WORK SESSION:
Session opened at 3:00pm by Mr. Al Thomason.
Approval of Agenda
Mr. Al Thomason moved to approve the agenda. Motion passed 4 -0.

PUBLIC HEARING:
Mr. Al Thomason called the meeting to order at 7:00pm. Mr. Kyle Robinson gave
the invocation and led the pledge of allegiance.
There was a petition of Judy Gustafson to rezone 200 acres from R -1
Residential District to AG -3 Agriculture and Rural Preserve District for
a commercial stable located on 5350 Poor Mountain Road, Salem, VA
24153, Catawba Magisterial District. Ms. Janet Scheid, Roanoke
County Planning, presented the Staff Report for this petition. Ms.
Scheid confirmed that proffers had been verbally discussed.
Ms. Gustafson stated that she had been a resident for 11 years and
was interested in quality horsemanship and dressage training. Ms.
Gustafson addressed several issues: an explanation of the trainer,
insurance on the horses housed on the property, waste
management/waste collection area (including an exchange of manure
for sawdust) and the presence of limited waste which leads to low
parasites or infection of the animals, and finally the limitation of the
number of horses (no long term boarding -- only short term for training
programs. There will be very little increase of traffic on Poor Mountain
Road due to the three yearly training sessions. There are currently 8
horses on the property. There is no long -term contract with the trainer.
There were no citizen comments.
Ms. Martha Hooker then made the motion to approve the Special Use
rezoning with the following proffers:
The number of horses on the property shall be no more than
eighteen (18).
The number of clinics held shall be no more than three (3) per year.

2. There the petition of W. F. Walker to rezone 4.369 acres from AG-
1, Agriculture to AR, Agricultural Residential to construct new single
family houses located at 1114 Skyview Road (Route 755), Catawba
Magisterial District. Mr. David Tickner, Roanoke County Planning,
presented the Staff Report for this petition. The number of houses
which could currently be built on the property was stated. Concern
about additional traffic generation was expressed. Driveways
would have to be shared due to setbacks. The property has a lot of

stone — would need septic permits and the setback would need to
be even further from the road.
Mr. Walker has owned the property for 10 years and was waiting for
the county to install the water in that area. There are 3 driveways
already there -- only adding 2 more — all accessed by Skyview. Mr.
Walker stated that the septic would be in the front of the houses on
the Skyview side of the road. The barn and cabin will be torn down
with the passage of rezoning (4 lots above the barn). 150 foot
frontage per lot. Confirmed that he will build the homes — 1500sf
with basement, vinyl brick grade.
Mr. Dan Phlegar, of 751 Shirley Road, Salem, VA is a 29 year
resident with the following concerns: Roadway curves (180
degrees at some areas) and lack of VDOT road maintenance, lots
located at the dangerous curves, Clear- cuVerosion problems,
quality of homes built (trailers ?), a power line which runs diagonally
across three lots causing building restrictions and the condition of
the property at this time.
Mr. Harold Walts of 723 Shirley Road, Salem, VA, a resident with
the following concerns: there is no exit off the road, inability of pass
two cars traveling in opposite directions, clear- cutting and erosion
and winter ice and snow on the roads. He suggested that the road
be improved before any building takes place.
Mrs. Virginia Cadarian of 795 Sky Cove Road a resident, was
concerned with the lack of speed limit on Sky View.
The Commission stated that they had viewed the area. Concurred
that Skyview was very dangerous and had concerns regarding the
steepness of the property and the septic concerns. There would
need to be more information given for proof regarding the
availability of the septics for the additional housing requested.
Ms. Martha Hooker then made the motion to deny the rezoning.

3. There was a petition of Marc I. Wilson to obtain a Special Use
Permit to operate an Automobile Dealership, Used on 1.4088 acres
located at 3328 Peters Creek Road, Catawba Magisterial District.
Mr. David Holladay, Roanoke County Planning, presented the Staff
Report for this petition. The Commission confirmed that the
accessory use would be incidental and subordinate to the intensity
land use. Also confirmed that there would be no physical changes
in the property.
Mr. Wilson stated that no additional parking would be necessary
and that no dollar amount measurement would be appropriate.
Martha Hooker then made the motion to approve the Special Use Permit
with the following two proffers:
• The used auto dealership shall be allowed only as an accessory
use to Minor Auto Repair
• No More than 5 vehicles shall be displayed for sale at any one time.

4. There was a petition of Larry E. Huffman to obtain a Special Use
Permit for 13.4 acres for a private stable located at Carlos Drive
(Rt. 616), Hollins Magisterial District. Mr. John Murphy, Roanoke
County Planning, presented the Staff Report for this petition. The
Commission confirmed that there were no neighbor concerns. The
requirement of VDOT for a commercial entrance was questioned as
well as the waste management for the horses.
Mr. Huffman stated that there would be a maximum of 4 -5 horses
maintained on the property, one neighbor uses his driveway and
has volunteered to assist in the care of the horses. Additionally, the
waste management will be carried off of the property.
The Commission requires that the barn be at least 200 feet from
the road.
Todd Ross then made the motion to approve the Special Use Permit with
the following proffers:
• All animals shall have sufficient grazing areas
• A maximum of 4 horses on the land
• The property shall be developed in accordance with the site plan
specifically related to the barn — no less than 200 feet from the road

5. There was a petition of Jeffrey S. Maronic to rezone 4.068 acres
from R -3, Medium Density Residential with conditions to R -3
Medium Density Residential with amended conditions, property
located at the intersection of Cave Spring Lane and Old Cave
Spring Road, Windsor Hills Magisterial District. Mr. David Tickner,
Roanoke County Planning, presented the Staff Report for this
petition. The Commission expressed some concern over the
confusion of "Lot 12.° The county attorney will be consulted
regarding the wording — "Lot 12" was kept in the wording due to the
wording in the previous paperwork. It was confirmed that there is

only one more house being built on the property — no extension
beyond the new house.
Mr. Maronic stated that he purchased the lot on the side of the hill
and plans to build his personal house there.
Mr. Earles, a resident, stated that he was concerned about the
potential noise, the sewer line being broken and water drainage
outlet from property but then said that he wasn't concerned after he
understood that the additional building would be Mr. Maronic's
personal house.
Todd Ross then made the motion to approve the rezoning with conditions
with the following proffers:
• The subject area will be developed in accordance with the
approved plan of Farmington Place Subdivision, bearing revised
date of 11127195. With the exceptions that:
1) The access easement across Lots 1 and 9 will be eliminated,
and
2) Lots 9 and 10 will be served by the same private road
currently serving Lots 11 and 12, and the storm water
detention pond.
• The Homeowner's Association, which has been established to
provide for the maintenance of the private road serving Lots 11 and
12, and the storm management area, will be responsible for the
entire length of said roadway, as it serves Lots 9, 10, 11, 12.
• The proposed private road will not be built to state standards
• The proposed development will continue to be built to the same
standards as the existing homes. They will be similar in quality and
size as the existing homes, with a minimum square footage of
1,400 square feet.
• The proposed road will not be extended, and will serve only lots 9,
10, 11, 12, and Tax Parcel # 76.20- 03 -06, as said lots are
designated on the plat of Farmington Place dated September 8,
1995, and approved by Roanoke County on November 3, 1995.
• The proposed road serving lots 9, 10, 11, 12 is private and its
maintenance, including snow removal, shall not be a public
responsibility. It shall not be eligible for acceptance into the State
Secondary System for maintenance until such time as it is
constructed and otherwise complies with all the requirements of the
Virginia Department of Transportation for the addition of subdivision
streets current at the time of such request. Any costs required to
cause this street to become eligible for addition to the State system
shall be provided with funds other than those administered by the
Virginia Department of Transportation.

Final Orders
1) The petition of the Trustees of the Korean Baptist Church to rezone 2.16
acres from C -1 Office District with conditions to C -1 Office District with Conditions
and to obtain a Special Use Permit for Religious Assembly, located at 5422
Starkey Road, Cave Spring Magisterial District was approved on February 27,
2001.
2) The petition of Jones & Jones Associates to rezone 1.31 acres from R1
Residential to R4 Residential located at 6621 Peters Creek Road, Hollins
Magisterial District was approved on February 27, 2001.
3) The petition of Mi Suk Perry to rezone 3 acres from AR Agricultural
Residential to C -2 with Clearbrook Village Overlay District for Retail Sales
located at 5679 Franklin Road, Cave Spring Magisterial District was approved on
February 27, 2001.
4) The petition of Tracy A. Bryant to rezone 1.94 acres from AR, Agricultural
Residential to AV Agricultural Village and obtain a Special Use Permit for a
Garden Center located at 7796 Bent Mountain Road, Windsor Hills Magisterial
District was approved on February 27, 2001.
There being no additional business, the meeting was adjourned at 8:35pm.
