HomeMy WebLinkAbout7/21/2015 - MinutesCommissioners Present: Mr. Wayne Bower Ms. Martha Hooker Mr. Rick James Mr. Gene Marrano (arrived after approval of June 2, 2015 minutes) Mr. Jim Woltz Mr. Philip Thompson Mr. Ruth Ellen Kuhnel, Senior Assistant County Attorney Mr. John Murphy Ms. Megan Cronis,e Ms. Becky James Ms. Naomi Siodmok Mr., Brian Hughes Ms. Susan McCoy, Recording Secretary Call to Order Mr. James called the meeting to order at 6:03 p.m. Approval of Agenda Mr. Woltz imade a motion to approve the agenda, which passed 4-0. Approval of Minutes Ms. Hooker made a motion to approve the minutes, as amended of June 2, 2015, which passed 4-0. Mir. James made a motion to approve the minutes of June 16, 2015, which passed 3,-0-2, with Ms. Hooker and Mr. Woltz abstaining. Consent Agenda There were no items for the Consent Agenda. Zoning Ordinance Amendments Mr. Thompson discussed the proposed Zoning Ordinance Amendments. He provided an overview and history of previous changes. He reviewed the current standards for permitted bed and breakfast use. He suggiested allowing this use in R-2 areas. He discussed allowing certain commercial uses in 1-1 area. Mr. James inquired about permitted uses in 1-1, including construction, recreational vehicles sales and service. Mr. Thompson discussed having similar processes for similar uses. Mr. Thompson discussed this issue. Mr. Marrano noted requiring a special use permit would allow more control over the use. Mr. Thompson, Ms. Kuhnel, and the Commission discussed providing a process for certain uses. Mr. Thompson discussed standards allowing accessory apartment use by -right in some areas, noting if the use does not meet standards a special use permit would be required. He discussed allowing this use in a multi -family district if the accessory apartment is part of the home. He stated that if the square footage request is higher than the percentage allowed in the design standards, a special use permit would be required. Mr. Thompson and the Commissioners discussed adding bed and breakfast use to residential districts. The consensus of the Commission was to allow bed and breakfast use in R-1 and R-2 districts with a maximum of four guests at a time. Mr. Thompson, Ms. Kuhnel, and the Commissioners discussed commercial kennel standards and procedures, noting some kennels are primarily pet daycare centers. The consensus of the Commission was to review regulations regarding commercial kennels. Mr. Thompson discussed regulations regarding private stable use. Mr. Hughes discussed the requirements and regulations regarding private stables in other jurisdictions and compared them to County regulations. He reviewed information received from Virginia Tech Cooperative Extension Agency, Virginia Department of Agriculture, and the Virginia State Veterinarian regarding needs and requirements for horses. He discussed pasture size, waste management, lot size, and fencing requirements. Mr. James inquired about waste storage. Mr. Hughes and the Commission discussed this issue. Mr. Marrano inquired if other localities require a dwelling on property. Mr. Hughes stated Roanoke County is the only locality with this requirement. Mr. Woltz stated the minimum should be two acres per horse, noting you cannot regulate or enforce supplemental feeding. He discussed year round water requirements. Mr. Thompson, Mr. Hughes, and the Commission discussed shelter for the horses. Ms. James discussed the definition of pasture. Mr. Thompson discussed animal density on the property. Mr. Bower stated requiring a house be located on the property should be removed from the standards. Ms. Melanie Bond, 802 Skyview Road, stated each horse requires various amounts of space and grazing area. She stated two acres would allow room for exercise, noting food from pasture land does not exist in the winter. Mr. Thompson stated that in agricultural areas the minimum lot size is two acres. Mr. Thompson and the Commissioners discussed the need for the horse owner to provide nearby residents with an emergency contact. Mr. Thompson discussed stormwater management regulations. The general consensus of the Commission was to require two fenced acres and remove requirement regarding dwelling on the property. Mr. Thompson reviewed the residential chicken keeping use regulations. Mr. Thompson and the Commissioners discussed developing a sliding scale for the number of chickens allowed based on the lot size. The consensus of the Commission was to amend the residential chicken keeping regulations. Page 2of3 ROANOKE COUNTY PLANNING COMMISSION MINUTES JULY 21, 2015 Mr. Thompson and the Commission discussed allowing fitness centers in 1-1 and 1-2, noting most surrounding localities allow this use in industrial districts. The consensus of the Commission was to allow fitness center in 1-1 and 1-2 districts. Mr. Thompson stated a citizen has requested that the County review regulations regarding special events such as weddings. Mr. Thompson, Ms. Kuhnel, and the Commission discussed issues including noise and time restrictions. Final Orders 1. The petition of Carl and Carol Slate to obtain a special use permit for a private stable in a R-1, Low Density Residential, District, on approximately 2.012 acres, located at 7904 Carvin Street, Hollins Magisterial District was approved by the Board of Supervisors on June 23, 2015. Citizens' Comments There were none. Commissioners' and Staff Comments Mr. Thompson stated there are no petitions scheduled for public hearing on August 4, 2015. Mr. Woltz made a motion to cancel the August 4, 2015 Planning Commission Meeting and hold a Planning Commission Public Hearing for Zoning Ordinance Amendments on August 18, 2015, which passed 4-0.
