Approval of Agenda Mr. Al Thomason moved to approve the agenda. Motion passed 4 -0. Approval of Minutes Mr. Don Witt moved to approve the November minutes with changes. Motion passed 4 -0. Approval of Consent Agenda Mr, Kyle Robinson moved to approve the consent agenda with addition. Motion passed 4 -0. Mr. John Murphy gave a brief overview of the additional item. Site Viewing The meeting was adjourned for site viewing at 3:41 pm. 1 PUBLIC HEARING: Mr. Al Thomason called the meeting to order at 7:OOpm. Mr. Al Thomason gave the invocation and led the pledge of allegiance. 1. The continuance of the petition of Star City Church of Christ to obtain a Special Use Permit for 8.91 acres for a religious assembly located at Va. Rte. 31111-aurel Mountain Road intersection, Catawba Magisterial District. Mr. Tim Beard, Roanoke County Planning, presented the staff report for this petition and a brief overview /history of this petition. Mr. Paul Hatfield, gave an update of the previous public hearing concerns and stated the church's intention for the future, neighborhood, results of his neighborhood canvas, and traffic projections. Mr. Hatfield stated that he is willing to make any site improvements necessary. He then distributed an email message to the PC stating that there had been no reported accidents at Routes 311 and 1710 from January 1996 thru November 30, 2001. Mr. Hatfield also stated that he is in the process of selecting an architect and engineer for the project. He stated that the past flooding was due to the creek backing up resulting in 1 -3 inches of wafter coming in the building under the door. The church feels the challenge of possible flooding is small compared to the potential possibilities the church is looking at. Mr. Hatfield stated that the loan to buy the property has been approved and that he is ready to move on. Ms. Hooker questioned when the swim club had closed in relation to the traffic generated for comparison to the email accident report. Several citizens spoke. Jamie Hatfield, 1635 Hampton Avenue, SW, gave a brief church history and noted the benefits a church could add to the community. Gary Foutz, church member stated that the church would not decrease property value and it would be a benefit to the community. Judy Hatfield, Mr. Paul Hatfield's wife, stated that when she canvassed the neighbors, they emphasized that they lived in a rustic area and were interested in preserving the area. She stated that the church would preserve the landscape as necessary including during expanding the parking area and potential upcoming growth. Steve Meddor, a lifetime resident, had concerns about the increased traffic and the flood issues. Tony Hart, 13 year member and supporter of the church, stated that the church would be a good neighbor and that they had been looking for a building for a long time. He also stated that the church would be a quiet tenant. Carol Edwards, 1947 Laurel Mountain Drive, stated that she was unable to find the aforementioned flooding photos, but did locate the person who replaced the floor of the building after the 1985 flood. Robert Divers, an adjoining property owner stated that he was not looking forward to the potential of traffic from 125 cars while he was relaxing on his back porch. Paul Moore, a 9 -year church member, stated that allowing the SUP would benefit both the members and the neighbors. Ms. Hooker stated that she appreciated the work the church has done with the community and VDOT. She stated that noise and traffic seemed to be 2 the main issues from the community and that the flood was an exceptional situation. Ms. Hooker stated that the impacts to the community are manageable, as per the staff report and were in compliance with the land use type. Mr. Witt asked if this type area was not appropriate, where should churches be located. The Planning Commission is reluctant to approve SUP's for churches in commercial areas. He stated that he would have a difficult time justifying not approving the SUP and that this is an acceptable location for a church. He stated that he is aware that there are a lot of impacts and activities at churches that the neighbors have to put up with but that the members have to be sensitive to the surrounding neighbors. Mr. Robinson stated that there are a lot of other higher impact uses. Ms. Martha Hooker then made the motion to favorably recommend approval of the Special Use Permit to the BOS with the following proffer: • No principal building expansion(s) shall be permitted. Special Use Permit: AYES: Witt, Hooker, Ross, Robinson, Thomason NAYS: None ABSENT: None 2. There was a petition of Richard M. Sink to obtain a Special Use Permit to conduct a Home Occupation Business in an accessory structure for .3023 acres, located at 753 Plantation Circle, Hollins Magisterial District. Mr. David Holladay, Roanoke County Planning, presented the Staff Report for this petition. Mr. Ross asked staff whether any new machinery would be needed and verified that the equipment was not industrial, but private use size. Mr. Thomason asked how close the nearest neighbor was located. Staff responded approximately 60 feet. Mr. Richard M. Sink, 753 Plantation Circle stated that he intends to maintain the property to a high level. Mr. Witt asked what were the types of products produced. Mr. Sink stated potato boxes, bins, bookcases, desks and decorative items. There were no citizen comments. Mr. Todd Ross then made the motion to favorably recommend approval of the Special Use Permit. Special Use Permit: AYES: Witt, Hooker, Ross, Robinson, Thomason NAYS: None ABSENT: None 91 3. There was a petition of K & K Rentals, LLC to rezone .327 acres from C -1 Office District to C -2C General Commercial District with proffered C -2 uses, located at 3426 Brambleton Avenue and a portion of 3512 Brambleton Avenue, Cave Spring Magisterial District. Mr. John Murphy, Roanoke County Planning, presented the Staff Report for this petition. Mr. Witt asked if the petitioner owned the 3512 property and who was the petitioner. Staff stated that K & K Rentals was the petitioner but does not own the property at 3512. The property owner has signed the rezoning application. Mr. David Helscher, representative for the petitioner, stated that the property owner is interested in doing a long -term lease with the owner of a beauty salon. Mr. Witt expressed concern regarding the increased signage allowed under C -2 versus C -1. Mr. Helscher stated that his client would be willing to proffer that signage be limited to the C -1 requirements. Mr. Robinson verified the status of the occupancy of the houses on the property. Ms. Cindy King, 3512 Brambleton Avenue, stated that there were two condos in the front building, two in the rear building (which would be taken as one by the beauty salon) and one unit used as storage. She verified that they were requesting that the whole property be rezoned. Mr. Thomason verified the number of corporations, parking spaces available and the traffic generation. There were no citizen comments. Mr. Don Witt then made the motion to recommend favorable approval of the rezoning with the following proffer: • Use of the subject property will be limited to the current uses permitted under the existing zoning, C -1, as well as personal improvement services, consumer repair services, and personal services (excluding Laundromat/dry cleaning). • The signage requirements for the property will be limited to that allowed in the C -1 zoning district. Rezoning: AYES: Witt, Hooker, Ross, Robinson, Thomason NAYS: None ABSENT: None 4. There was a petition of Calvary Chapel of Roanoke to obtain a Special Use permit for .891 acres for a religious assembly located at 4903 Starkey Road, Cave Spring Magisterial District which was withdrawn by the petitioner. 4 5. There was a petition of Chase Potter to rezone 23.55 acres from AR, Agricultural Residential to AG -1 Agricultural /Rural Low Density District and obtain a Special Use Permit for a Shooting Range, Outdoor located at 3454 Randall Drive, Vinton Magisterial District. Mr. David Holladay, Roanoke County Planning, presented the Staff Report for this petition. Mr. Robinson verified that Mr. Potter would need a business license. He also asked if there were any state or local requirements for archery ranges. It was stated no. Mr. Robinson verified that the property would be used for tournaments only — not daily use. He also requested that the word "private" be omitted in proffer #3. It was verified that the SUP would become null and void after two years if development or use of the SUP had not been initiated. Mr. Robinson asked if the petitioner understood that any change from tournament use only to daily use of the property would require application for a new SUP and site development information as deemed necessary. Staff responded that the petitioner has a clear understanding of those requirements. Mr. Witt confirmed that the petition was for a rezoning and a SUP. He also questioned the meaning and intention of the screening required in proffer #6. Staff responded that the intent is to screen portable toilets from Randall Drive. Mr. Chase Potter, 3454 Randall Drive, petitioner, stated that there would be no alcohol on the property, that the tournaments would be scheduled for the second weekend of the month with the exception of May (the first weekend that month) and that the tournaments were open to the public. He also stated that there were twelve club members in his private club. Mr. Robinson verified that Mr. Potter was agreeable to the proffers and aware of additional requirements if the property would be used for more than just tournaments. Mr. Potter stated that there would be no clearing of the woods. He also stated that the range distances would be three to fifty yards and estimates of attendees were between 70 -110 people which would be divided between several ranges used for each tournament. There would be no parking on Randall Drive, only on the edge of Mr. Potter's driveway and a field on the property. He also confirmed that there would be packaged foods and non - alcoholic drinks available. Mr. Witt confirmed that the targets would be 100' from the property line as stated in the proffers. Mr. Potter stated that he had no problem adjusting the targets and shooting stations at least 100 feet from the property lines. Several citizens spoke. Wesley Overstreet, 13601 Hardy Road, a three year archery sportsman stated that archery was one of the cleanest sports involving all ages. Mr. William Richardson, had concerns about Mount Pleasant school children since the school is within a' /z mile radius of the property and suggested that the property should be fenced. He stated that the children in the area had been observed shooting BB guns. He was also concerned about the unposted speed limit on Randall Drive and the increased traffic. 5 He stated that the road was narrow and the speed limit should be posted or lowered. Ms. Lynn Hall, 2505 Rutrough Road, asked what would happen to the petitioner if the proffers were not met. He also questioned what recourse the citizens would have if the property were sold. Staff stated that Roanoke County is responsible for enforcing the proffers if the conditions are not met. Mr. Potter stated that he has insurance through the ASA and that the property is posted. Mr. Robinson then reviewed the suggested conditions with Mr. Potter. Mr. Kyle Robinson then made the motion to recommend favorable approval of the rezoning. Rezoning: AYES: Witt, Hooker, Ross, Robinson, Thomason NAYS: None ABSENT: None Mr. Kyle Robinson then made the motion to recommend favorable approval of the Special Use Permit with the following conditions: 1) The outdoor shooting range shall be for archery only. 2) The property shall be posted every fifty feet to restrict access to the site. 3) The facility shall be open for tournament use only, and not open daily to the general public. 4) All targets and shooting stations shall be located a minimum of 100 feet from the property lines. 5) All targets shall have sufficient terrain backdrop to stop arrow flight. 6) All portable restrooms shall be screened from public view from Randall Drive. 7) Parking shall be on site and shall not be allowed in Randall Drive right of way. Special Use Permit: AYES: Witt, Hooker, NAYS: None ABSENT: None Final Orders Ross, Robinson, Thomason The petition of Windsor House, Inc. to rezone .398 acres from R -1 Residential District to C -1 Office District with conditions for expansion of a r medical clinic and related parking, located at 2501 Pinevale Road, Windsor Hills Magisterial District, was approved by the Board of Supervisors at the Public Hearing on November 13, 2001. 2. The petition of Stephen D. and Ruth E. Nash to obtain a Special Use Permit for 11.71 acres for a private stable located at 4911 Poor Mountain Road, Catawba Magisterial District, was approved by the Board of Supervisors at the Public Hearing on November 13, 2001. 3. The petition of Star City Church of Christ to obtain a Special Use Permit for 8.91 acres for a religious assembly located at Va. Rte. 311/Laurel Mountain Road intersection, Catawba Magisterial District, was continued for 30 days by the Planning Commission at the Public Hearing on November 6, 2001 to the December 4, 2001 Planning Commission Public Hearing. 4. The petition of the Roanoke County Planning Commission to amend the Roanoke County Zoning Ordinance, Section 30 -92 Screening, Landscaping, and Buffer Yards was approved by the Board of Supervisors at the Public Hearing on November 13, 2001. 5. The petition of the Roanoke County Planning Commission to amend the Roanoke County Zoning Ordinance, Section 30 -23, Non - Conforming Uses and Structures was approved by the Board of Supervisors at the Public Hearing on November 13, 2001. The Election of the 2002 Planning Commission Chairman Mr. Al Thomason made a motion to nominate Mr. Todd Ross as Chair of the 2002 Planning Commission. Mr. Don Witt made a motion to close the nominations. This motion passed 5 -0. The motion to elect Mr. Ross passed 5 -0. Mr. Thomason made a motion to elect Mr. Don Witt as Vice - Chairman for the 2002 Planning Commission. Mr. Kyle Robinson made a motion to close the nominations. This motion passed 5 -0. The motion to elect Mr. Witt passed 5 -0. Mr. Thomason made a motion to elect Ms. Janet Scheid as Secretary to the Planning Commission with the existing slate of alternates. The motion carried 5- 0. Citizens Comments There were no citizen comments. Comments Mr. Thomason made comments regarding the 2001 year as he comes to the end of his current term as Chair. He expressed appreciation to the Commission and Staff for bearing with him this evening as he was not "up to par." There is no Planning Commission Work Session on December 18, 2001. 7 Ms. Scheid announced the promotion of Mr. David Holladay to Senior Planner, effective next Monday. Mr. Witt stated that the Planning Commission and Staff need to begin looking at their program of work for 2002. Ms. Scheid stated that the process had already begun and staff would be bringing forward project ideas early next year. There being no additional business, the meeting was adjourned at 8:40pm.
