Approval of Minutes Mr. Marrano made a motion to approve the minutes of March:, 4, 2014, and March 15, 2014, which passed 4-0, Consent Agenda Ms. Zirkle provided an overview of the petition regarding Airport Road Holdings 11, LLC, including a brief history of the property, current zoning, and future land use designation. Ms. Zirkle Mr. Thompson, and the Commissioners discussed proposed changes to the master plan and proffered conditions. Ms. Zirkle stated portions of the development, which are part of the previously approved master plan, are currently under construction. She stated a community meeting will be held on April 17, 2014, at 6:30 p.m. at Burlington Elementary School. Mr. James made a motion to approve the consent agenda, which passed 4-0 Page 1 of 7 ROANOKE COUNTY PLANNING COMMISSION MINUTES APRIL 1, 2014 Citizen Comments There were none. Commissioners' and Staff Comments Ms. Kuhnel, Mr. Thompson, and the Commissioners reviewed and discussed documents received from citizens regarding the petition of Corporate Properties Services, Inc. Ms. Hooker adjourned the meeting for site viewing at 4:23 p.m. EVENING SESSION Ms. Hooker called the Public Hearing to order at 7:00 p.m. She gave the invocation and led the pledge of allegiance. The petition of State Central Bank to amend the proffered conditions and Planning and Design documents for Loblolly Mill by amending the sections dealing with trails and lighting. The Loblolly Mill Planned Residential Development is located an Sterling Road and is approximately 104.4 acres in size, Vinton Magisterial District. Ms. Pattisall presented the staff report including a history of the property, previous zoning, and proposed changes to lighting and trails. Ms. Pattisall and the Commissioners discussed current construction within the development and County regulations and guidelines regarding lighting and trails within the development. Ms. Hooker opened the public hearing for public comment. With no citizens requesting to speak, Ms. Hooker closed the public hearing. Mr. James made a motion to recommend approval of the request with the following amended proffered condition: 1. The property will be developed in substantial conformance with the "Planning and Design Documents for: Loblolly Mill a Planned Residential Community" prepared by Balzer and Associates, Inc. dated January 18, 2006, revised April 17, 2006, amended January 10, 2007, revised February 9, 2007, and last revised November 25, 2013. Mr. Thompson called the roll and the motion passed (4 -0) with the following vote: AYES: Hooker, James, Jarrell, Marrano, NAYES: None ABSENT: Woltz 2. The petition of Corporate Properties Services, Inc. to obtain a special use permit for a restaurant, drive -in or fast food in a C -1, Low Intensity Commercial, District, on approximately 1.3825 acres located at 3814 Challenger Avenue, Hollins Magisterial District. Ms. Pattisall discussed procedural confusion regarding altered documents received by citizens and staff which have not been endorsed by the County. Ms. Pattisall presented the staff report, including surrounding zoning, Page 2of7 ROANOKE COUNTY PLANNING COMMISSION MINUTES APRIL 1, 2014 future land use designation, suggested conditions, and traffic impact analysis findings. Mr. Gary Rouse, GBC Design, Inc., discussed the concept plan including a 5,000 square foot building, 52 parking spaces, and property access. He stated access will be from West Ruritan Road with no direct access from Challenger Avenue. Mr. Mike Agee, Mattern and Craig, Inc., stated the petitioner is committed to study allowing right turns only when entering or exiting property. He reviewed the traffic impact analysis format and results, including sight distance issues, speed limits, traffic counts, and peak hours. He discussed level of service ratings and trip generation. He discussed improvements which could alleviate traffic issues, including a right turn lane off of West Ruritan Road, lowering the speed limit, and improving sight distance. He suggested using signage to prohibit blocking of the intersection. He also suggested coordinating signalization in the area. He stated he does not see any justification for a left turn lane off of West Ruritan Road. Mr. Agee and the Commissioners discussed peak hours, speed reduction, and sight distance calculations. Mr. Jarrell discussed safety concerns regarding school buses travelling in the area with increased traffic. Mr. Marrano inquired about by- right uses for the property. Ms. Pattisall discussed this issue, noting by -right uses for this parcel include daycares, medical offices, and banks. Ms. Hooker opened the public hearing for public comment. Mr. Chris Craft, 1501 East Gate Road, stated he is in favor of the petition because it will be a good neighbor and generate jobs and revenue for the area. Mr. Max Byer, 2402 Coachman Drive, stated he was concerned about traffic and sight distance issues, noting it is a congested area. He stated West Ruritan provides access to the surrounding neighborhood. He stated the petitioner's plan is deficient in addressing traffic issues. Mr. Ron Roop, 1431 West Ruritan Road, stated he is concerned about traffic issues, noting a right turn lane is an improvement that should have been considered prior to the installation of current signalization poles. He stated adding a short turning lane would not correct traffic issues. He stated he is concerned about the sight distance waiver request, noting safe and efficient traffic flow is important. Ms. Margurette Angell, 2068 Wesvan Drive, provided a history of development in the area. She stated accidents are a common occurrence in the area. She stated there is only room for five vehicles and no lane to turn left. She discussed sight distance issues. Mr. John Pollard, 1440 West Ruritan Road, stated traffic stacks past his house from the intersection. He stated at 1:30 p.m. traffic is back to his driveway. He discussed concerns regarding vehicles exceeding the speed limit in this area. Mr. Rouse, Mr. Agee, and the Commissioners discussed sight and stopping distance calculations. They discussed other traffic flow options including access from Trail Drive. Mr. Agee stated entering from Trail Drive was not considered as part of the TIA. Mr. Brian Blevins, P.E., VDOT, and the Commissioners discussed requirements and waiver request. Mr. Blevins stated VDOT received the revised TIA on March 24, 2014, and have not finalized their review of the study. Mr. Jarrell inquired about the request for two VDOT waivers. Mr. Agee discussed the two waiver requests. Mr. Jarrell made a motion to postpone action on the petition until the May 6, 2014 Planning Commission meeting in order to review VDOT's comments regarding the revised traffic study. Mr. Thompson called the roll and the motion passed (4 -0) with the following vote: AYES: Hooker, James, Jarrell, Marrano, NAYES: None ABSENT: Woltz 3. The petition of McDonald's USA, LLC to obtain a special use permit for a restaurant, drive -in or fast food in the CVOD, Clearbrook Village Overlay District, on approximately 1.0 acre located at 5347 Franklin Road, Cave Spring Magisterial District. Ms. Wood presented the staff report, including the concept plan and CVOD guidelines. Mr. Scott Thompson, Regional Construction Manager, reviewed the traffic impact analysis (TIA), including entrance and exit from the property and traffic stacking issues. He discussed citizen concerns regarding menu products, noting nutritional information is posted on the company's website. He discussed proposed stormwater management of the site. He reviewed architectural plans, noting the building will be consistent with the CVOD guidelines. He stated additional jobs and tax revenue will benefit the community. Mr. S. Thompson and the Commissioners discussed the number of employees needed for operation, property access, and traffic flow. Mr. Brian Blevins, P. E., VDOT, stated that the July, 2012 Traffic Impact Analysis remains valid and can be used for the proposed development, noting the traffic counts used included Walmart outparcel improvements and development. He discussed current synchronization of traffic signals. Ms. Wood and the Commissioners discussed zoning regulations, future land use designation, and suggested conditions. Ms. Wood stated the petitioner agrees with the suggested conditions. Page 4of7 ROANOKE COUNTY PLANNING COMMISSION MINUTES APRIL 1, 2094 Ms. Hooker opened the public hearing for public comment. Ms. Beth Burbridge, 8588 Starlight Lane, stated she is concerned about the safety of children in the area. She stated that the petitioner is known for poor food quality and emissions. She discussed concerns regarding safety, traffic, and employee exploitation. With no other citizens requesting to speak, Ms. Hooker closed the public hearing. Mr. Marrano inquired about by -right uses for this property. Ms. Wood discussed allowable uses for this zoning designation. Mr. Marrano made a motion to recommend approval of the special use permit with the following conditions: Development of this site shall be in substantial conformance with plan sheets C -3 and L-1 titled McDonald's by Stimmel Associates, PA, and dated 1124114 subject to any revisions required during site plan review. 2. The fagade of the primary structure shall be in substantial conformance with the undated elevation sheet titled "Proposed McDonald's Restaurant — Color Elevation Study" subject to any revisions required during site plan review and building plan review. 3. The building materials for the proposed monument sign shall match the building materials used on the primary structure and shall be in substantial conformance with the monument elevation sheet. The dimensions of the monument sign shall be equal to or less than the dimensions depicted on the elevation sheet prepared by Persona Sign Makerslimage Builders dated 04124/13. 4. The building materials for the dumpster enclosure shall match the building materials used on the primary structure. Mr. Thompson called the roil and the motion passed (4 -0) with the following vote: AYES: Hooker, James, Jarrell, Marrano, NAYES: None ABSENT: Woltz 4. The petition of Richard and Nancy Koplow to obtain a special use permit to operate a bed and breakfast in a R -1, Low Density Residential, District, on approximately 2.35 acres located at 804 Dexter Road, Hollins Magisterial District. Ms. James presented the staff report, including the concept plan and property access. Ms. James and the Commissioners discussed Use and Design Standards regarding this use. Page 5of7 ROANOKE COUNTY PLANNING COMMISSION MINUTES APRIL 1, 2014 Mr. Jeff Wood, Rife and Wood Architects, discussed the concept plan including widening of the property entrance and development of a parking area which will include one handicapped accessible space. He stated four guest rooms will be available and only breakfast will be provided to the guests. He discussed traffic impacts, noting this use does not require a traffic impact analysis. Mr. Wood and the Commissioners discussed employees needed, building code requirements, property access, and proposed signage. Ms. Hooker opened the public hearing for public comment. Ms. Lynn Thompson, 859 Dexter Road, expressed concern regarding the proposed parking lot being located adjacent to her yard. She discussed concerns regarding increased traffic, excessive parking, decreased property values, safety, and garbage collection. Ms. Donna Knox, 864 Dexter Road, discussed parking issues and traffic, noting a bed and breakfast would be a nice addition to the area. She stated other potential buyers would also have multiple family members and additional vehicles. With no other citizens requesting to speak, Ms. Hooker closed the public hearing. Ms. James, Mr. Thompson, and the Commissioners discussed garbage collection, allowable accessory uses, on- street parking, and public water and sewer availability. Mr. Jarrell stated on- street parking should be discouraged. Mr. Wood and the Commissioners discussed widening of the driveway, topography, landscaping, and buffering of the property. Mr. Koplow stated the existing driveway gate is 14'/2 feet wide. Mr. Jarrell made a motion to recommend approval of the special use permit with the following condition: The site shall be developed in general conformance with the concept plan dated February 21, 2014. Mr. Thompson called the roll and the motion passed (4 -0) with the following vote: AYES: Hooker, James, Jarrell, Marrano, NAYES: None ABSENT: Woltz Final Orders There were none.
