Approval of Agenda Ms. Hooker moved to approve the agenda. Motion passed 3 -0. Approval of Minutes Ms. Hooker moved to approve the June minutes. Motion passed 3 -0. Approval of Consent Agenda Mr. Witt moved to approve the consent agenda. Motion passed 3 -0. Site Viewing The meeting was adjourned for site viewing at 4:10 pm. PUBLIC HEARING: Mr. Witt called the meeting to order at 7:OOpm. Ms. Martha Hooker gave the invocation and led the pledge of allegiance. 1. There was a petition of O. M. Enterprises, LLC to rezone a portion of two parcels consisting of approximately 4 acres from C -2C, General Commercial District with conditions to C -2C, General Commercial District with amended conditions to construct a hotel, located on North Electric Road, Catawba Magisterial District. Postponed by the petitioner until the August 6, 2002 Planning Commission Public Hearing. 2. There was a petition of Calvary Chapel Roanoke to obtain a Special Use Permit to operate a religious facility on 3.48 acres, zoned C -2 General Commercial District, located at 2067A Electric Road, Windsor Hills Magisterial District. Mr. Chris Lowe, Roanoke County Planning, presented the Staff Report for this petition. Pastor Brian Phillips spoke on behalf of the church. Mr. Thomason clarified that the proposed use would only occupy a small portion of the 3.48 acre parcel. He also inquired as to how Oak Grove Plaza was selected for the use. Pastor Phillips responded that the church saw the "for lease" sign at the plaza and contacted the owner. Mr. Witt inquired from staff as to the basis of the some of the Economic Development Department comments. Mr. Lowe was not sure of the basis of their comments. Mr. Witt inquired if the Special Use Permit could only be granted for the two year time period that the church planned on leasing the site. Mr. Lowe responded that the permit may be limited to two years. Mr. Thomason made the motion on the Special Use Permit, to forward the petition with a negative recommendation. AYES: Witt, Hooker, Thomason NAYS: None ABSENT: Robinson, Ross 3. There was the petition of McNeil Asphalt to amend conditions on a Special Use Permit to operate a construction yard on 2.62 acres, zoned AV, Agricultural Village District located at 7210 Franklin Road, Cave Spring Magisterial District. Postponed by the petitioner until the August 6, 2002 Planning Commission Public Hearing. K 4. There was a petition of St. Francis of Assisi Service Dog Foundation to obtain a Special use Permit to operate a commercial kennel on 18.16 acres, zoned AR, Agricultural Residential District located at 8232 Enon Drive, N.W., Hollins Magisterial District. Mr. Tim Beard, Roanoke County Planning, presented the Staff Report for this petition. . Mr. Michael Pace, esquire spoke on behalf of the petitioner. He identified some of the staff and board members of the organization that were present. Mr. Pace outlined the operation of the organization with specific emphasis on the ability to train up to 25 dogs with the proposed facility vs. the ability to only train 5 dogs at the current location. Mr. Pace explained that noise and odor from the facility would not be an issue. The animal waste would be removed by a contractor. The applicant is proposing the use of Leyland Cypress trees to fill in along the borders of the site. Ms. Hooker asked about the transition from horses to dogs and the use of the existing house on the property. Mr. Pace described the transition and explained that the house would be an on -site resident associated with the organization. The office for the facility would be in the stable building. Ms. Hooker also asked about the closest houses on Buckland Mill Road and about the region that this facility would serve. Mr. Pace advised that the closest house was over 100' from the facility and that the facility was generally a local facility but dogs have been placed outside of the area on several occasions. Mr. Witt asked staff if the use and design standards were mandatory or just guidelines. Staff responded that the standards were mandatory. The commission, staff and Mr. Pace discussed kennel silencers for the facility. Several adjoining neighbors, Howard Boggess and Martha Rakes, had concerns about the amount of screening and buffering as well as the noise and odor from the facility. Mr. Boggess requested better noise control than Leyland Cypress trees. Ms. Hooker asked Mrs. Rakes if there had been a problem with any odor from the horse stable. Mrs. Rakes said that there had been no odor. Mr. Witt then made the motion to approve the Special Use Permit with the staff suggested condition. AYES: Hooker, Thomason, Witt NAYS: None ABSENT: Robinson, Ross 5. There was a petition of William E. Lee to obtain a Special use Permit to operate a surplus sales business on 1.47 acre parcel, zoned 1 -2, Industrial District located at 3716 Garman Road, Catawba Magisterial District. Mr. John Murphy, Roanoke County Planning, presented the Staff Report for this petition. Mr. William Lee described the history of the site. Ms. Hooker asked staff about all of the storage of items on the property. Mr. Murphy responded that the items could be stored on the property but they must behind the building line and screened. Ms. Hooker asked the applicant if he had a concern with complying with the recommended conditions. Mr. Lee responded by saying that he wanted to comply with the rules. Mr. Lee had concerns about other sites in the general area with outdoor storage of items. Mr. Lee showed photographs to the commissioners of the sites with the alleged violations. Ms. Mariah Roberts from CSI Distribution, described concerns about the potential of customers from the proposed use entering their property and excessive traffic generated from the use. She described that the distribution business had a 24 -hour operation and she was concerned with passenger vehicles interfering with truck traffic. Ms. Hooker then made the motion to approve the Special Use Permit with staff recommended conditions, and the understanding that the Special Use Permit could be revoked if the conditions were not met: AYES: Witt, Hooker, Thomason NAYS: None ABSENT: Robinson, Ross Citizens Comments There were no citizen comments. L, Final Orders 1. The petition of Petition of William and Tonja Goodrich to rezone 11.44 acres from 1 -2, Industrial District to R -1, Low Density Residential District to construct a single family home, located on Poor Mountain Road, Catawba Magisterial District was approved by the Board of Supervisors at the Public Hearing on June 25, 2002. 2. The petition of Petition of Christopher A. Desimone, et al, to rezone .49 acres from C -1 Office District with conditions to C -1 Office District with amended conditions to construct a general office building, located on the west end of Colonial Avenue, Cave Spring Magisterial District was approved by the Board of Supervisors at the Public Hearing on June 25, 2002.
