WORK SESSION:
Mr. Todd Ross called the meeting to order at 4:05pm.
Approval of Agenda
Mr. Witt moved to approve the revised agenda. Motion passed 5 -0.
Approval of Minutes
Ms. Hooker moved to approve the January 2, 2002 minutes. Motion passed 5 -0.
Approval of Consent Agenda
Mr. Robinson moved to approve the revised consent agenda. Motion passed 5-
0.
Subdivision Waiver Re guest
Subdivision waiver request by Mr. Harold Wingate to waive Section 200.07, Curb
and Gutter, of the Roanoke County Street Design Standards and Specifications
for a 119.54 acre parcel located on Va. State Route 311 — Catawba Valley Drive,
Catawba Magisterial District. Ms. Janet Scheid presented the report for this
request. Mr. Witt asked why Mr. Wingate was requesting the waiver. Mr.
Wingate stated he was requesting the waiver primarily because of the added cost
but also due to the rural nature of the area.
Ms. Hooker then made the motion to approve the subdivision waiver.
Motion passed 5 -0.
Sign Ordinance Discussion
Mr. Murphy discussed the ordinance and got an overview of the Commission's
views on County sign regulations.

The meeting was adjourned for site viewing at 4:30pm.
PUBLIC HEARING:
Mr. Todd Ross called the meeting to order at 7:00pm. Ms. Hooker gave the
invocation and led the pledge of allegiance.
1. The petition of the Roanoke County Planning Commission to re-
write the Roanoke County Subdivision Ordinance. Mr. John Murphy,
Roanoke County Planning, presented the Staff Report for this petition.
Mr. Murphy gave a brief history from Spring 2001 until the present. He
described the process the County took in involve the surveyors and
engineering professionals and Roanoke Regional Homebuilders
Association. Mr. Witt had one question regarding storm water
management and the phrase "topographically unsuitable." Mr. Murphy
explained that not all the flood plain areas are mapped. Mr. Witt stated
that the ordinance was well written and an excellent job was done and he
hoped that the surveyors, engineers and developers appreciated all the
work.
There were no citizen comments.
Mr. Witt then made the motion to recommend approval of the Subdivision
Ordinance.

2. Petition of Betty J. F. Henderson to obtain a Special Use Permit to
operate a Home Occupation for a Beauty Salon on .27 acres, located at
5704 Malvern Road, NW, Hollins Magisterial District. Mr. Chris Lowe,
Roanoke County Planning, presented the Staff Report for this petition.
Mr. Witt reviewed the suggested conditions and noted that parking issues
were not addressed in the conditions. Mr. Thomason asked if any
neighbors had contacted staff about the petition. Mr. Lowe stated he had
three calls from neighbors, none of them from adjoiners. Mr. Robinson
questioned the nature of the concerns and it was stated parking, trash,
and a business located in the residential neighborhood. He also clarified
the meaning of condition #4 regarding complaints.
Ms. Betty J. F. Henderson, 5704 Malvern Road gave a brief history of her
knee injuries and the house location. She stated that parking for her
customers would be in her driveway and not on the street. She also
stated that the days of operation would be Wednesday through Saturday
during normal business hours. Mr. Ross asked if she had reviewed the
suggested conditions for the SUP. He reviewed them with her.
Mr. Warren Campbell, 5711 Malvern Road stated that he was unfamiliar
with what was going on until the permit sign was posted. He stated that
he did receive the adjoiner notice, but that the petitioner should have
touched base with the neighbors. His concerns included parking (which
should be strictly limited), a busy intersection where stop signs and speed
limits are not obeyed, but primarily he is concerned about the infiltration of

a commercial business in the neighborhood. Ms. Henderson re-
addressed these concerns. Mr. Robinson stated that he would support the
request due to the hardship on the petitioner and the conditions imposed.
Mr. Ross then made the motion to recommend approval of the Special
Use Permit because it complies with the Zoning Ordinance. He stated
that he would not include parking in the conditions at this time because the
customers would park in the driveway.

3. Petition of Jerry and Donna Green to obtain a Special Use Permit
for a Private Kennel on 1.50 acres located at 5606 Barns Avenue, Hollins
Magisterial District. Mr. Chris Lowe, Roanoke County Planning, presented
the Staff Report for this petition. Mr. Thomason questioned the nature of
the construction taking place at the head of the driveway. Mr. Lowe was
unaware of the construction. Mr. Thomason also expressed concern
regarding the three dogs appearing to be running free this afternoon
during the site visit. The invisible fencing was discussed.
Mr. Jerry Green, 5606 Barns Avenue, addressed the issue of the dogs
running free. He stated that the construction was due to the age of the
house (170 years old) and the side porch "caving in" while trying to screen
it in. Ms. Hooker and Mr. Witt questioned the collaring and shelter of the
dogs as well as the amount of barking. Mr. Ross then asked the status of
the horses on the property and if they had obtained an SUP for them. Ms.
Green stated that they had horses due to a grandfather clause. Staff
reported that no SUP had been found, but that further research was
needed. Mr. Ross stated that he had concerns regarding invisible fencing,
unrestricted dogs, and the horses. Ms. Hooker confirmed that the Invisible
fencing was extended up to the road. Mr. Green stated that he would
change the area where the dogs are allowed if necessary. Mr. Ross
stated that he would not want barking dogs in R -1 zoned area. Ms. Hooker
stated that her concerns were that not all the dogs are trained on the
fencing and the horses on the property. Mr. Thomason stated that he
would like to see the petition approved but would suggest barking collars
on the one dog that barks. Mr. Ross had concerns regarding the
construction with no building permits, dogs running loose, no collars on
the dogs, training for the dogs, and the horse situation.
There were no citizen comments.
Mr. Ross then made the motion to continue the SUP to the March 5, 2002
PCPH to have time for staff and the petitioner to address and resolve the
issues and concerns brought up by the commission.

Comments
Colonial Avenue Issue Update
Ms. Scheid gave an overview of the VIDOT plans. Originally a 5-lane road was
pIanned, but after a series of meetings with the Colonial Avenue Alliance, staff,
Mr. Minnix and Mr. Hodge the plan now is to improve the two lane road and add
a turning lane at certain sections. There will be another meeting tomorrow night.
Issues include looking at traffic calming techniques, no turn on red at Kroger, and
a three way stop at Penn Forest. Staff is looking into a better way to have more
input in the 6-year plan in the future. Mr. Thomason confirmed that the Colonial
Avenue plan was on the secondary road list. Mr. Witt asked if there was the
possibility of a no build plan as an option. He stated that would solve the traffic
calming problem.
Ms. Scheid stated that the citizens have done a lot of work. She also stated that
if the project was pulled off the plan, VDOT wants the locality to pay for
expenditures up to that point.
Final Orders
1. The petition of Mr. Robert Finck to obtain a Special Use Permit for an
accessory apartment on 2,24 acres located at 2929 Elderwood Road, Catawba
Magisterial District, was approved by the Board of Supervisors with one condition
at the Public Hearing on January 22, 2002.
There being no additional business, the meeting was adjourned at 7:52pm.
