Approval of Agenda Mr. Al Thomason moved to approve the agenda. Motion passed 5 -0. Approval of Consent Agenda It was moved to approve the consent agenda. Motion passed 5 -0. Site Viewing The meeting was adjourned for site viewing at 3:10pm. PUBLIC HEARING: Mr. Al Thomason called the meeting to order at 7:OOpm. Mr. Donald Witt gave the invocation and led the pledge of allegiance. 1. The petition Stephen D. and Marie Freeman to rezone 1.50 acres from C -2 General Commercial District with Conditions to C -1 Office District for office use, located at the southwest corner of Rosecrest Road and Route 221, Windsor Hills Magisterial District. Ms. Janet Scheid, Roanoke County Planning, presented the Staff Report for this petition. Ed Natt represented the applicants. It was stated that the facilities would be two story or smaller, limited by the size of the property. There were no citizen comments. Al Thomason then made the motion to approve the rezoning. AYES: Thomason, Hooker, Witt, Robinson, Ross NAYS: None ABSENT: None 2. The petition of Steven L. Nash and William F. Richards to rezone 1.17 acres from R1 Low Density Residential District to C -1 Office District to operate professional offices located at 4920 Colonial Avenue, Cave Spring Magisterial District. Mr. Tim Beard, Roanoke County Planning, presented the Staff Report for this petition. Staff recommends the following proffered conditions: 1) All applicable Colonial Avenue Corridor Design Guidelines shall be in effect with the word "shall" replacing the word "should" throughout 2) No building addition shall exceed one story in height and 1,500 square feet of gross floor area 3) Uses shall be limited to insurance, accounting and financial planning offices 4) Hours of operation shall be limited to 7:OOam to 9:00 pm, six days a week 5) If the existing dwelling is removed, total new building area shall not exceed one story in height and 3,000 square feet of gross floor area and shall comply fully with all Colonial Avenue Corridor Design Guidelines. A presentation was made by Ms. Cindy Webster — private citizen, neighbor, Colonial Alliance Member, owner 3 acres on Colonial Avenue. This area is designated Neighborhood Conservation Designation. Should leave only the edges on Colonial for Commercial — need to stay on the edge. The group is looking for respect of 2 neighborhood owners. Please respect and adhere to the Colonial Avenue guidelines. A presentation was made by H. Sutton Payton, Jr., 4818 Colonial Avenue, a resident since 1965 on 2.5 acres. Many available office buildings in the vicinity for use other than this property. A presentation was made by Nancy Spillman, 4904 Colonial Avenue, next door to the property since November 2000. A presentation was made by Mr. Henry Howard, 4809 Leewood Circle, overlooks property, treeline does not cover property. Telephone company has been there for 27 years. Property located on a hill, entrance on a taper from 4 to 2 lanes. Transition tapered to 18 feet, should not be less than 30 feet, present driveway is 8.5 feet. No room for a retention pond. A presentation was made by Fred Boettner, 4611 Hazel Drive, 15 year resident around corner. Harris Teeter construction impact revisited. A presentation was made by Tom Webster, 4714 Colonial Avenue, resident for 20+ years. A presentation was made by Ms. Kristen Reynolds. 3748 Martinell Avenue. A presentation was made by Pete Johnson, Jr., 3748 Martinell Avenue. Minimum setback — 30 feet. Mr. Ed Natt addressed the citizen's issues. Additional proffer by Mr. Kyle Robinson - any additional building must be an additional 20 feet behind existing building line. Proffers reviewed: • No change in property initially • Petitioner obligated by proffer to comply with studies if any changes • Any additional building must be an additional setback of 20 feet -- total of 50 feet behind existing building. • Petitioners proffered uses (brokerage, temporary services, counseling, architecture /engineering, accounting, law, real estate) and surrounding adjacent commercial development Mr. Don Witt then made the motion that petition be denied with the proffered conditions. AYES: Hooker, Ross, Witt NAYS: Thomason, Robinson ABSENT: None 3. The petition of the Trustees of Evangel Foursquare Church to obtain a Special Use Permit for 48 acres for a church and day care facility located on the 5400 block of Indian Grave Road, Cave Spring Magisterial District. Mr. John Murphy, Roanoke County Planning, presented the Staff Report for this petition. Mr. Car Kinder, Jr. represented the applicant. The conditions of the SUP originally placed are not workable under ordinance as they now exist. VDOT, not the county has the final say regarding the road. Building of roads and signals are the only conditions under review. Applicant is now using recommended entrance as requested. Applicant doesn't want to be in a fight between VDOT and the County and does the county have the authority to make the proposed requirements on the applicant. There were no citizen comments. Mr. Witt then made the motion to continue the request for the Special Use Permit. AYES: Thomason, Hooker, Witt, Robinson, Ross NAYS: None ABSENT: None 4. The petition of Michael A. Anderson to obtain a Special Use Permit for 2.1848 acres to develop a non - conforming lot of record with no public street frontage, located in the 5100 block of Starkey Lane, Cave Spring Magisterial District, Cave Spring Magisterial District. Mr. David Holladay, Roanoke County Planning, presented the Staff Report for this petition. Mr. Michael A. Anderson of 4709 Colonial Avenue addressed the Commission. No questions were asked. Mr. Don Witt then made the motion to approve the Special Use Permit. AYES: Thomason, Hooker, Witt, Robinson, Ross NAYS: None ABSENT: None 5. Petition of Nextel Partners, Inc. to obtain a Special Use Permit for 2.14 acres for an extension on tower height located at 880 Brushy Ridge Road, Catawba Magisterial District. Mr. David Tickner, Roanoke County Planning, presented the Staff Report for this petition. Third Proffer change — Strike "No lighting on the tower except as may be required by the FAA" - and change to "No lighting on the tower ". 4 Harold Timmons of Crown Castle Intl. on behalf of Nextel Partners, Inc. addressed the Commission. The height extension will enable the applicant to extend the broadcast area without constructing a new tower. _Ms. Martha Hooker then made the motion to approve the Special Use Permit with Staff Conditions of: 1) The height of the proposed tower shall not exceed 120 feet above existing grade. A monopole type structure shall be constructed. The structure shall have a structural capacity to be increased in height to 160 feet, however, the tower shall not be increased in height above 120 feet unless the increase is required to accommodate co- location of equipment for another vendor /provider, and any increase in tower height above 120 feet shall be subject to an additional special use permit application. 2) The tower structure and all attached hardware shall be a flat matted color so as to better blend into the landscape and reduce visibility and light reflection. 3) No lighting shall be installed on the tower structure or equipment building. 4) This tower shall be structurally designed to carry sufficient loading and the site shall be developed to accommodate the additional buildings necessary to accommodate co- locating of communications equipment of at least two other vendors/providers, in addition to the number of vendors/providers currently present, in addition to the City of Salem and CFW. In addition, by executing the Special Use Permit, the applicant and owner of the land agree to make the tower and tower site available for lease within the structural capacity of the tower and at reasonable costs adequate to recover the capital, operating and maintenance costs of the tower location required for the additional capacity. 5) If the use of the tower structure for wireless communications is discontinued, the tower structure shall be dismantled and removed from the site within 30 days of notice by the County, and the Special Use Permit shall become void. 6) As a part of construction, all unused structures, poles and antennas on the property shall be removed and 8 foot security fencing shall surround the compound. AYES: Thomason, Hooker, Witt, Robinson, Ross NAYS: None ABSENT: None 5 Subdivision waiver request by Mr. Don Massey to waiver Section 200.12, Street Centerlines, of the Roanoke County Public Street and Parking Design Standards and Specifications for a 5.65 acre parcel located on the NE side of Barrens Road opposite and between Ridgeview Drive and France Drive, Hollins Magisterial District. Mr. Terry Harrington presented the request to the Commission. Staff recommends approval. David Givens, L.A. Gates Company Engineer addressed the Commission. — Mr. Todd Ross then made the motion to approve the waiver. Petition of W. F. Walker to rezone 4.369 acres from AG -1, Agriculture to AR, Agricultural Residential to construct new single - family houses located at 1114 Skyview Road (Route 755), Catawba Magisterial District was denied on March 27, 2001. 3. Petition of Marc I. Wilson to obtain Automobile Dealership, Used on 1 Creek Road, Catawba Magisterial 2001. a Special Use Permit to operate an .4088 acres located at 3328 Peters District was approved on March 27, 4. Petition of Larry E. Huffman to obtain a Special Use Permit for 13.4 acres for a private stable located at Carlos Drive (Rt. 616), Hollins Magisterial District was approved on March 27, 2001. 5. Petition of Jeffrey S. Maronic to rezone 4.068 acres from R -3, Medium Density Residential with conditions to R -3 Medium Density Residential with amended conditions, property located at the intersection of Cave 6 Spring Lane and Old Cave Spring Road, Windsor Hills Magisterial District was approved on March 27, 2001. 6. The petition of Go -Mart, Inc. to obtain a Special Use Permit to operate a convenience store on 1.612 acres located at 3752 Challenger Road, Hollins Magisterial District was withdrawn by the applicant.
