Approval of Agenda Mr. Robinson moved to approve the agenda. Motion passed 5 -0. Approval of Minutes Mr. Witt moved to approve the May minutes as amended. Motion passed 5 -0. Mr. Ross moved to approve the May 21 Planning Work Session minutes with amendments. Motion passed 5 -0. Approval of Consent Agenda Mr. Ross moved to approve the consent agenda. Motion passed 5 -0, Site Viewing The meeting was adjourned for site viewing at 4:11 pm. PUBLIC HEARING: Mr. Todd Ross called the meeting to order at 7:00pm. Mr. Todd Ross gave the invocation and led the pledge of allegiance. There was a petition of William and Tonja Goodrich to rezone 11.44 acres from 1 -2, Industrial District to R -1, Low Density Residential District to construct a single family home, located on Poor Mountain Road, Catawba Magisterial District. Mr. Chris Lowe, Roanoke County Planning, presented the Staff Report for this petition. Ms. Hooker asked Mr. Lowe a question regarding the principal industrial goal in the Roanoke County Community plan. Mr. Thomason asked if there was any interest in the remaining property. It was confirmed that there was no proposed use noted. Mr. Witt discussed the possibility of a subdivision at the property. Mrs. Goodrich, 3205 Delmar Lane, petitioner approached the lectern. Ms. Hooker questioned preserving the trees on the property. Ms. Hooker then made the motion to recommend approval of the rezoning request with the following proffers: One dwelling shall be allowed on the property and when the property line is adjusted, then the property line shall follow the metes and bounds of the zoning line. AYES: Mr. Thomason, Ms. Hooker, Mr. Witt, Mr. Robinson, Mr. Ross NAYS: None ABSENT: None 2. There was a petition of Christopher A. Desimone, et al, to rezone .49 acres from C -1 Office District with conditions to C -1 Office District with amended conditions to construct a general office building, located on the west end of Colonial Avenue, Cave Spring Magisterial District, Mr. John Murphy, Roanoke County Planning, presented the Staff Report for this petition. Mr. Witt questioned what the Colonial Avenue plans states regarding parking. Mr. Murphy stated that the goal is side and rear parking vs. in front. Mr. Chris Desimone described his history in the purchase of the property and that he intends the building to have a residential appearance. Mr. Witt stated that the main issue was the parking and asked Mr. Desimone if he would be willing to proffer the elevations, Mr. Desimone stated yes. Ms. Cindy Webster, 4714 Colonial Avenue stated that she did not object "on this site" to allow "parking in front" but that she did not want to set a precedent with this case. She also stated that she was in agreement with the plan and that the Colonial Avenue Alliance would recommend approval of the petition. Mr. Steve Strauss spoke supporting the rezoning and stated that he would be willing to answer questions related to the site and the plan. 2 Mr. Witt stated that he appreciated the community working with the applicant and that the building at that location would screen the back of the Kroger to the residential neighborhood. He also stated that it does not create a precedent in his mind because it is a tough site in which to make the project work. Side and rear parking would be encouraged. Mr. Robinson stated that he supports the front parking request due to the tight construction on the lot. He stated he recommends approval of the request based on previous conditions, size, and quality of construction as guidelines which were originally agreed upon. Mr. Robinson stated that he agreed that a precedent was not set with this recommendation. Mr. Witt made the motion to forward the recommendation for the approval of the Rezoning to the BOS with the following proffers: 1) The property will be developed is substantial conformity to the attached concept plan dated April 23, 2002, indicating the relative layout and location of the building, the square footage of the footprint of the building, the location and number of parking spaces and Type C screening and buffering where the property adjoins R -1 zoning, with a combination of option 1, 15 -foot buffer yard and Option 2 landscaping, shall be evergreen trees and one row of evergreen trees, to be planted and maintained in the buffer yard, and to replace the 6 -foot screening fence, but achieve an equivalent screening effect. 2) The property will be developed to have a residential appearance in that the roof of the building will be shingled and have a pitch equal to or greater than 5 -12, the exterior construction will be brick, residential type siding or a combination of the two, the outside lighting will be for security rather than commercial purposes, such as residential type dusk -to- dawn lighting, and there will be no more than one sign on the premises which will not be larger than 20- square feet, will not be backlit and will be either a monument type sign or a sand blasted wooden sign. 3) The permitted uses for the property under Section 30 -53 -2 of the 1992 Roanoke County Zoning Ordinance will be limited to the following: Civic Uses administrative services, educational facilities, college /university, education facilities, primary /secondary; Office Uses general office, medical office; Commercial Uses communication services, studio, fine arts. 4) The site plan for the petition be developed in substantial compliance with the Desimone Front Elevation drawing dated June 4, 2002. 3 AYES: Mr. Ross, Mr. Robinson, Mr. Witt, Ms. Hooker, Mr. Thomason NAYS: None ABSENT: None 3. There was a petition of O. M. Enterprises, LLC to rezone a portion of two parcels consisting of approximately 4 acres from C2C, General Commercial District with conditions to C2C, General Commercial District with amended conditions to construct a hotel, located on North Electric Road, Catawba Magisterial District. The petition was continued by the petitioner until the July 2, 2002 Planning Commission Public Hearing. Citizens Comments There were no citizen comments. Planning Commission and Staff Comments Final Orders Petition of Winter Properties Partnership, LLP to rezone 3.33 acres from C -2, General Commercial District with conditions to C -2 General Commercial District with amended conditions and to obtain a Special Use Permit on a 4.20 acre parcel to expand mini - warehouses, located at 2205 Washington Avenue, Vinton Magisterial District was approved by the Board of Supervisors at the Public Hearing on May 28, 2002, 2. Petition of Barrens Development Corporation to rezone 7,883 square feet from C -2 General Commercial District to R -3C Medium Density Multi - Family Residential District with conditions, for the construction of townhouses located at the south side of U. S. 11 at North Brook Drive, Hollins Magisterial District was approved by the Board of Supervisors at the Public Hearing on May 28, 2002.
