr. Azar inquired about zoningreversion. Mr. Mahoney discussed zoning and previous conditions on property. He discussed the legality of reversion of thezoning classification.Mr. Azar expressed concern regarding ingress and egress from property. He noted the topography is challenging. Mr. Thomason notedthe property is currently in disrepair and the church is willing to improve the property. Ms. Hooker stated the paving, buffering, road issues wouldbe handled during site plan review.Mr. McNeil stated asite plan is needed before approving the SUP. Ms. Scheid explained the land development process. Mr. Thomason suggested giving temporary approval and revisit the issue in six months. Mr. Kirchoff stated the 2 church has limited funding. He stated he did not realize the extent of additional requirements. Mr. Azarthen made a favorable recommendation to approve the rezoning: AYES:Thomason, Hooker, Azar, McNeil NAYS:None ABSENT:Jarrell Mr. Azarthen made a favorable recommendation to approve the SUP with the following condition: 1.Freestanding signs shall be limited to monument type. AYES:Thomason, Hooker, Azar NAYS:McNeil ABSENT:Jarrell Citizens Comments Mr. Martin Irving, 2144 Laurel Woods Drive, expressed concern regarding removing trees for development and the effectonviewsheds. He expressed concern regarding septic systems. He suggested limiting building on slopes. He stated the access roads are unattractive. Ms. Annie Krochalis, 9428 Bent Mountain Road, expressed concern regarding slope development. She stated the process should be acollaborative process. She expressed concern regarding stream sediment pollution. She expressed concern regarding wildlife moving into neighborhoods due to development. She noted the economic value of viewsheds. She recommended reviewing ordinances from other localities. Planning Commission and Staff Comments Ms. Scheid discussed access to Groupwisefor the PC. Mr. Azardiscussed the importance offindingthe best way to implement the Slope Ordinance. Final Orders 1.The petition ofLawrence A. Goldstein to rezone .241acres fromR-1,Low Density Residential Districtto C-2 General Commercial District, and to rezone .44 acres from C-2C, General Commercial District with conditions to C2,General Commercial Districtfor the construction of a parking lot, was located at 3604 Brambleton Avenue,Cave Spring Magisterial District approved by the Board of Supervisors at the Public Hearing on May 23, 2006 . 3 There being no additional business, the meeting was adjourned at8:05p.m. Respectfully Submitted, Approved: Secretary, Roanoke County Planning Commission 4
