WORK SESSION:
Session opened at 3:38pm with Mr. Al Thomason's summary of the County's
Economic Development Forum.
Approval of Agenda
Mr. Al Thomason moved to approve the agenda Motion passed 4 -0.
Approval of Minutes
Mr. Don Witt requested a change regarding his conversation with VDOT. Martha
Hooker moved to approve the January minutes with changes. Motion passed 4-
0.
Al212roval of Consent Agenda
Kyle Robinson moved to approve the consent agenda. Motion passed 4 -0.
Site Viewing
The meeting was adjourned for site viewing at 3:50pm.
PUBLIC HEARING:
Mr. Al Thomason called the meeting to order at 7:00pm. Al Thomason gave the
invocation and led the pledge of allegiance.
1. Petition of the Trustees of the Korean Baptist Church to rezone 2.1 E
acres from C -1 Office District with conditions to C -1 Office District with
Conditions and to obtain a Special Use Permit for Religious Assembly,
located at 5422 Starkey Road, Cave Spring Magisterial District.
Mr. David Tickner, Roanoke County Planning, presented the Staff Report
for this petition. Mr. Witt expressed a concern regarding parking. Ms.
Hooker mentioned the signage proffer -- and that the current sign is
attractive, though it is not the monument style. Mr. Robinson asked if
rezoning would affect both lots. There will be one access to both lots and
parking will be to the rear of the front of the structure. The site plan has
been proffered.
Ed Natt, representative for the Korean Baptist Church Trustees, concurred
with the staff report and referred to the revised site plan (dated 21212001),
stating that the rear portion is not usable.
Mr. Witt questioned the intention of leveling the entrance way — Owner has
discussed this with VDOT. It was suggested that the signage is attractive
and should be approved as -is. Mr. Natt stated the size was approximately
100 square feet.
Mr. Ross suggested that a religious facility is not a good use for the
property — if the church expands or moves to the other side the residential
area would be cramped.
Mr. Al Thomason confirmed that all parking is behind the front line --- for 20
vehicles.
Mr. Ross expressed concerns regarding churches taking up commercial
land. Creek Buffer, and surrounding buildings do make the religious
facility an appropriate use, but that we should not encourage religious
facilities in commercial areas.
There were no citizen comments.
Mr. Witt then made the motion to approve the rezoning with proffers
reflecting the following:
• Develop the property in accordance with the 212101 revised site
plan.
• Continue to have only one entrance on Starkey Road
• Used as a religious assembly only
• Signage -- any sign should be no greater than 6 feet high, and no
greater than 20 square feet with only front lighting.
• Parking should be behind building
• Parking area lighting should be a maximum of 20 feet in height
• Policy — limited to C1 for religious assembly

2. Petition of Jones & Jones Associates to rezone 1.31 acres from R1
Residential to R4 Residential located at 6621 Peters Creek Road, Hollins
Magisterial District.
Mr. David Tickner, Roanoke County Planning, presented the Staff Report
for this petition. Todd Ross questioned the current access of the property.
Mr. Tickner stated that there is no access or street frontage and confirmed
the ownership of the surrounding properties.
Mr. Jyke Jones, representing Mr. And Mrs. Hite, the property owners
stated that the easement had been deeded over as part of the Plaza Auto
development. The pipe stem has a dedicated ingress /egress to the Auto
Plaza, the large white house and the 9 acre property — all owned by the
Hites.
Due to the land density /topography only approximately 5 acres of the land
is developable. Mr. Witt mentioned that VDOT was not allowing a
crossover and the impact that would have on the number of cars leaving
the area. Another exit is available, but the topography is bad and very
narrow — no crossover is at this exit. Mr. Jones stated that due to the
other businesses on either side of the pipe stem, there is only a 30 foot
wide area that would need an acceleration /deceleration lane to be
installed. There were no citizen comments.
Mr. Ross then made the motion to approve the rezoning. Mr. Ross stated
that lack of frontage is not good for commercial zoning for C -1 or C -2.
Mr.Witt had a concern regarding the number of additional vehicles on
Peter's Creek Road as well as the concern of the number of units.

3. Petition of Mi Suk Perry to rezone 3 acres from AR Agricultural
Residential to C -2CVOD (Clearbrook Village Overlay District) for Retail
Sales located at 5679 Franklin Road, Cave Spring Magisterial District.
Mr. Terry Harrington, Roanoke County Planning, presented the Staff
Report for this petition. There was a question regarding the Home
Occupancy regulations - the expense, restrictions, and percentage of
home used for the business.
Mr. Thomason questioned why there were no site plans available for
viewing. Mr. Harrington stated that Ms. Perry was purchasing the property
with the zoning, and due to the minimal amount of exterior changes
needed, it was not considered. Mr. Thomason suggested rescheduling
until the applicant can purchase the property and design the site plan with
parking, egress /regress.
Ms. Perry is willing to install a turn lane later if the business traffic dictates.
Mr. Robinson asked if Ms. Perry had done any research into the cost of
compliance with the CVOD compliance.
Mr. Mike Wray, 5550 Yellow Mountain Road, President of the Clearbrook
Civic League asked how much product would be sold. Mr. Harrington
explained Home Occupancy vs. rezoning and if there was another use
other than candy making then Ms. Perry would have to return to the
Planning Commission for approval. Mr. Wray was also concerned about
drainage from the property. Water flow will not increase — the parking lot
will remain gravel. Mr. Wray welcomed Ms. Perry to the neighborhood
and as a member of the Civic League.
Mr. Thomason confirmed size of house and percentage that would be
needed for the business. Ms. Perry also stated that she had an engineer
inspect the culverts and was told that they were solid and in good
standing.
Mr. Clarence W. Simmons, 5505 Franklin Road, another citizen stated that
he had videos of the flood problem in that area and will continue to be a
problem. He proposed a larger diameter pipe be installed. Mr. Witt stated
that he was not sure that it was this petitioner's obligation to correct the
pre - existing problem and that this was a low intensity use business.
Mr. Witt then made the motion to approve the rezoning with proffers
reflecting the following:
• Business use will be limited to retail candy sales and catering.
• All commercial business would be within the existing home on the
property — all renovations comply with CVOD standards.
• A site plan be developed prior to commercial use of the property

4. Petition of Tracy A. Bryant to rezone 1.94 acres from AR,
Agricultural Residential to AV Agricultural Village and obtain a Special Use
Permit for a Garden Center located at 7796 Bent Mountain Road, Windsor
Hills Magisterial District.
Mr. John Murphy, Roanoke County Planning, presented the Staff Report
for this petition. The applicant was agreeable to all of the proffers. Ms.
Hooker confirmed that the area would store mulch, topsoil — graded out or
elevated. The pad is fiat, not elevated and the applicant is cleaning up the
area. The use of petroleum -based products are prohibited meaning there
will be no fueling. It was suggested that the wording be changed to "no
petroleum products." It was confirmed that the pad is out of the flood way.
A county engineer has visited the site.
Mr. Bryant has installed permanent markers to mark the floodway which
will include no storage area. There will only be enough mulch stored to
keep the business going on a daily basis. Mr. Bryant stated that he will
construct bins if necessary. There is enough room on the property for
customers to pull in, load up and turn around. He also confirmed that the
customer base is expected to be from the local subdivisions and that he
had experienced the flooding in the area. Mr. Bryant stated that he would
only carry decorative stone or brick chips if they were in demand in the
future.
Mr. Marty Harbin, 7793 Bent Mountain Road, a citizen stated that Mr.
Bryant has really shown pride in ownership and beautified the property
while he has lived there. Mr. Harbin also mentioned that the business is
reasonable, straightforward and that he supports his venture.
Mr. Thomason then made the motion to approve the rezoning and Special
Use Permit.

Final Orders
1. The Petition of Mr. Jerry Letterman, for a Special Use Permit to construct and
operate mini - warehouses in an 1 -2 zoning district, located at 4530 Barley Drive, in

the Catawba Magisteri6l District was approved with conditions by the Board of
Supervisors at the Public Hearing on January 23, 2001.
There being no additional business, the meeting was adjourned at 9:15pm.
