Call to Order:
Mr. Jarrell called the Public Hearing to order at 7:00 p.m. Mr. McNeil gave the
invocation and led the pledge of allegiance.
Approval of Agenda
Mr. Peters made a motion to approve the agenda as amended, which passed 5 -0.
Approval of Minutes
Ms. Hooker made a motion to approve the minutes of June 7, 2011, which passed
5 -0.
Consent Agenda
Mr. Holladay provided a PowerPoint presentation regarding the petition of Roanoke
County Economic Development Authority, including future land use, current zoning, and
the site plan. He reviewed the current and proposed conditions, including signage
changes.
Mr. Holladay discussed the petition for Roanoke Council of Garden Clubs. He reviewed
the proposed changes to the proffers including leasing of the building for religious
assembly. Ms. Hooker requested to review the Planning Commission Public Hearing
minutes from October 2004.
Mr. Radford made a motion to approve the consent agenda for August 2, 2011, which
passed 5 -0.
Public Hearing
1. The petition of Angelo R. Gianni, Jr. to obtain a Special Use Permit in a R -1, Low
Density Residential, District for a multiple dog permit for five (5) dogs on 1.02

acres, located at 6539 Fairway View Trail, Windsor Hills Magisterial District. Ms.
Micklow presented the staff report which included a brief history of the petition,
surrounding zoning, and topography of the property. She stated the dogs are
secured by an invisible electronic fence. She stated she received emails from
Ms. Lisa Lauria and Mr. Chris Lauria, 6609 Fairway View Trail, and Ms. Laura
McCarty and Mr. Geoff McCarty, 6530 Fairway View Trail, opposing the petition
and expressing concern regarding noise of barking dogs at night. She stated she
had also received calls from Dr. George and Ms. Mary Baron expressing concern
about the petition. She stated animal control has not received any complaints
regarding the petitioner's dogs.
Ms. Evelyn Muse, spoke on behalf of the petitioner, explaining that the petitioner
moved from Ohio. She explained the dogs are small inside dogs. She stated the
petitioner will be in attendance at the Board of Supervisors Public Hearing.
Ms. Hooker inquired about the use of bark collars for the dogs. The
representative stated she was unaware if collars had been used. She stated
dogs are inside at night. Mr. Peters expressed concern regarding small dogs
reportedly being left out at night. Mr. Jarrell inquired if the dogs would be used
for breeding purposes. The representative stated the dogs would not be used
for breeding and that the dogs had been acquired for the petitioner's daughters.
Dr. Dennis Weiserbs, 6538 Fairway View Trail, expressed concern regarding the
petition noting the area is a subdivision and not a rural area. He requested that a
restriction be placed on the special use permit to include only the current
animals. He expressed concern regarding breeding of animals on the property.
Mr. Jarrell inquired about current zoning restrictions. Ms. Micklow discussed this
issue. Mr. Radford suggested adding a condition that the SUP would cover only
the current four dogs. Mr. McNeil concurred. Mr. Obenshain discussed the issue.
Mr. Jarrell suggested limiting the weight of each dog. Mr. Holladay discussed
enforcement issues. Ms. Hooker expressed concern regarding noise issues.
She discussed difficulty mitigating concerns without the petitioner being present.
Mr. Jarrell stated the SUP would need to be exclusively for the current property
owner. Mr. Peters suggested continuing the petition for 30 days. Mr. Obenshain
discussed this issue. Mr. Jarrell expressed concern regarding unanswered
questions regarding the petition.
Mr. Radford made a motion to recommend approval of the special use permit
request with the following conditions:
The Multiple Dog Permit shall be for a maximum of 4 dogs not to exceed
25 pounds each.
2. The Special Use Permit shall be issued to Angelo R. Gianni, Jr. only, and
shall not be transferable to any other subsequent property owner. It shall
be the responsibility of Mr. Gianni to notify the Zoning Administrator, in
writing, of the transfer of ownership of the property within thirty (30) days
of the transfer.
Mr. Holladay called the roll and the motion passed (3 -2) with the following vote:

Other Business
Mr. Holladay provided a brief overview of the Roanoke Valley Resource Authority, Host
Community Improvement Fund Review and Approval of Expenditures for Public
Improvement Plan. Mr. Steve Barger, Operations Manager, spoke regarding the plan,
stating internet service would be acquired for a dedicated line at the Smith Gap Landfill.
He stated the community would have access through the landfill's internet connection.
Mr. Obenshain briefly discussed the cost of other options. Ms. Hooker noted the
surrounding community voted unanimously in favor of the internet connection. Mr.
Barger stated the majority of citizens would be in favor of the connection. Ms. Hooker
explained there is a $150,000 cap on the host community's funds. Mr. Barger explained
the asset the internet will be for the facility especially regarding natural gas collection.
Ms. Hooker stated this is a wonderful opportunity to help the people hosting the landfill.
Mr. Radford concurred. Mr. McNeil inquired about details regarding the development of
the collaboration. Mr. Barger stated it was a joint venture between county and the host
community's board members. Mr. McNeil inquired about cost. Mr. Obenshain
discussed this issue. Mr. Barger stated it may improve availability of 911 service. Mr.
Jarrell stated that the commission had not been invited to meetings or received
information regarding this service. Mr. Barger noted the host board was set up by the
planning commission. Mr. Obenshain discussed the history of the procedure. Mr.
Peters noted the citizens in the area are in favor of the expenditure for the connection.
Ms. Hooker reiterated the families have been imposed upon by the landfill and they are
in favor of having access to the internet. Mr. Barger and Mr. Holladay discussed the
development of the committee. Mr. Holladay also discussed the timeline of
implementing the plan. Mr. Peters noted it will benefit the community. Mr. McNeil
stated he would like to have heard directly from the committee members. Mr. Barger
invited the commission to visit the facility and review the guidelines.
Ms. Hooker made a motion to recommend approval of the plan.
Mr. Holladay called the roll and the motion passed (5 -0) with the following vote:

Final Orders
1. The petition of Sandra Finck to obtain a Special Use Permit in a R -1 S, Low
Density Residential, District with a special use permit for a multiple dog permit
for four (4) dogs on 2.24 acres, located at 2929 Elderwood Road, Catawba
Magisterial District was approved by the Board of Supervisors at a Public
Hearing on June 28, 2011.
2. The petition of National Park Service /Blue Ridge Parkway, to obtain a Special
Use Permit in a AG -3S, Agricultural /Rural Preserve, District with a special use
permit to construct a broadcasting tower on 27.612 acres, located off

Honeysuckle Road on Poor Mountain, Windsor Hills District was approved by
the Board of Supervisors at a Public Hearing on June 28, 2011.
3. The petition of the Roanoke County Board of Supervisors, Town of Vinton,
and Cardinal IG Company to amend the covenants, conditions, and Master
Plan on 99 acres zoned PTD, Planned Technology Development, District at
the Vinton Business Center, located near the 2100 through 2400 block of
Hardy Road and the 2100 block of Cardinal Park Drive, Vinton Magisterial
District was approved by the Board of Supervisors at a Public Hearing on
June 28, 2011.
4. The petition of Carol and Jason Lachowicz to rezone approximately 5.476
acres from AG -3, Agricultural /Rural Preserve, District, C -2C, General
Commercial, District with conditions, and C -1 C, Office, District with conditions
to AV, Agricultural/Village Center, District and AG -3, Agricultural /Rural
Preserve, District, located at 8346 Bent Mountain Road, 8364 Bent Mountain
Road, and 8399 Strawberry Lane, Windsor Hills Magisterial District was
approved by the Board of Supervisors at a Public Hearing on June 28, 2011.
Citizen Comments
There were none.
With no other citizens requesting to speak, Mr. Jarrell closed the citizen comment
period.
Commissioners' and Staff Comments
Mr. Radford requested an update on the amendments to the large wind ordinance. Mr.
Holladay stated the issue will be discussed at the Board of Supervisors Work Session
on July 26, 2011.
The commissioners requested to learn more about the Smith Gap Landfill.
With no further business or comments, Mr. Jarrell adjourned the meeting at 8:21 p.m.
