Approval of Agenda Mr. Jarrellmoved to approve the agenda. Motion passed 5-0. Approval of Consent Agenda Ms. Hookermoved to approve the consent agenda. Motion passed 5-0. Approval of Minutes Mr. Thomasonmoved to approve the June 6, 2006PCPH and June 20, 2006 PCWS minutes. Motion passed 5-0. Site Viewing The meeting was adjourned for site viewing at4:04p.m. 1 PUBLIC HEARING: Mr. Azarcalled the meeting to order at 7:03p.m. Mr. Jarrellgave the invocation and led the pledge of allegiance. Slope Ordinance Proposed Amendments to Chapter 8.1 of the Roanoke County Code, Erosion and Sediment Control Resolution Mr. David Holladay presented the resolution to the commission. He noted a BOS/PC Joint Worksession will be held on July 25, 2006 to discuss the proposed amendments. Mr. Azar commended staff for doing an excellent job. Mr. Azar then made the motion to forward the Resolution to the Board of Supervisors. AYES:Thomason, Hooker, Azar, McNeil, Jarrell NAYS:None ABSENT:None Street Waiver Request A petition from Qwiz Construction & Investments, LLC to request a waiver from Section 200.09 of the Roanoke County Public Street and Parking Standards in order to construct a private road (not constructed to VDOT Subdivision Street Requirements) to access more than (2) two residential lots, located at 5815 Bent Mountain Road, Windsor Hills Magisterial District.Mr. David Holladay, Roanoke County Planning Department, presented the staff report.He noted conditions cannot be placed on a waiver request. Mr. Thomason inquired about the width of the road. He expressed concern regarding the steepness of the slope. He also expressed concern regarding the development of a private road for multiple homes. Mr. Jacob Quesinberry, Manager of Qwiz Construction & Investments, LLC, spoke regarding the petition. He stated the driveway is currently 8- 10 feet. He stated they plan to widen the driveway to 20 feet. He stated widening the existing driveway would minimize land disturbanceand would also improve site distance. He stated granting the waiverwould provide a centralized entrance instead of havingindividual entrances for each dwelling. He stated public water is available in this areaand he discussed hydrant availability. Mr. Jarrellinquired about the slope of the property. Mr. Quesinberry discussed the building sites on the property. Ms. Hooker inquired about private roads. Ms. Scheid reviewed the history of private roads in Roanoke County and thereasons thecounty allows no more than two (2) homes on a private road. Mr. Thomason reiterated his concern regarding 2 the steepness of the property. Mr. Quesinberry stated steep slope development has been successful with the correct design. Mr. Azar stated they appreciate the petitioner offering conditions but reiterated they are not enforceable by the county. He offered to allow the petitioner to reconsider and develop a PRD design for the property prior to the commission voting on the waiver.Mr. Quesinberry stated he would like for the commission to act on the waiver. Mr. Thomason then madethe motion to deny the waiver. AYES:Thomason, Hooker, Azar, McNeil, Jarrell NAYS:None ABSENT:None Public Hearing Petitions: 1.The petition of Bethel Assembly of God to obtain a Special Use Permit for the operation of a religious assembly, located at6200 block Meacham Road (revised driveway location), Catawba Magisterial District.Mr. David Holladay, Roanoke County Planning Department, presented the staff report. He provided a brief history of the petition. He discussed the revised concept plan. Ms. Hooker inquired about the parking lot. Mr. Holladay stated the parking lot and entrance way would be paved.Ms. Hooker asked about buffering. Mr. Holladay briefly discussed. Mr. Jarrell asked about the right of way. Mr. Holladay explained right of way pavement in relation to the proposed driveway. Mr. Jarrell noted the right of way is close to one of the adjacent properties. Mr. Holladay discussed buffering in that area. Mr. Azar inquired about setback requirements. Mr. Holladay briefly discussed requirements. Mr. Paul Hicks, Pastor Burt Franks, and several members of the churchwere present in support of thepetition. They agreed with the suggested conditions. Mr. Daniel Leffel, 6230 Meacham Road, inquired about buffering. Mr. Holladay discussed the Zoning Ordinance requirements and options. Mr. Azar requested Mr. Leffel be informed about buffering as it relatesto his property. Ms. Hooker noted it is a good use for the property. Mr. McNeil commended the petitioner on the revised plan. Mr. Jarrell inquired about the driveway location.Mr.Holladay discussed its location in reference to the property line.Mr. Azar stated this development complies with the Comprehensive Plan. 3 Ms.Hookerthen made the motion to recommend approval of the request with the following conditions: 1.All improvements shall be setback a minimum of 50 feet from the Interstate Route 81 right of way. 2.Tax parcels #063.04-03-49 and #063.04-03-51 shall be used for the entrance driveway only. 3.Large or small evergreen or large or small deciduous trees shall be planted within the entrance driveway easement between the entrance driveway and property at 6224 Meacham Rd, per the planting specifications in Section 30-92- 5 (D) 3. of the zoning ordinance. The intent of this condition is to fill in the open spaces between existing wooded areas. 4.The development shall be in general conformance with the concept plan entitled Proposed Church Facility for Red Lane Assembly of God, dated 5/30/06. AYES:Thomason, Hooker, Azar, McNeil, Jarrell NAYS:None ABSENT:None 2.The petition of Amina Al-Hindi a/k/a Amina Al-Habashy to obtain a Special Use Permit for the construction of an accessory apartment on .387 acres, located at 2923 Embassy Drive, Catawba Magisterial District.Ms. Tammi Wood, Roanoke County Planning (Continued at the request Department, presented the staff report. of the petitioner) 3.The petition of Kahn Development Company, Inc. to rezone 17.24 acres from I1-C Industrial District with Conditions to C2 General Commercial District in order to construct a retail sales facility located at the 3900 block Challenger Avenue near the intersection of Valley Gateway Boulevard, Vinton Magisterial District. Ms. Janet Scheid, Roanoke County Planning Department, presented the staff report. Ms. Hooker inquired about the property access pointonto an arterial highway. Ms. Scheid discussed the concept plan. She stated accesswould be addressed during the site plan review process. Mr. McNeil asked about traffic signalinstallation. Mr. Anthony Ford, Transportation Engineering Manager, discussed increased traffic and the VDOT process to acquire atraffic signal. Mr. Jarrell noted there will be additional employees traveling to and from this site. Mr. Ford discussed the increase in traffic. Mr. Azar asked about access. Mr. Ford discussed potential access points. 4 Mr. Ford said he had just received the traffic study today and has had a very short time to review it. He discussed the traffic plan. Ms. Maryellen Goodlatte, Esquire, spoke representing the petition. She provided a brief history of the property. She reviewed the concept plan and surrounding parcels. She discussed access points. She noted this request is for down-zoning. She discussed the Community Meeting, noting the citizens expressed concern regarding increased traffic and stormwater runoff. She introduced Mr. Bobby Temple ofKahn Development,Mr. Ron Fink and Mr. Michael Gay of Gay & Neel, Inc.,and Mr. Mike AgeeofMattern & Craig.Mr. McNeil asked about VDOT requirements regarding turning lanes. Ms. Goodlatte stated VDOT is still reviewing the concept plan. She noted VDOT would have final jurisdiction over all decisionsof this type.Mr. McNeil stated although he is concernedabout downzoning from I-1 to C-2, the request is a good use for the property. Mr. Jarrell expressed concern regarding the timeline ofinstallinga light. Mr. Azar stated he was in favor of rezoning the property to C2 without conditions. Mr.Azar then made the motion to recommend approval of the request. AYES:Thomason, Hooker, Azar, McNeil, Jarrell NAYS:None ABSENT:None 4.The petition of Valley Gateway, LLC, to rezone .69 acres and .48 acres from R1 Low Density Residential to C2 General Commercial District in order to construct a retail sales facility located at 4065 Challenger Avenue and 4053 Challenger Avenue, Vinton Magisterial District. Doss to obtain a Special Use Permit with amended conditions for the operation of a used automobile dealership on .467 acres, located at 6717 Williamson Road, Hollins Magisterial District.Ms. Becky Mahoney, Roanoke County (Withdrawn per Planning Department, presented the staff report. request of the petitioner) Final Orders There were none. 5 Comments Ms. Scheid stated the PC/BOS will have a joint worksession on July 25, 2006to discuss the Slope Ordinance. She stated this meeting will be in lieu of the PCWS on July 18, 2006.
