Approval of Agenda Mr. Robinson moved to approve the agenda. Motion passed 3-0. Approval of Minutes Ms. Hooker moved to approve minutes. Motion passed 3-0. Approval of Consent Agenda Mr. Robinson moved to approve the consent agenda. Motion passed 3-0. Site Viewing The meeting was adjourned for site viewing at 4:18pm. I PUBLIC HEARING: Mr. Todd Ross called the meeting to order at 7:OOpm. Mr. Kyle Robinson gave the invocation and led the pledge of allegiance. 1. There was a Petition of Mr, Robert Finck to obtain a Special Use Permit for 2.24 acres for an accessory apartment located at 2929 Elderwood Road, Catawba Magisterial District. Ms. Janet Scheid, Roanoke County Planning, presented the Staff Report for this petition. Ms Hooker asked how many accessory apartments were currently in Roanoke County. Ms. Scheid stated that there were many. There was some discussion. Mr. Ross asked if there was a limit on non -family members. Ms. Scheid stated that the zoning ordinance does not restrict the use to family members and tracking who was living in the unit would be difficult to do and enforcement would be problematic. Mr. Finck spoke and described his situation and his request for in-house care for his daughter. Ms. Hooker then made the motion to approve the Special Use Permit. AYES: Hooker, Witt, Robinson, Ross NAYS: None ABSENT: Thomason Subdivision Waiver Request Subdivision waiver request by Mr. Terry Parks to waiver Section 17-3 of the Roanoke County Subdivision Ordinance to create an additional lot with no public road frontage for a 7.058 acre parcel located at 4125 Barley Drive, Catawba Magisterial District. Mr. John Murphy, Roanoke County Planning, presented the Staff Report for this waiver request. Mr. Parks spoke and stated that he was requesting the waiver for family purposes and that he plans to give the new house to his son, Mr. Witt asked about the access to the rear parcel and verified that the driveway would be used to access the rear parcel. Mr. Robinson asked whether the attorney at the closing explained the restrictions of the property to the petitioner. The petitioner stated that he did not recall. Several citizens spoke. Mr. Kenneth Perdue, Jr., 4879 Poor Mountain Road, owner of a lot in the subdivision explained the history of the subdivision. Ms. Allison Morrison, 4100 Barley Drive, owner across from the petitioner, stated that she moved there because the houses were spaced out and wants to keep her privacy. She opposed the waiver. Ms. Angie Holshouser, 4135 Barley Drive, discussed road maintenance and additional traffic issues. She added that trash must be taken down to the public road for pick up. She opposed the waiver. PA Ms. Nancy Ward, 4115 Barley Drive, bought her property specifically because it was private and the property could not be subdivided. Ms. Ki'lm Slate, 4105 Barley Drive, a 3 year resident, spoke in opposition to the waiver due to concerns regarding privacy and traffic. Also mentioned was the narrowness of the road and road maintenance issues. Mr. Wayne Clark, 4091 Barley Drive, stated that if the request were to "give it to the children," he would not have a problem with the subdivision request. Ms. Hooker then made the motion to deny the subdivision waiver based on the previous conditions placed on the subdivision plat. Mr. Witt added that approving this request would open the door to further subdivision requests. AYES: Hooker, Witt, Robinson, Ross NAYS: None ABSENT: Thomason Citizens Comments There were no citizen comments. Comments There was a discussion of the work program for the 2002 year including the information on the attached memo. 'There was also a detailed discussion of the six-year road plan process and a request that more planning input be incorporated into the process. Mr. Witt stated that better communication between Roanoke County and VDOT was needed. Final Orders Ms. Scheid presented the Final Orders for December 2001.
