Session opened at 4:36 p.m. by Mr. Don Witt.
Approval of Agenda
Mr. Azar moved to approve the agenda as amended. Motion passed 4 -0.
Approval of Minutes
Mr. Ross moved to approve the September 16, 2003 minutes. Motion passed 2-
0. Ms. Hooker and Mr. Azar abstained.
Mr. Ross moved to approve the October 7, 2003 minutes as amended. Motion
passed 4 -0.
Approval of Consent Agenda
Mr. Azar moved to approve the consent agenda. Motion passed 4 -0.

PUBLIC HEARING.
Mr. Don Witt called the meeting to order at 7:00 p.m. Ms. Martha Hooker gave
the invocation and led the pledge of allegiance.
H. Bent Mountain Road Waiver from Section 200.09 of the Roanoke County
Public Street and Parking Design Standards and Specifications. Mr. John
Murphy presented the staff report.
Mr. Azar inquired if a standard exists for private road development which
could be applied to this development. Mr. Murphy stated Cluster Development
standards exist regarding maximum grading and drainage. He noted the
Planning Commission could recommend using particular standards and
recommendations. Mr. Witt asked if grading permits had been issued for this
property. Mr. Murphy stated permits have been issued for septic drainfields
and removal of brush only. Mr. Witt expressed concern regarding E & S
Control of this property.
Mr. Steve Strauss, 3649 Peakwood Drive, stated when he purchased the
property, it was divided into three parcels. He stated VDOT allows two lots to
use one driveway which was his original plan. He stated VDOT has
requested he construct a single entrance instead of four, three or two
entrances for these four parcels. He stated county staff previously indicated
this would be appropriate. Mr. Azar asked the petitioner about the standards
he would use to construct the private road. He stated he will use VDOT road
and street entrance standards. He stated there is not sufficient traffic from
the four lots to require a decel lane. He stated he is unsure of the exact
grade of the slope. He stated there will be a Homeowners Association with a
mutual agreement to maintain the private road. He stated the road will be
built according to Category 1 standards without curb and gutter. He noted
without the waiver he could construct four separate driveways. Mr. Ross
inquired about Roanoke County services including the 'One Armed Bandit'
refuse collection. Mr. Strauss stated the residents of these homes would
have the same collection arrangement as others in the Route 221 corridor.
Mr. Ross stated a location should be established for mail delivery and trash
pickup. Mr. Strauss stated due to the topography of the area, he is unsure if
there is sufficient room to create a specific area without building a retaining
wall. Mr. Ross inquired about Lot E having a totally separate entrance. Mr.
Strauss stated Parcel E is under contract and will not be included in the
maintenance agreement. Ms. Hooker asked where children waiting for school
buses will stand. Mr. Strauss stated the children will come down the hill to
wait as on other steep streets. He stated VDOT's request is to have a single
entrance to make the area safer. He explained the options if the waiver is
denied. Mr. Witt noted it is an extremely steep slope at the edge of the road.
He asked if the VDOT standard requires the entrance to be level. Mr. Strauss
stated the entrance will need to be graded at the intersection to meet
standards. Mr. Azar asked if service vehicles would access the private road.
Mr. Strauss stated some services are provided on private roads. Mr. Azar
expressed concern regarding fire and rescue access to the proposed homes.
Mr. Strauss stated access would be worsened if there were four separate
driveways. He stated he would surface or pave the road. Mr. Azar asked if

emergency vehicles could access these properties. Mr. Strauss stated they
would be able to make the turns into the properties. Mr. Witt asked if it would
be a cul -de -sac or a T -turn. Mr. Strauss stated all four homes would have
attached garages with four individual turns. He stated he would have a turn
around for vehicles which turn into the private road in error. Mr. Witt asked if
the petitioner had received grading permits. Mr. Strauss stated Roanoke
County required an E & S Control permit. He stated he had a
miscommunication with the county and his staff regarding proceeding with
grading. He stated he has put a hold on the grading until further notice from
the county. Mr. Witt stated he does not approve of grading without E & S
Control. Mr. Strauss stated the previous owners cut down trees and pulled
stumps out. He stated his company did not do all the damage to the property.
Mr. Witt suggested entering the properties from Poage Valley Road. Mr.
Strauss explained the site plan to Mr. Witt. Mr. Ross asked if all five lots
could access the private road at a common point in order to keep traffic
funneled into one location. Mr. Strauss stated Lot E is already under contract
and cannot be changed. Mr. Ross suggested granting Lot E an easement for
access to a better and safer entrance. Mr. Strauss stated although he cannot
make Lot E use the entrance, he would be happy to consider the suggestion.
Mr. Azar stated more research is needed regarding both the Lot E easement
for the safety of the residents and VDOT's road specifications in relation to
Roanoke County specifications to determine the possibility of any negative
impact. Mr. Azar stated he could not support the waiver as presented. Mr.
Ross suggested implementing design standards and conditions for this road.
He stated the petitioner could grant Lot E an access easement. Ms. Hooker
concurred with Mr. Ross, noting it would be safer for the homeowners. Mr.
Witt stated the design may not work with regards to the topography. He
stated fire trucks may have difficulty climbing a steep sloped driveway.
Mr. Azar then made the motion to deny the waiver:

Mr. Ross suggested if the petitioner proffers certain conditions, another
motion may be considered. Mr. Strauss stated he will grant a 12 foot
easement from Lot E to the new driveway, the road will be limited to five lots,
the pavement will follow Category 1 VDOT standards, T- turn - arounds at top
of drive and 8 foot gravel drive turn- arounds. He stated the concrete trucks
are able to access this road. He noted it is not an ideal road but three
separate entrances are not in the best interest of the county.
Mr. Ross made a substitute motion to recommend approval of the waiver
with the following conditions:
1. The applicant shall provide access limited to five Lots A, B, C, D, and E.
2. Pavement design standards shall be to VDOT Category 1 standards for
road design construction.
3. The applicant shall grant a 12 foot easement from Lot E to the new road.
4. T- turn - arounds shall be constructed at the approximate location of the
letters 'SCC' on the Concept Map provided to the Planning Commission
on November 4, 2003. A commercial entrance permit shall be granted to
comply with VDOT standards.
5. The site shall be developed in substantial conformity to the Concept Plan
provided to the Planning Commission on the November 4, 2003.

1. The petition of Jeffrey Glick to Rezone .81 acres from R -1 Low Density
Residential District to C -1 Office District in order to operate a general office,
located in 2415 Electric Road, Windsor Hills Magisterial District. Mr. Chris
Lowe presented the staff report for this petition.
Mr. Witt inquired about decel lane. Mr. Lowe stated that issue would be
clarified during site review.
Mr. Jeff Glick, 6529 Fairway View Trail, spoke regarding the petition. Mr.
Azar asked about the intended use of the property. Mr. Glick stated he and
two other employees would be working at the proposed insurance office. Mr.
Ross asked if the petitioner was in agreement with the suggested proffers.
Mr. Glick indicated he was in agreement. Mr. Witt asked about the size of the
building. Mr. Glick stated the building is approximately 1200 square feet. Mr.
Glick stated he is under contract with the representative of the owner's estate.
There were no citizen comments.
Mr. Ross then made the motion to recommend approval of the rezoning with
the following conditions:
1. Development of the site shall be in substantial conformity to the Concept
Plan provided to the Planning Commission on November 4 2003.
2. Use shall be limited to general office.

2. The petition of Buck Mountain Land, LLC to Rezone 1.88 acres from 1 -1
Industrial District to AR Agricultural /Residential District in order to construct
single family dwellings, located on Eagle Crest Drive, Cave Spring Magisterial
District. Mr. John Murphy presented the staff report for this petition.
No one was present to represent the petitioner.

Mr. Witt then made the motion to recommend approval of the rezoning:

Status of the Comprehensive Plan Update
Ms. Scheid stated staff is currently working on the final portion of the update. In
regards to Smart Growth she stated that staff is cataloging issues and strategies
regarding schools, transportation and other infrastructure issues and natural
resource issues.
Comments
Ms. Scheid reported on her meeting with the Back Creek Smart Growth
Committee. She stated a second meeting is scheduled for Wednesday,
November 5 at 7:00 p.m. She stated the county is encouraging citizen input
regarding growth. She stated this focus group may expand to include other
areas of the county.
Ms. Scheid stated the county has received a letter from Mr. Ed Natt requesting a
2232 Review for Public Water System in the Bent Mountain Road Area. She and
Mr. Paul Mahoney, Roanoke County Attorney, are compiling a list of items
needed to process the review. Mr. Witt asked about public water system
compared to private wells. Ms. Scheid stated the number of houses allowed in
an area nearly doubles if public water is available. Mr. Ross asked if proffers are
allowed to restrict the number of homes. Ms. Scheid stated it will depend on the
information submitted regarding the proposed development. Mr. Ross inquired
about impact fees. Ms. Scheid stated Hanover County charges cash proffers of
$8,000 per building permit on rezonings. She stated that in general impact fees
are not allowed in the State of Virginia. She stated she will provide more
information for the Planning Commission to discuss regarding the 2232 Review
and Smart Growth at the next PC Worksession. Mr. Witt noted input will be
needed from Gary Robertson, Utility Department for the 2232 Review.
Final Orders
1. The petition of MJH Development to obtain a Special Use Permit to construct
mini warehouse facility and offices located 112 mile from Plantation Road on
Angel Lane, Catawba Magisterial District was approved by the Board of
Supervisors at the Public Hearing on October 28, 2003.

2. The Town of Vinton to rezone 99.38 acres from PTD to PTD with revised
proffered conditions, located in the 2100 block of Hardy Road, Vinton
Magisterial District was approved by the Board of Supervisors at the
Public Hearing on October 28, 2003.
3. The petition of the Roanoke County Planning Commission to amend the
Roanoke County Zoning Ordinance, Section 30 -29 -5 Commercial Use Types
to include a new definition for "Outpatient Mental Health and Substance
Abuse Center", and Section 30- 54 -2(B) C -2 General Commercial to add
"Outpatient Mental Health and Substance Abuse Center" as a use allowed
only by Special Use Permit was approved by the Board of Supervisors at
the Public Hearing on October 28, 2003.
