Approval of Agenda Ms. Hooker moved to approve the agenda. Motion passed 5 -0. Approval of Minutes Mr. Witt moved to approve the minutes. Motion passed 5 -0. Approval of Consent Agenda Mr. Thomason moved to approve the consent agenda. Motion passed 5 -0. Site Viewing The meeting was adjourned for site viewing at 3:37pm. PUBLIC HEARING: Mr. Todd Ross called the meeting to order at 7:00pm. Mr. Al Thomason gave the invocation and led the pledge of allegiance. The petition of Winter Properties Partnership, LLP to rezone 3.33 acres from C -2, General Commercial District with conditions to C -2 General Commercial District with amended conditions and to obtain a Special Use Permit on a 4.20 acre parcel to expand mini - warehouses, located at 2205 Washington Avenue, Vinton Magisterial District. Mr. David Holladay, Roanoke County Planning, presented the Staff Report for this petition. Mr. Robinson asked why the property needed to be rezoned. Mr. Holladay stated that several conditions such as no expansion allowed and the M -1 zoning specifications, which were imposed on the 1986 rezoning, were no longer applicable. He also stated that the five original conditions would be replaced by 3 conditions. Mr. Robinson confirmed that the buffering condition would remain and asked if the petitioner was aware of the amended proffered conditions. Mr. Holladay stated yes. Mr. Holladay then stated that the amended proffers would pertain to the rezoning segment of the petition and that none were necessary for the SUP. Mr. Scott Winter, 6971 Pine Needle Drive, the petitioner, stated the he did not plan to change the zoning of the portion of property that fronts on Washington Avenue. He said that there would be no additional storage buildings constructed on the front property, but that there was a possibility of a strip center or restaurant in the future. Mr. Winter stated that his purchase of the property was contingent on the outcome of the rezoning and SUP request. He also confirmed that he understood all the proffers for the rezoning. There were no citizen comments. Mr. Kyle Robinson then made the motion to recommend approval for the rezoning with the following conditions: 1. Eastern .9 acres of the original mini - warehouse development shall remain as a natural buffer zone. Type C screening and buffer yard shall be installed between expansion area and adjoining residential property. 2. Expansion of the mini - warehouses shall be in substantial conformance with the concept plan dated February 22, 2002. 3. The color and architectural design of the new structure shall match the existing structures. AYES: Hooker, Witt, Robinson, Thomason, Ross NAYS: None ABSENT: None 2 Mr. Kyle Robinson then made the motion to recommend approval for the Special Use Permit. AYES: Hooker, Witt, Robinson, Thomason, Ross NAYS: None ABSENT: None 2. The petition of Haven of Hope Community Church to obtain a special use permit for a religious assembly on 1 acre, located at 4108 Electric Road, Cave Spring Magisterial District was withdrawn by the petitioner. 3. The petition of Barrens Development Corporation to rezone 7,883 square feet from C -2 General Commercial District to R -3C Medium Density Multi - Family Residential District with conditions, for the construction of townhouses located at the south side of U. S. 11 at North Brook Drive, Hollins Magisterial District. Mr. Chris Lowe, Roanoke County Planning, presented the Staff Report for this petition. He stated that the conditions would stay the same for the current rezoning request as they were stated on the original rezoning. Mr. David Helscher, attorney for Barrens Development stated that the petitioner needed additional construction area to meet County setback requirements. There were no citizen comments. Mr. Ross then made the motion to recommend approval of the request for the rezoning with the conditions as they exist on the adjacent property. AYES: Hooker, Witt, Robinson, Thomason, Ross NAYS: None ABSENT: None Citizens Comments There were no citizen comments. Comments Final Orders 1. Petition of Hollins Hospitality, LLC to rezone two parcels of .797 acres and 1.290 acres from R -1 to C -2 General Commercial District and R-2 Residential District to C -2 General Commercial District for a Motel /Motor Lodge located on 8008 Plantation Road and 7929 Carvin Street respectively, Hollins Magisterial District was continued to be heard by the BOS on May 28, 2002. 3 2. Petition of Ralph T. Henry to obtain a Special Use Permit to operate a private stable on two parcels with the total acreage of 34.07acres located between 6341 and 6545 Corntassel Lane, Windsor Hills Magisterial District was continued to be heard by the BOS on May 14, 2002. , 3. Petition of Fellowship Community Church to obtain a Special Use Permit to operate a religious assembly on 15.652 acres located on Red Lane Extension at interstate 81, Catawba Magisterial District was approved by the BOS on May 114, 2002. 4. Petition of Fellowship Baptist Church to rezone 15 acres from III-IC Industrial District with conditions, to C-1 Commercial District and to obtain a special use permit for a Religious Assembly and Daycare located on 5022 Hollins Road, Hollins Magisterial District was continued to be heard by the BOS on May 14, 2002.
