Session opened at 4:00 p.m. by Ms. Hooker.
Approval of Agenda
Mr. Thomason moved to approve the agenda. Motion passed 3 -0.
Approval of Minutes
Mr. Thomason moved to approve the July 1, 2003 minutes. Motion passed 3 -0.
Mr. Thomason moved to approve the July 15, 2003 minutes. Motion passed 3 -0.
Approval of Consent Agenda
Mr. Azar to approve the consent agenda. Motion passed 3 -0.

The meeting was adjourned for site viewing at 4:05 p.m.
PUBLIC HEARING:
Ms. Martha Hooker called the meeting to order at 7:02 pm. Mr. Al Thomason
gave the invocation and led the pledge of allegiance.
1. There was a petition of Ground Up Inc. to rezone 1.31 acres from AG -1,
Agricultural Low Density District to AV, Village Center District and to
obtain a Special Use Permit on 7.37 to operate a construction yard located
on 5788 Kathryn Drive, Cave Spring Magisterial District. Ms. Tammi
Wood, Roanoke County Planning, presented the petition.
Ms. Hooker asked if the property was located within the Clearbrook
Overlay. Ms. Wood stated it was in the Clearbrook Community but not
within the Clearbrook Overlay District.
Mr. Azar asked the petitioner if he repairs vehicles on the property. Mr.
Tim Phelps, owner of the Ground Up Inc., stated he performs
maintenance and repair of business equipment on premises. He stated
he does not have a mechanic on staff. Mr. Azar asked if repairs are
performed during normal business hours. Mr. Phelps stated maintenance
is usually performed during normal business hours on rainy days. Mr.
Azar noted two vehicles are currently stored on the property. Mr. Phelps
stated both vehicles are owned by his employees who have temporarily
stored them on the property. Mr. Azar asked about stormwater runoff
management. Mr. Phelps stated he diverts the water away from the drain
on his neighbors property. He stated he keeps the driveway in good
condition. Ms. Hooker asked if he had expectations of further growth. Mr.
Phelps stated his growth has been gradual. He also noted he has
operated from the same site for nine years. He stated he has a small
amount of road frontage on Route 220 which may be utilized in the future
if his business grows larger. Mr. Thomason inquired about the two
vehicles on the property. Mr. Phelps stated the vehicles will be moved as
soon as the owners are able to afford repairs. Mr. Thomason asked if
signage would be installed on the property. Mr. Phelps stated since he
does not want to increase traffic on the property, he does not plan to
install a sign.
Ms. Hooker then made the motion for favorable approval of the rezoning:

Ms. Hooker then made the motion for favorable approval of the specia
use permit with the following conditions:
1. The special use permit shall be for a landscape contractor business
only.
2. The existing vegetation along the perimeter of the property is to be
retained for screening.
3. Should a freestanding sign be proposed, it shall be of a monument
type. The sign shall have a maximum area of thirty (30) square
feet.

2. There was a petition of M. L. Leonard Inc. to obtain a Special Use Permit
to operate a car wash located in the 1600 Block of Washington Avenue,
Vinton Magisterial District. Mr. John Murphy, Roanoke County Planning,
presented the petition.
Mr. Azar requested the status of the billboard currently on the property.
Mr. Murphy stated it was his understanding according to the petitioner that
an agreement to remove the billboard was to be written into the
purchasing contract.
Mr. Phillip Nichols and Mr. Mike Leonard represented M. L. Leonard Inc.
Mr. Thomason inquired about installation of the sewer line. Mr. Leonard
stated the Town of Vinton would install the sewer line to the property. Mr.
Thomason expressed concerned about possible damage to the Wolf
Creek Trail. Mr. Leonard confirmed the Wolf Creek Trail would be
returned to presconstruction condition. Mr. Azar asked the petitioner to
describe hours of operation. Mr. Nichols stated most likely it would be
operational 24 hours per day. Mr. Azar asked how many hours it would be
manned. Mr. Nichols stated he plans to have a personal video monitoring
system installed on the property. Mr. Azar requested the status of the
billboard. Mr. Nichols stated it would be removed from the property. Ms.
Hooker asked staff about the proposed hours of operation. Mr. Holladay
stated most automated car wash facilities operate 24 hours per day. Ms.
Hooker expressed concern regarding vandalism and loitering. Mr.
Holladay noted the police would be responsible for controlling these
issues.
Mr. Azar then made the motion for favorable approval of the special use
permit with the following conditions:
1. The development of this site shall include C -2 to R -1 screening and
buffer requirement between the developed site and the Greenway
Trail. Any significant trees within this buffer yard, identified by
Planning Staff during plan review, shall be preserved. If necessary,
the owner shall provide for any Greenway Trail easements for the
preservation of the existing Greenway.
2. The site shall be developed in a manner to absorb or to deflect any
site- generated noise away from the adjoining public park and
Greenway.
3. The on- premise signage for the site shall be limited to .5 square
feet per foot of Washington Avenue road frontage. Any
freestanding sign on the site shall be a monument type sign.
4. The exterior wall building materials of the car wash facility shall be
limited to brick, split -faced block, drivit, wood, vinyl or combination
of these materials.
5. No access to the site shall be allowed from Goode Park Drive,
State Route 961 (Leisure Lane).
6. Should any utility or construction activity related to the development
of the car wash site cross or effect the Wolf Creek Greenway, the
trail shall be returned to the pre- construction condition.

3. There was a petition of Richard J. Sidor to obtain a Special Use Permit to
construct an accessory apartment on .52 acres, zoned R -1 Low Density
Residential District located on 5916 Blackhorse Lane, Cave Spring
Magisterial District. Mr. David Holladay, Roanoke County Planning,
presented the petition.
Ms. Hooker stated the layout and appearance is well done. Mr.
Thomason stated it is a good plan.
Ms. Hooker then made the motion for favorable approval of the special
use permit:

Update on Status of Community Plan Revisions
Mr. David Holladay stated the Citizens' Planning Academy has been completed.
He stated the many good comments and suggestions were received from the
attendees. He stated many of the CPA attendees will be participating in the
September 16 Community Meeting. Mr. Holladay explained the meeting will be

held in lieu of the September PC Worksession. He stated some of the issues to
be presented will be stormwater management, economic development, growth
management, utilities, and transportation. He reported some mapping has been
completed including amendments to the Land Use Maps. He stated new slope
maps have been created which will be used in conjunction with other maps. He
stated staff has received documentation from many other departments which will
be incorporated into the revision process. Ms. Hooker commended staff on the
presentation and success of the CPA.

Final Orders
1. The petition of James C., III and Laura B. Parrish to Permit to obtain a
Special Use Permit to construct an accessory apartment on .5 acres,
zoned R -1 Low Density Residential District located at 3210 Lawndale
Road, Windsor Hills Magisterial District was approved by the Board of
Supervisors at the Public Hearing on July 22, 2003.
2. The petition of Elijah S. Carroll to obtain a Special Use Permit to operate
a Primary Educational Facility on 4.76 acres, zoned R -2 Medium Density
Residential District located at 3432 Poff Lane, Cave Spring Magisterial
District was approved by the Board of Supervisors at the Public
Hearing on July 22, 2003.
3. The petition Randy Grisso to obtain a Special Use Permit to operate a
Private Kennel on 2.21 acres, located at 1459 Mountain Heights Drive,
Catawba Magisterial District was denied by the Board of Supervisors at
the Public Hearing on July 22, 2003.
4. The petition of Christopher H. Hanes to obtain a Special Use Permit to
construct a drive -in restaurant on approximately .75 acres, zoned C -2
General Commercial District located near the intersection of Brambleton
Avenue and View Avenue, Cave Spring Magisterial District was
withdrawn.
There being no additional business, the meeting was adjourned at 7:39 p.m.
