PUBLIC HEARING MINUTES
DECEMBER 5, 2011

Work Session:
Mr. Jarrell called the work session to order at 4:00 p.m.
Approval of Agenda
Mr. McNeil made a motion to approve the agenda, which passed 4 -0.
Approval of Minutes
Mr. Radford made a motion to approve the minutes of November 1, 2011, and
November 14, 2011, which passed 4 -0.
Discussion of Zoninq Amendments
Mr. Murphy provided a brief overview of the proposed Emergency Communications
Overlay. He introduced Mr. Rodney Thompson, Communications Coordinator. Mr.
Murphy reviewed the proposed text and reference maps revisions. He discussed both
digital and microwaveable sites, noting Roanoke County and Vinton may coordinate
some signals. He stated the jail system may use some different types of antennas all of
which will need protection. He explained 3- dimensional modeling will allow us to view
the coverage. He and Mr. Rodney Thompson discussed existing structures. Mr.
Murphy stated the newer technology will improve the ability for staff to review an area
for possible encroachment.

Mr. Radford inquired about various types of interference. Mr. Rodney Thompson stated
the overlay district will protect areas from possible interruption by prompting review of
coverage. Mr. McNeil inquired about existing Poor Mountain antennas. Mr. Murphy
discussed the locations of microwave paths to insure interference would not be an
issue. Mr. Philip Thompson stated construction requests received which would be
within the overlay area would prompt an evaluation request from COMMIT. Mr. Murphy
reviewed portions of the proposed text, noting changes would also be reviewed by
COMMIT. Mr. Philip Thompson discussed FAA regulations. Mr. Obenshain stated the
commission should not consider specific circumstances but the entire county's point of
view. Mr. Philip Thompson reviewed a proposed timetable, noting other information
may need to be considered as deemed necessary during application process. He
discussed that technology is advancing rapidly. Mr. Peters agreed this issue has
triggered the county to update this portion of the ordinance.
Mr. Radford made a motion to move forward with the development of the Emergency
Communications Overlay, which passed 5 -0.
Mr. Thompson and the commissioners discussed moving forward with additional
research regarding development of residential poultry regulations. The general
consensus was to continue moving forward regarding the development of the
regulations. The commissioners discussed minimum acreage requirements. They
discussed not allowing roosters due to noise issues. Mr. Thompson discussed poultry
regulations applicable in AR zoned areas. Mr. Thompson noted a special use permit
based on lot size and setbacks requirements could be incorporated into the ordinance.
Ms. Hooker suggested further researching regulations within other localities regarding
this issue. Commissioners agreed more research is necessary prior to additional
discussion regarding this ordinance.
Peters Creek/Hollins Community Plan Update
Mr. Patriarca provided a brief overview regarding Peters Creek/Hollins Community Plan,
including existing and proposed future land use maps. He discussed various core
areas. He discussed various proposed changes to transition areas to neighborhood
conservation. Ms. Hooker inquired why some transitional areas would be changing.
Mr. Patriarca some of the areas will be developing as apartments congruent with
neighborhoods. Mr. Thompson also stated transitional areas could later be increased to
higher intensity areas if they are sold and developed as commercial properties. He
stated it would offer more protection for the neighborhoods, keeping them in character
with the area. Mr. Patriarca stated some areas would be predominantly commercial
while other areas would be reduced from transitional in order to provide better
connectivity for North Lakes and other communities. He also reviewed other types of
spot zoning which will be revised, including Airport Road which has some large scale
commercial frontage. He discussed current development in the area including the
Stonelyn Cottage area. He stated some citizens have expressed the need to improve
the appearance of Greenway Drive. He stated Florist Road has a creek which provides
a natural barrier. He stated neighbors have suggested Charleston Estates being
protected by neighborhood conservation. He also discussed the Shadwell area being
both commercial and residential which borders Botetourt. Ms. Hooker expressed

concern regarding changing some areas from commercial zoning. Mr. Thompson and
Mr. Patriarca discussed requesting public input regarding this subject. Mr. Patriarca
also discussed development and topographical issue of Greenridge Road area.
2012 Planning Commission Meeting Dates
Mr. Thompson reviewed the Planning Commission meeting schedule for public hearing
and work sessions. Ms. Hooker suggested November and December work sessions
should be tentative instead of definitive. Ms. Hooker made a motion to approve the
2012 Planning Commission Meeting Schedule, which was approved 5 -0.
Commissioner and Staff Comments
The commissioners and staff discussed cancelling December 19, 2011, and January 3,
2012, meetings. Mr. Peters made a motion to approve the cancellation of these two
Planning Commission meetings, which was approved 5 -0.
Ms. Pattisall, Mr. Thompson, and the commissioners reviewed proposed changes which
had been made to the Glenn Reed site plan and the proffered conditions.
With no further comments, Mr. Jarrell adjourned the work session at 5:28 p.m.
EVENING SESSION
Mr. Jarrell called the Public Hearing to order at 7:00 p.m. Mr. McNeil gave the
invocation and led the pledge of allegiance.
1. The petition of Glenn L. Reed, to rezone 13.7 acres from AR,
Agricultural /Residential, District to AV, Agricultural/Village Center, District for
private /secondary educational facilities and general office use and to obtain a
special use permit in order to operate a convenience store, located in the 9600
block of Bent Mountain Road, Windsor Hills Magisterial District was postponed
from October 4, 2011, until December 5, 2011, by the petitioner. Ms. Pattisall
provided the staff report for the petition which included a brief history and review
of the petition including changes to the concept plan.
Mr. Radford inquired about the proffered conditions. Ms. Pattisall reviewed
proffered condition regarding substantial conformity to the site plan. Mr. Radford
inquired about dumpster location for the property. Ms. Pattisall stated this issue
would be determined by the zoning administrator during the site plan review
process.
Mr. Rodney Pierson, P.E., Pierson Engineering & Surveying, reviewed the
concept plan changes made by petitioner. Mr. Radford noted the changes were
more in agreement with citizen requests.
Mr. Jarrell opened the public hearing for public comment.
Mr. Jim Balsdon, 385 Sunny Ridge Road, Floyd, VA, stated he teaches at the
Christian Academy and a new school is needed. He noted a school would be
quiet for surrounding neighbors. He stated the convenience store and school

would be good for the area and an attractive addition by fitting into the natural
setting of the Bent Mountain Area.
Mr. Kevin Poff, 6699 Bent Mountain Road, stated he does not object to
convenience store but does not want a school to operate in near his property.
Mr. Dennis Humston, 11107 Rocky Road, stated the property will make acquiring
diesel fuel and food convenient for the area. He stated it would be an asset to the
area.
Mr. Larry Larsen, 9738 Bent Mountain, discussed public safety for proposed
entrance located near the fire house. He stated VDOT has agreed with entrance
location.
Mr. Val Bernice, 4202 Cordell Drive, expressed concern the area has not grown
enough to support the proposed store. He stated he and his partner own
convenience store near the proposed location but do not make enough income to
financially support themselves without additional retirement funds.
With no other citizens requesting to speak, Mr. Jarrell closed the public hearing.
Mr. Pierson stated the proposed entrance is the original entrance. He spoke
about the sight distance in both directions. He stated the school did not want to
use Tinsley Road which is a secondary road. He stated the road would not work
for the store.
Mr. Peters discussed the safety of the driveway of the school entering and exiting
onto Bent Mountain Road.
Mr. Radford inquired about the setbacks. Ms. Pattisall discussed various buffering
types and proposed changes from previous site plan.
Mr. McNeil stated the petitioners have done well to move things around to
appease the community. Ms. Hooker concurred. Mr. Jarrell inquired about the
number of prospective students. Ms. Pattisall stated currently approximately 20
students attend the school but they project approximately 100 students will attend
in the future. The petitioner noted they will need room to expand.
Mr. Radford made a motion to recommend approval of the rezoning and special
use permit with the following proffered condition:
1. The site shall be developed in substantial conformance with the site plan
prepared by Pierson Engineering and Surveying, dated November 28, 2011,
and the architectural renderings prepared by Interactive Design Group dated
July 18, 2011.
Mr. Thompson called the roll and the motion passed (5 -0) with the following vote:

Final Orders
1. The petition of Peter Lundy to obtain a Special Use Permit in a C -2, General
Commercial, District for the operation of a used automobile dealership on
0.665 acre, located at 3119 Brambleton Avenue, Windsor Hills Magisterial
District was approved by the Board of Supervisors at a Public Hearing on
November 15, 2011.
Citizen Comments
There were none.
Commissioners' and Staff Comments
Mr. Thompson provided invitations to the Planning Commissioners to attend the
Roanoke County Christmas luncheon on December 15, 2011.
He also reviewed the prospective timeline for the proposed adoption of the Glenvar
Community Plan, noting the Board of Supervisors Public Hearing is scheduled for
January 24, 2012.
With no further business or comments, Mr. Jarrell adjourned the meeting at 7:37 p.m.
