Approval of Agenda Mr.McNeil moved to approve the agendaas amended. Motion passed 3-0. Approval of Minutes Mr.Thomasonmoved to approve the April 4, 2006PCPH minutes.Mr. McNeil moved to approve the April 18, 2006PC Worksession minutes. Both motions passed 3-0. Comments th Mr. Jarrell stated he would be absent for the May 16PCWS. Site Viewing The meeting was adjourned for site viewing at4:16p.m. 1 PUBLIC HEARING: Mr.Azarcalled the meeting to order at 7:00p.m. Mr. McNeilgave the invocation and led the pledge of allegiance. 1.The petition of Cherney Development Company, Inc.to rezone 4.75acres fromR-3C,Medium Density Multi-Family Residential Districtwith conditions, to R3,Medium Density Multi-Family Residential District for the construction of a townhouse-condominium residential development, located onRoute 419 near its intersection with Stoneybrook Drive and (Continued until June 6, 2006 per Bridle Lane,Windsor HillsDistrict. request of the petitioner) Ms. Maryellen Goodlatte, spoke representing the petitioner. She reviewed reasons for requested continuance. She stated the petitioner plans to amend conditions in order to provide safe access to and from the property. Ms. Joy Taylor, 5206 Stoneybrook Drive, expressed concern regarding increased traffic. She stated VDOT should be invited to meetings. Mr. Thomason noted VDOT was invited. Mr. Holladay stated VDOT representatives were invited but declined to attend since the request has being continuedby the petitioner. Mr. Azar asked citizens attending the meeting to sign a list in order to receive information regarding future hearings. Mr. James Kelley, 5133 Hackney Lane, expressed concern regarding increased traffic. He stated he was concerned vehicles would back up onto Hackney Lane. Mr. William Atkinson, 2234 Bridle Lane, expressed concern regarding traffic. He stated traffic would back up at the light. He requested staff investigate access onto Rt. 419. 2.The petition of Bethel Assembly of God to obtain a Special Use Permit for the operation of a religious assembly, located at 6430 Kelley Street, CatawbaMagisterial District. Mr. David Holladay, Roanoke County Planning Department,stated the petitioner has requested a continuance. He stated they are researching an entrance which would go through Mr. Hicks’property farther down Meacham Drive. Mr. Frank Hawk, architect, spoke representing the petitioner. He stated the entrance they are consideringhas abetter grade for access. He stated the new entrance would provide better usage of the property. Mr. Ronald Wade, 6406 Kelley Street, stated Meacham Drive is a narrow road which requires one car to pullover if another vehicle coming from the 2 other direction needs to pass. He stated the church will create an increase in traffic on this road. He stated if the 15 acres of buffer is cleared,I-81 noise will be an issuefor the community. He expressed concern regarding the church well causing the other area wells to go dry. He stated the surrounding communityis a ‘tight knit’ neighborhood. He expressed concern for the safety of his children due to limited site distance on the road and increasedtraffic. Ms. Christina Mengerink, 6418 Kelley Street, concurred with Mr. Wade’s comments. She noted the area is a quiet peaceful place. She stated increased traffic and increased outside people put children at risk. Mr.Jarrellthen made a motion to continue the petition until July 10, 2006: AYES:Azar, McNeil, Jarrell, Thomason NAYS:None ABSENT:Hooker 3.The petition ofBeacon Baptist Churchto rezone 4.8acres fromC-2C, General Commercial Districtwith conditions, to C2,General Commercial Districtand obtain a special use permit for the operation of a religious assembly,located at 7342 Plantation Road,Hollins Magisterial District. (Continued until June 6, 2006per requestof the petitioner) 4.The petition ofLawrence A. Goldstein to rezone .241acres fromR-1,Low Density Residential Districtto C-2 General Commercial District, and to rezone .44 acres from C-2C, General Commercial District with conditions to C2,General Commercial Districtfor the construction of a parking lot, located at 3604 Brambleton Avenue,Cave Spring Magisterial District.Mr. Tim Beard, Roanoke County Planning Department, presented the staff report. He suggested adding a proffer which would prohibitoutdoor seating. Mr. McNeil recommended an additional proffer requiring a concrete divider be placed at the Custis Avenue exit to prevent right hand turnswhen exiting the petitioner’s property.Mr. Jarrell inquired about the use of the property.Mr. Beard stated restaurant use is a ‘by right’ use. Mr. Jarrell and Mr. McNeil inquired about the access points.Mr. Beard explained. Mr. McNeil stated the citizens have expressed concern regarding increased traffic entering the neighborhood from Custis Avenue. Mr. Azar and Mr. Jarrell inquired about the history of the property. Mr. Beard stated the property has been used as a restaurant for approximately 23 years. He also stated the adjacent properties previously allowed shared parking. Mr. Azar asked about the use of the rear portion of property. Mr. Beard stated the property formerly was a separate property but is now one parcel with split zoning. Mr. Sean Horne, Balzer & Associates, explained the site plan. He stated they plan to have right-in and left-out only onto Custis Avenue. He stated 3 they plan to install an island to prevent right hand turns onto Custis Avenue.He provided a brief history of the property. Mr. Lawrence Goldstein spoke regarding the petition. He explained since adjoining property owners currently need all of their parking, they are unable toshare spaces. He stated he has made every effort to try to accommodate the neighbors. He discussed forcing traffic back onto Brambleton Avenue. He stated he would like to have some outdoor dining available for the patrons. He expressed concern with limiting the signage. He stated his intent is to save the restaurant. He requested the signage allowance be at least 250 sq. ft. Mr. McNeil discussed the importance of the divider at the Custis Avenue access in order to direct traffic back onto Brambleton Avenue. Mr. Jarrell expressed concern regarding limiting signage. Mr. Beard stated, according to the ordinance,he could be allowed approximately 300-400 sq. ft. of signage with this property. He stated the current signage is approximately 48 sq. ft. Mr. Mahoney noted only one side of the sign is counted for the total footage. Mr. Azar reviewed the proffers including the traffic flow. Mr. Horne reviewed the traffic flow stating the entrance will be on Brambleton and the exit on Custis Avenue with provisions added to prevent right hand turnsonto Custis Avenue.Mr. Goldstein discussed bufferingandMr. Beard explained buffering options. Mr. Goldstein reiterated that he would prefer some outdoor seating be permitted. He also stated future owners of this building may required more signage that the current business. Mr. Ford noted all road recommendations will require review and approval by VDOT. Mr. Brian Pauley, 3537 Bunker Hill Drive, expressed concern regarding outdoor and upper level dining. He stated the parking area would not accommodate such an increase in patrons. He stated he is in favor of the petition as long as the medianis installedto prevent right hand turns onto Custis Avenue. He noted the property has been empty for an extended period of time. He expressed concern regarding stormwater issues. He asked the commissioners to look-out for the citizens. He asked about the ratio of patrons and parking spaces. Mr. Goldstein and Mr. Beard explained requirements. Ms. Diane Merritt, 3603 Bunker Hill Drive, stated her property is located directly behind the petitioner’s property. She provided a brief history of the property. She discussed buffering. She stated she would rather see a successful business in that location. Mr. Mahoney noted the condition the county imposes regarding roads and entrances would be contingent upon VDOT’s approval. Mr. McNeil 4 emphasized the importance of preventing right hand turns onto Custis Avenue. Mr. Ford stated the specifics would be determined by VDOT. Mr. David Pauley, 3325 Brandywine Avenue, emphasized the importance of the petitioner signing the proffers. He requested no outdoor seating be allowedto protect the neighborhood. Mr. Jarrell asked the petitioner if 250 sq. ft. of signage would be acceptable. Mr. Goldstein agreed with a 250 sq. ft. allowance. Mr. Azar stated he was against outdoor dining. Mr. Beard explained that the rear parking lot would be gravel or blacktop depending on the type of stormwater management utilized. Mr. Horne explained the preferred stormwater management provisions which would be located underground. Mr. McNeilthen made a favorable recommendation to approve the rezoning with the following conditions 1. The Brambleton Avenue access shall display an “enter only” sign in addition to pavement markings; the Custis Avenue access shall display “left turn only” signage exiting the parking area in addition to pavement markings and a raisedmedian prohibiting right turns exiting the site contingent upon VDOT reviewand approval. 2.Total site signage shall not exceed 250 square feet excluding directional signs and not more than one freestanding sign shall be permitted. 3.Any new exterior lighting to be installed shall be of a bollard / pathway designapproximately three feet in height per “Moldcast” or similar specification. 4.Front yard plantings along the building’s north and east sides shall be installedper ordinance Section 30-92-6(B)2. 5.No outdoor seating shall be permitted. Comments Mr. Mahoneyprovided a summary of legislation adopted by the General Assembly and signed by the Governor regarding Land Use. He provided the commissioners with a handout regarding these laws. Mr. Tim Beard thanked the commissioners for the remembrancesreceived regarding arecent death in his family. 5 Final Orders 1.The petition of Judy Taylor Wagner to rezone .369 acres from R-1, Low Density Residential District, to C-1, Office District for the operation of a beauty salon, located at 3722 Colonial Avenue, Cave Spring Magisterial was deniedby the Board of Supervisors at the Public Hearing District onApril 25, 2006. 2.The petition of Loblolly Mill, LLC to rezone 94.229 acres from AG-3, Agricultural Preserve District, to PRD, Planned Residential District with a maximum density of 0.33 houses per acre, located at 3672 Sterling Road and property in the 3800 block of Sterling Road, Vinton Magisterial District was approved by the Board of Supervisors at the Public Hearing on April 25, 2006 . 3.The petition of Kevin & Jennifer Cook to obtain a Special Use Permit for the operation of a used automobile sales business, located at 7400 Sunnybrook was deniedby the Board of Drive, Suite 6, Hollins Magisterial District Supervisors at the Public Hearing on April 25, 2006 . 4.The petition of Sonic Restaurants, Inc. to obtain a Special Use Permit on 1.101 acres for the operation of a fast food restaurant with drive-in, located was at 4504 & 4510 Challenger Avenue, Hollins Magisterial District approved by the Board of Supervisors at the Public Hearing on April 25, 2006 . 5.The petition of Che Torry to rezone .92 acres from C-1, Office District to C- 2, General Commercial District in order to construct a personal improvement service (personal trainer), located in the 4600 block of Brambleton Avenue, was approved by the Board of Windsor Hills Magisterial District Supervisors at the Public Hearing on April 25, 2006 .
