Work Session
Mr. James called the meeting to order at 6:00 p.m.
Approval of Agenda
Mr. Butzer made a motion to approve the agenda, which passed 4-0.
Alternative Housing
Mr. Murphy provided a history of an approved cluster subdivision on Merriman Road,
noting a request has been made by the owner to use shipping containers as, housing.
Mr. Murphy stated he has checked with other jurisdictions but using shipping containers
as housing is not clearly defined. He stated the Zoning Ordinance regulates shipping
containers and was geared towards the use of PODs as temporary storage containers.
He discussed restrictions noting they are not to be inhabited. He discussed restrictions
regarding housing types. Mr. Murphy provided handouts of various types of alternative
housing, including huts, yuirts, and tiny houses. He stated Mr. Frederick Taylor has
provided', some examples of shipping container, housing.
Mr. Butzer stated Lexington, Kentucky has some information on its website regarding
this type of housing. Mr. James inquired about regulations regarding building codes.

Mr. Yates stated building code regulations apply to structures 256 square feet and
above whether the structure is inhabited or not. He stated the structure would have to
meet the Virginia Residential Code. He stated if the structure has a permanent
foundation it is also subject to building code regulations. He stated shipping containers
are exempt from building code since they do not meet the criteria for regulations. He
stated they regulate modular and stick -built homes, noting they can accept a building
structure if a stamp certifying the structure is received from a licensed architect. Mr.
Butzer inquired about using information from Lexington, Kentucky website. Ms. Pattisall
stated she had spoken with a planner in that locality. Mr. James inquired about zoning
areas in Kentucky. Mr. Murphy stated it is a new concept. Mr. Murphy and the
Commissioners discussed creating a section for regulations regarding non-traditional
housing types, including use and design standards. They discussed areas where
alterative housing potentially may be allowed. They discussed subdivision covenants,
real estate values, and neighborhood compatibility. Mr. Murphy and the Commissioners
discussed current subdivision regulations and use and design standards for
campgrounds.
Mr. Yates discussed building codes for permanent dwellings, including apartments and
hotels which would follow the Virginia Building Code. He discussed requirements for
transient and non -transient type dwellings, noting transient is under 30 days. They
discussed various types of dwellings and applicable regulations.
Mr. Murphy discussed traditional and non-traditional housing. He discussed Federal
Standards, State Code, and local regulations. Mr. Yates stated water and septic are
regulated by the State Health Department unless public water and sewer are available
for the site. Mr. Yates and the Commissioners discussed building regulations for
residential homes. Mr. Bower discussed ventilation requirements for homes. Mr. Yates
discussed regulations regarding this issue. He stated if the design professional certifies
the structure, no inspections are needed. Mr. Woltz asked Mr. Taylor if any covenants
or proffers had been placed on the cluster subdivision. Mr. Taylor stated none were
placed on the property.
Mr. Bower inquired about Mr. Taylor's property. Mr. Taylor discussed the evolution of
the economy, noting they previously planned to sell individual lots within the cluster
development. He stated they are unsure now if they will sell or rent homes on the
property. Mr. Murphy stated Mr. Taylor's property is vested with the original cluster
ordinance. Mr. Murphy stated Mr. Taylor has approved site plans. Mr. Taylor stated he
has installed sewer into the subdivision.
Mr. Taylor requested the Commission adjust the ordinance to allow the option to use
shipping containers for housing. The Commissioners discussed this issue.

Commissioners' and Staff Comments
Mr. Bower discussed the IYS XXII, L.C. Community Meeting, noting concerns
expressed by citizens included the petitioner currently being in violation of ordinance,
safety issues, and property values.
Mr. Bower stated concerns expressed by citizens at the Roanoke H&R RE, LLLP and
Fralin & Waldron Commercial Rental Limited Partnership Community Meeting included
traffic issues, lighting, and lower property values. Ms. Pattisall discussed the zoning
and future land use designation of the property. Mr. Bower stated the citizens are also
concerned about water quality and runoff, fire and rescue vehicles, and the proposed
pond. Ms. Pattisall discussed the traffic summary.
Mr. Woltz stated he told a citizen who called him that he has recused himself from any
action regarding Roanoke H&R RE, LLLP and Fralin & Waldron Commercial Rental
Limited Partnership. He referred the caller to the other Commissioners.
Mr. Butzer stated he has received his certification as a Certified Planning
Commissioner.
Mr. Murphy provided an update regarding Roanoke H&R RE, LLLP and Fralin &
Waldron Commercial Rental Limited Partnership, noting the Planning Commission
Public Hearing has been postponed until October 4, 2016.
Mr. Murphy provided an update regarding the IYS XXII, L.C. petition, noting it may be
postponed.
Ms. Cronise provided an update regarding the Route 419 Corridor Study, noting they
currently have a consultant under contract. She stated the kickoff for the study is
tentatively scheduled for September 15, 2016, at 6:30 p.m. at Holiday Inn Tanglewood,
4468 Starkey Road.
With no further business or comments, Mr. James adjourned the meeting at 7:35 p.m.
