Approval of Agenda Mr. Woltz made a motion to approve the agenda, which passed 4-0. Approval of Minutes Mr. Butzer made a motion to approve the minutes of June 7, 2016, which passed 4-0. Consent Agenda Mr. Thompson provided an overview of the petition of Stephen Hartman, including a brief history of the property, access, and site plan. Mr. Thompson and the Commissioners discussed the existing proffers on the property, noting removing the proffers will make the property more marketable. They discussed property frontage and signage regulations. Mr. Bower made a motion to approve the consent agenda, which passed 4-0. The petition of Kate Madison Properties, LLC to rezone approximately 0.99 acre from R-1, Low Density Residential, District to G1, Low Intensity Commercial, District on property located at 3746 Colonial Avenue, Cave Spring Magisterial District. Mr. Hughes presented the staff report, including revised proffers, concept plan, and future land use designation. Mr. James inquired about buffering requirements. Mr. Hughes discussed the buffering requirements for the proposed use. Mr. Butzer inquired about existing fencing on the property. Mr. Hughes discussed the fencing requirements and maintenance. Mr. Bower inquired about parking regulations. Mr. Hughes discussed parking regulations, noting the petitioner will be providing more spaces than required and most of the parking would be in the front portion of the property. Mr. James inquired about current buffering. Mr. Hughes discussed existing vegetation. Mr. Waltz discussed future land use designation, noting nearby properties are commercial. He stated backyard parking should not be restricted. Mr. Hughes discussed parking regulations. Mr. Thompson stated an 18 foot minimum sideyard setback is required per the Zoning Ordinance. Ms. Katherine Beard and Ms. Madison Madden, co-owners of business, provided an overview of the business. Ms. Beard stated they are currently in their third year in business and have outgrown their current location. Ms. Madison described the business, noting it is an upscale business. Ms. Beard stated the proposed location is very near their current location. Mr. Woltz inquired about operation of the business. Ms. Madison described the type of business, noting they require appointments and do not currently accept walk-in clients. She discussed hours of operation. Ms. Beard noted they are closed on Sundays. Ms. Madison stated the new site would increase the size of their facility from approximately 800 sq. ft. to 3000 sq. ft. Mr. James inquired about the number of people employed. Ms. Madison stated currently five people are employed by their organization. Mr. James opened the public hearing for public comment. Mr. Mark Overstreet, 3835 Thompsons Lane, stated a similar petition was previously denied by the County. He stated he was representing others who live in the nearby neighborhood. He stated the neighborhood is a safe and quiet setting and they do not want to become like Brambleton Avenue. He stated they intend to keep the area residential. He stated traffic is frequently backed up on Colonial Avenue which limits access to nearby homes. He discussed the frequency of accidents in this area. He discussed concerns regarding parking and stormwater runoff from the proposed parking area. He stated VDOT has stated Colonial Avenue is at maximum capacity. He asked that the petition be denied. Ms. Marilyn Henry, 3740 Green Valley Drive, stated she has lived in her home since 1994 and was raised in the house next to her current home. She stated Page 2of6 ROANOKE COUNTY PLANNING COMMISSION MINUTES JULY 5, 2016 she has seen development on Colonial Avenue. She stated she does not want businesses so near her home. She discussed increasing traffic and safety issues. She stated the area has a residential feel. Ms. Margaret Sharpe, 3651 Cedar Lane, stated commercial businesses have slowly moved onto Colonial Avenue. She stated residents should be able to come and go as they please, noting traffic and accidents have increased. She stated this type of use does not need to be near a residential area. With no other citizens requesting to speak, Mr. James closed the public hearing. Mr. Bowers inquired about Fire and Rescue comments. Mr. Hughes stated Fire and Rescue has not objections. He stated the Police did not submit any concerns regarding the petition. Mr. James inquired about accident statistics. Mr. Hughes stated VDOT will be included in the site plan review process if the petition is approved. Mr. Bower noted the Western Virginia Water Authority has no objection to the proposed use. He also noted the petitioner will need to meet the Colonial Avenue Guidelines. Mr. Woltz stated he understands citizen concerns but the use fits into the nearby commercial development. Mr. Thompson noted that proffer 5, regarding general conformance with the concept plan, addresses the layout of property. Mr. Butzer made a motion to recommend approval of the petition with the following conditions: 1. The project shall have only one entrance onto Colonial Avenue. 2. No neon signage will be on the property. 3. Hours of operation shall be limited from 7:00 am to 9:00 pm. 4. The freestanding sign shall be limited to a brick monument -style sign not to exceed five feet in height and seven feet in width. 5. The property will be developed in general conformance with the concept plan submitted on July 5, 2016 (titled exhibit one), with any changes required under the Roanoke County comprehensive site plan review process. 6. The property will adhere to the applicable Colonial Avenue Corridor Design Guidelines for development and redevelopment. Mr. Thompson called the roll and the motion passed (4-0) with the following vote: AYES: Bower, Butzer, James, Woltz NAYES: None ABSTAIN: None 2. The petition The petition of Refuge Church to obtain a Special Use Permit in a C - 2C, High Intensity Commercial, District with conditions for the operation of religious assembly on approximately 1.92 acres, located at 4145 and 4173 West Main Street, Catawba Magisterial District. Ms. Pattisall presented the staff Page 3of6 ROANOKE COUNTY PLANNING COMMISSION MINUTES JULY 5, 2016 report, including a brief history of the property, zoning, and future land use designation. She reviewed proposed access and parking availability, noting the petitioner will add handicapped parking spaces. She stated the use is in conformance with the Glenvar Village Community Plan. Mr. Butzer inquired about hours of operation. Ms. Pattisall stated some evening programs will be conducted, noting there are no conflicts with the store. Mr. Butzer inquired about membership. She stated up to 80 people according to parking availability. She stated the church is currently in Elliston but has a strong base in the Glenvar area. Mr. Woltz inquired about access. Ms. Pattisall stated the buildings are owned by the same person. She stated additional parking is available, if needed. Mr. Chuck Garner, pastor, stated the use would match the Glenvar Village Community Plan. Mr. James inquired about church growth. Mr. Garner started moving toward Salem will allow more growth and options for the church. Mr. James inquired about primary hours of operation. Mr. Garner stated currently 50 people attend the church, noting they currently do not have Sunday evening functions. He stated in the future they want to utilize the church throughout the week. Mr. Woltz asked if the Elliston location would continue to be utilized by the church. Mr. Garner stated the entire church membership would be moved to the proposed location. Mr. James opened the public hearing for public comment. With no citizens requesting to speak, Mr. James closed the public hearing. Mr. Butzer noted the property has ample parking and is a good location for the church. Mr. James inquired if the petitioner plans to remark the parking area at the rear of the church. Mr. Garner affirmed they do plan to remark the parking area. Mr. James noted the proposed use is in conformance with the Glenvar Village Community Plan for community center. Mr. Woltz made a motion to recommend approval of the petition. Mr. Thompson called the roll and the motion passed (4-0) with the following vote: AYES: Bower, Butzer, James, Woltz NAYES: None ABSTAIN: None Citizen Comments Mr. Frederick Taylor and Ms. Zheng Xu provided a handout regarding the use of shipping containers in residential building. Mr. Taylor stated Ms. Xu is an architect. He provided an overview of his property which has been approved for a cluster development on Merriman Road consisting of 18 lots and a 1.5 acre pond. He discussed using shipping containers as housing. He stated he is requesting permission to pursue this type of alternative housing on his property. He stated he lives in the Page 4of6 ROANOKE COUNTY PLANNING COMMISSION MINUTES JULY 5, 2016 house adjacent to the proposed development. He stated the use of the containers is inexpensive, noting there are examples of their use as housing all over the world. Ms. Zu stated the containers are affordable and sustainable. She stated she saw a competition regarding this type of housing. Mr. James stated the Commission has been discussing reviewing alternative types of housing. Mr. Taylor stated he has met with County staff but they are unable to find a model ordinance which deals with this type of housing. Mr. Woltz stated it is important to create concepts to present to the Commission. He inquired about neighbors. Mr. Taylor stated he has almost no neighbors. He stated he needs feedback in order to move forward. Mr. Thompson discussed the property zoning, noting it is zoned R-1, Low Denisty Residential and R-2, Medium Denisty Residential. Mr. Taylor stated it is difficult to come up with ideas without feedback. Mr. Butzer stated he will have to comply with permitting regulations. Mr. Taylor stated the Building Department said yes and the Zoning Department said no. Mr. James inquired about site standards. Mr. Taylor stated currently he has 17 subdivided lots. Mr. Thompson discussed definitions regarding landuse, manufactured homes, and standards. He stated they will need to review various types of housing standards. Mr. Woltz inquired about square footage cost projection. Mr. Taylor stated they have been successful in Fincastle. He stated the unit is 40 feet for a single family. Mr. Bower stated the standard shipping container is 8 feet x 40 feet, noting they need more information. Mr. Taylor stated there are infinite variations, noting economics are powerful. Mr. Thompson stated Mr. Murphy can discuss this issue at a future Planning Commission Work Session. Mr. Bower suggested that Mr. Taylor bring some proposed designs for review. Commissioners' and Staff Comments The Commissioners expressed appreciation to Mr. Gene Marrano for his service on the Planning Commission. Mr. Bower inquired about the State Central Bank petition. Ms. Pattisall provided a status update of the petition. Mr. Thompson stated Mr. Paul Mahoney has been appointed Planning Commissioner, Cave Spring Magisterial District. He stated Mr. Butzer has been re -appointed Planning Commissioner, Catawba Magisterial District. Mr. Thompson provided a status update regarding the Community Strategic Plan, noting it will be considered for adoption at the August 9, 2016 Board of Supervisors Meeting. Mr. James inquired about the status of the McDonald's on Route 220. Mr. Thompson and Ms. Pattisall provided a status update. Final Orders 1. The proposed amendments to the Roanoke County Zoning Ordinance. The proposed amendments would include but are not limited to: Article I (General Provisions), amending Powers and Duties of the Board of Zoning Appeals; Article II (Definitions and Use Types), amending the definitions of residential chicken Page 5of6 ROANOKE COUNTY PLANNING COMMISSION MINUTES JULY 5, 2016 keeping and variance, and adding definitions for bed and breakfast inn, country inn, and special events facility; Article III (District Regulations), to allow single family dwelling, detached with zero lot line option as a by -right use in the AR, Agricultural/Residential District, and to allow bed and breakfast inn, country inn, and special events facility as a special use in the AG -3, Agricultural/Rural Preserve District, AG -1, Agricultural/Rural Low Density District, and the AV, Agricultural/Village Center District; Article IV (Use and Design Standards), amending or adding standards for single family dwelling, detached with zero lot line option, bed and breakfast inn, business or trade school, country inn, and special events facility; and Article V (Development Standards), removing Maximum Off -Street Parking standards and amending the Bicycle Parking Standards were approved by the Board of Supervisors at a Public Hearing on June 28, 2016.
