Approval of Agenda Mr. Al Thomason moved to approve the agenda. Motion passed 5 -0. Approval of Minutes Mr. Al Thomason moved to approve the September minutes with changes. Motion passed 5 -0. Approval of Consent-Agenda Mr. Al Thomason moved to approve the amended consent agenda. Motion passed 5 -0. There was a brief discussion by Mr. John Murphy regarding the Subdivision Waiver request. There was a discussion /update of the Windsor House petition. There was a brief overview of the Bowman - Dalton petition. There was a brief discussion of the County Cluster Ordinance. Site Viewing The meeting was adjourned for site viewing at 5:00pm. PUBLIC HEARING: Mr. Al Thomason called the meeting to order at 7:OOpm. Mr. Donald Witt gave the invocation and led the pledge of allegiance. 1. The petition of Bowman Dalton, Inc. to Rezone 3.71 acres from C -1 Commercial Office District to R -3 Medium Density Multifamily Residential District for a development of multifamily housing located at 3990 Challenger Drive, Hollins Magisterial District. Ms. Janet Scheid, Roanoke County Planning, presented the Staff Report for this petition. Mr. Witt questioned the intention of the storm water retention basin on the site plan along Challenger Road. Ms. Scheid stated that the petitioners have not completed the final site plans and may not need a retention basin as large as shown on the plan. Mr. Natt, counsel for the petitioner, gave a brief history of the petition. He addressed Mr. Witt's question by stating that the front portion is not rezoned, the storm water area was placed on the site plan to show that the storm water management pond could be located in that area and that there would still be access. There may be several other options available for the location of the detention pond. Mr. Ross stated that he only had two issues: leaving the frontage zoned commercial and the density of the housing on the parcel. He stated that the commercial concern had been met so he was agreeable with the density issue. There were no citizen comments. Mr. Ross then made the motion to forward the petition, with the following conditions, to the Board of Supervisors with a favorable recommendation: The subject property will be developed in substantial conformity with the "Plat Showing Rezoning Exhibit, Property of Robert L. Metz and Reba S. Metz ", prepared by Lumsden Associates, P.C. under date of 13 September 2001. The access road to the C -1 property will be limited to the access road provided for the R -3 property. Rezoning: AYES: Ross, Robinson, Witt, Hooker, Thomason NAYS: None ABSENT: None 2 2. There was the petition of the Roanoke County Planning Commission to amend the Roanoke County zoning ordinance, Section 30- 21 (B) Enforcement Procedures. Ms. Janet Scheid, Roanoke County Planning, presented the Staff Report for this petition. There were no citizen comments. Mr. Thomason then made the motion to approve the amendment. AYES: Ross, Robinson, Witt, Hooker, Thomason NAYS: None ABSENT: None 3. There was the request for a subdivision waiver for the Steak and Ale property by Balzer & Associates, Cave Spring Magisterial District. Mr. John Murphy, Roanoke County Planning, presented the Staff Report for this petition. Mr. Ross confirmed that there were only two parcels involved in the waiver. One parcel is land locked. The commissioners confirmed the subdivision waiver was giving the right to subdivide the land and that the frontage is handled by the subdivision ordinance. Mr. Balzer, Balzer and Associates, representing the landowners, stated that the 3.52 -acre parcel was underdeveloped, and limited by access. The owners are looking to preserve the restaurant (contract pending for purchase) and had originally tried to purchase the adjoining land to extend the frontage. They were only trying to create two lots. The plat property line may need to be shifted. The residual land is planned for development — possibly as a small Executive Inn. The owners do not want to lock into the plat or proffer the line because the plan offered is a concept plan only. Parking requirements are met, only the frontage requirements are inadequate. Mr. Robinson stated that he had a concern regarding the dedication of the road, but would support the waiver because there is adequate land to develop the property. Mr. Thomason stated that he did not concur with a "blank check" idea for the frontage requirements. He likes the two lots, but is concerned that the developer should be locked into a specific frontage for each parcel rather than a floating frontage requirement. Mr. Robinson stated that he supported the petition because of the pre- existing circumstances on a large tract of developed land and that the subdivision waiver should be approved due to the pre - existing conditions. Ms. Hooker clarified the signage limitations on a parcel without road frontage. It was confirmed that a freestanding sign must have 100 feet of road frontage. Signage on lots without frontage would have to be attached to the building. Mr. Witt confirmed signage requirements. There were no citizen comments. Mr. Donald Witt then made the motion to subdivide the property into a maximum of two parcels with the frontage requirement flexible to the point that it can vary from 0 -100 feet per property. AYES: Ross, Robinson, Witt, Hooker, Thomason NAYS: None ABSENT: None Citizens Comments There were no citizen comments. Comments Final Orders 1. The continuation from the August Public Hearing of petition of Nathaniel C. Haile to obtain a Special Use Permit to develop a golf course on 364 acres and rezone 118 acres from AG -3, Agricultural to AR, Agricultural Residential, located at 3608 Pitzer Road, SE, Vinton Magisterial District, was continued by the applicant. 2. The petition of Windsor House, Inc. to rezone .398 acres from R -1 Residential District to C-1 Office District with conditions for expansion of a medical clinic and related parking, located at 3500 block of Pinevale Road, Windsor Hills Magisterial District, was continued by the Board of Supervisors on September 25, 2001.
