Approval of Minutes Ms. Hooker made a motion to approve September 20, 2011, which passed 5 -0. the minutes of September 6, 2011, and Revisions to Planninq Commission's Meetinq Schedule Mr. Thompson discussed proposed schedule changes for the November 2011 Planning Commission meetings. Mr. Peters made a motion to change the November Planning Commission Public Hearing to November 1, 2011, beginning at 7:00 p.m. and in lieu of a work session the Glenvar Planning Commission Public Hearing will be held on November 14, 2011, beginning at 7:00 p.m., which passed 5 -0. Mr. McNeil made a motion to approve the consent agenda, which passed 5 -0. Commissioner and Staff Comments Mr. Thompson stated the balloon test for Skyway Towers will be conducted on October 4, 2011. Mr. Jarrell inquired about site visit to Glenn Reed property. Mr. Thompson and commissioners discussed this issue. With no further comments, Mr. Jarrell adjourned the work session at 4:12 p.m. for site viewing. EVENING SESSION Mr. Jarrell called the Public Hearing to order at 7:00 p.m. He gave the invocation and led the pledge of allegiance. 1. The petition of Glenn L. Reed, to rezone 13.7 acres from AR, Agricultural /Residential, District to AV, Agricultural/Village Center, District for private /secondary educational facilities and general office use and to obtain a special use permit in order to operate a convenience store, located in the 9600 block of Bent Mountain Road, Windsor Hills Magisterial District. Ms. Pattisall presented the staff report, including the proposed site plan, surrounding zoning, and future land use. She stated the fire marshal has issued a fire flow waiver and VDOT has no objections. She reviewed input received from citizens at the September 8, 2011, Community Meeting including lighting and landscaping. Mr. Radford inquired about proffered conditions. Mr. Thompson explained commissions' options regarding procedure. Mr. Rodney Pierson, Pierson Engineering, provided an overview of the petition. He stated the property has been perked and has a private well. He discussed minimizing safety issues for the school and buffering proffer to reduce noise impacts. Mr. McNeil asked if state requirements have been met for the school. Mr. Pierson noted it is a private school and they are up to date. Ms. Hooker discussed the need for proffered conditions. Mr. Peters inquired about using Tinsley Lane for better emergency access. Mr. Pierson discussed VDOT constraints and guidelines regarding the property entrance. He stated if the entrance is not at top of the hill sight distance would be impaired. Mr. Jarrell opened the public hearing for public comment. Page 2 of 5 ROANOKE COUNTY PLANNING COMMISSION MINUTES October 4, 2011 Mr. Kevin Poff, 6699 Bent Mountain Road, stated he purchased his property for $38,500 at which time the petitioner stated he had plans to develop a convenience store but not other development. He stated other businesses would crowd him and his property value would decrease. He stated lighting from school or convenience store would impact his property. Mr. Paul Sandburg, 1345 Bottom Creek Lane, stated he owns a convenience store located approximately one -half of a mile from petitioner's property. He reviewed the history of his store, noting the previous owners of his had filed bankruptcy twice and the property was sold at auction. He stated he and his partner are retired and do not make enough from the store to support them. He stated gas is cheaper at other locations in town. He asked about the reason the petitioner has requested rezoning at this time if he does not have plans to develop the property in the near future. Mr. Pierson stated buildings will be phased, noting the school would be first to be developed. He stated the petitioner wanted to put all proposed uses upfront and show total buildout. He stated lighting would meet all county codes with lights being shielded. He reviewed stormwater management plans. Mr. Radford stated he appreciates the petitioner's desire for economic development on top of Bent Mountain but he would be in favor of continuing the petition in order to develop proffered conditions. The other commissioners concurred. Mr. Pierson inquired about specific proffers. Ms. Pattisall discussed this issue. Mr. Peters inquired about available road frontage. Mr. Pierson discussed sight distance issues. Mr. Peters inquired about the addition of a turning lane. Mr. Pierson stated the sight distance from both directions would need to be considered, as well as stormwater runoff issues. Mr. David Higginbotham, 9947 Tinsley Lane, stated his property is adjacent to the petitioner's property. He inquired about the reason the petitioner has requested the rezoning to include the entire 13 acres when the school would only require 2 acres. Mr. Radford stated the petitioner has not shown development options. Mr. McNeil stated the petitioner will need to provide staff with more information. Mr. Thompson suggested Mr. Reed and Mr. Pierson meet with staff to discuss options. He noted that if the property is not rezoned from AR to AV, the petitioner will still need a special use permit for the proposed school. He also noted the convenience store and office are not allowed in AR zoning designations. Mr. Thompson and commissioners discussed options and procedures. Mr. Radford made a motion to continue the rezoning and special use permit request to November 1, 2011. The petition of Skyway Towers, to obtain a Special Use Permit for an approximately 199' broadcasting tower in an AG -3, Agricultural /Rural Preserve, District on 17.12 acres, located at 3557 Jae Valley Road, Vinton Magisterial District. Ms. Micklow presented the staff report stating the structure would be monopole in design and light gray in color. She reviewed the setbacks and surrounding viewshed. She reviewed comments and concerns received from citizens regarding the tower. She reviewed an email received from Mr. David Charles Campbell expressing concern regarding visual pollution to the viewshed if the tower is installed. Ms. Lindsey Ritter, Pyramid Network Services, LLC, stated the zoning ordinance requires that towers have potential for co- location. Mr. Peters inquired about the number of proposed mounts. Ms. Ritter discussed this issue stating a total of five antennas could be mounted on the proposed tower. Ms. Hooker inquired about the type of antenna proposed. Ms. Ritter stated flat panel antennas would be used. Mr. Thompson discussed the proposed type of tower and antennas, noting that the National Park Service has expressed concern regarding this issue. Ms. Hooker discussed the need for mitigation of park service concerns. Ms. Ritter discussed the impacts of different types of mounts. Ms. Micklow stated the park service has requested minimal viewshed obstruction, noting they will be sending written comments by the end of the week. Mr. Jarrell opened the public hearing for public comment. Mr. George Stevenson, 4021 Pebble Drive, expressed concern regarding radiation emission from the towers and devaluation of adjacent properties. Ms. Ritter stated they are required to comply with FCC regulations regarding radiation. She stated information regarding property values is inconclusive. With no other citizens requesting to speak, Mr. Jarrell closed the public hearing. Mr. Peters made a motion to recommend approval of the request with conditions including approval of regulations from the National Park Service. Mr. Thompson called the roll and the motion passed (5 -0) with the following vote: AYES: Hooker, Jarrell, McNeil, Peters, Radford NAYES: None ABSTAIN: None Final Orders 1. The proposed amendments to the Roanoke County Zoning Ordinance amendments relating to Large and Utility Wind Energy Systems would include Page 4 of 5 ROANOKE COUNTY PLANNING COMMISSION MINUTES October 4, 2011 amendments to Section 30 -29 "Use Types; Generally," Various Sections in Article III "District Regulations," and a new Section 30 -87 -7 "Wind Energy System, Large; and Wind Energy System, Utility" in Article IV. "Use and Design Standards" were approved by the Board of Supervisors at a Public Hearing on September 13, 2011. 2. The petition of Scott and Debbie George to rezone approximately 5.02 acres from R -1, Low Density Residential, District to AR, Agricultural /Residential, District, located at 4211 Harborwood Road, Catawba Magisterial District was approved by the Board of Supervisors at a Public Hearing on September 27, 2011. Citizen Comments Ms. Lisa Moran, 1811 Feather Road, spoke regarding being permitted to have chickens in non - agricultural areas. She stated she would like to have four or five chickens, which she would keep caged. Mr. Thompson stated the issue being discussed would require amending the zoning ordinance. Ms. Hooker thanked Ms. Moran for coming to the meeting. Mr. Jarrell noted it is a current trend. Ms. Moran noted chickens are quiet. She also noted dogs are not restricted to lot size. The commission encouraged her to attend the work session when chickens in non - agricultural areas will be discussed. With no other citizens requesting to speak, Mr. Jarrell closed the citizen comment period. Commissioners' and Staff Comments Mr. Thompson stated the Glenvar Community Plan and the Plantation Road Streetscape would be discussed at the October 18, 2011 Planning Commission Work Session.
