Approval of Minutes Mr. Mahoney made a motion to approve the minutes of March 7, 2017, which passed 3- 0-1, with Mr. James abstaining. Mr. Henderson made a motion to approve the minutes April 4, 2017, which passed 3-0- 1, with Mr. Mahoney abstaining. Mr. James made a motion to approve the minutes of April 18, 2017, which passed 3,-0- 1, with Mr. Mahoney abstaining, Consent Agenda There were no items for the consent agenda. Citizen Comments There were none. Page 1 of 9 ROANOKE COUNTY PLANNING COMMISSION MINUTES MAY 2, 2017 Commissioners' and Staff Comments Mr. Thompson and the Commissioners discussed the tentative timeline for the Draft 419 Town Center Plan. Mr. Thompson and the Commissioners discussed the agenda items for the Joint Roanoke City Planning Commission and Roanoke County Planning Commission meeting which will be held on May 5, 2017, at 12:00 noon, in the Noel C. Taylor Municipal Building, 215 Church Avenue. Mr. Thompson stated a community meeting regarding the Wood Haven Road Project will be held May 25, 2017, from 6:30 p.m. to 8:00 p.m, at the Holiday Inn Roanoke Airport, 3315 Ordway Drive. Mr. Thompson and the Commissioners discussed upcoming County events. Mr. Lubeck provided a status update regarding Triple J Farm Events, LLC litigation. Mr. Bower adjourned the meeting for dinner at 5:44 p.m. EVENING SESSION Mr. Bower called the Public Hearing to order at 7:01 p.m. He gave the invocation and led the pledge of allegiance. The petition of Lexington Falls, LLC to rezone approximately 1.67 acres to amend a proffered condition on property zoned C-2CS, High Intensity Commercial, District with conditions and special use permit and to rezone 0.68 acre from C-1, Low Intensity Commercial, District to C-2, High Intensity Commercial, District. The amended proffer references general conformance to a revised concept plan showing additional parking and a new access drive on Burlington Drive for an existing Bojangles restaurant. The property is located at 6065 Peters Creek Road and in the 6100 block of Burlington Drive, Hollins Magisterial District. Ms. Pattisall presented the staff report, including a brief history of the petition, future land use designation, and surrounding zoning. Mr. Stan Seymour discussed previous rezoning request. He discussed property access and parking issues. He provided a history of the property. He stated he would like additional access to the property to allow vehicles to exit at the traffic light. Mr. James inquired about the petitioner's request to rezone property to C-2. Mr. Seymour discussed this issue, noting he is planning ahead if there is future development in the area. Mr. Brian Blevins, VDOT, stated the current design meets standards, noting they may have future comments. Mr. Bower inquired if Burlington Road is wide enough for this change of use. Mr. Blevins and the Commissioners discussed road width and right-of-way requirements. Mr. James inquired about primary access issues. Mr. Blevins discussed sight distance at the primary entrance. Mr. James inquired about left-hand turning movement. Mr. Blevins discussed this issue. Dr. Verna Lewis, stated she owns property at 6149 Airport Road, noting that her office parking lot access is off of Burlington Drive. She stated extra traffic on this road will cause access problems for her patients. She stated she is concerned Burlington Drive may be used as a shortcut to other businesses. She stated she has safety concerns. Mr. Hunter Tolley, 6155 Burlington Drive, stated he purchased his home because the road is quiet. He stated he cleans up litter on the roadway 20.30 minutes per day. He stated he is concerned about additional stormwater runoff affecting the properties on Burlington Road. He stated he is worried motorists will use Burlington Road to avoid the traffic light. Mr. Daniel Mazur, 6143 Burlington Road, stated he has lived in his home thirty- two years. He stated the analysis of the traffic is inaccurate. He discussed safety concerns regarding increased cut-thru traffic. He stated people will cut- thru when traffic backs -up from the airport, noting they will be looking for shortcut. He discussed safety concerns regarding children playing outdoors. He also discussed safety concerns regarding the RADAR bus which backs out of Dr. Lewis' driveway. Ms. Susan Wooldridge, 6125 Burlington Drive, stated she has lived at her residence for twenty-seven years, noting her grandchildren ride their bicycles on the road. She stated she picks up trash along the roadside. She expressed concern regarding speeding. She stated the road is currently used as a back entrance for Gentle Shepherd Hospice. She stated the additional traffic will affect sleeping because they use her driveway to turn around, noting her mailbox has been knocked down three times. She stated her grandchildren play in the front yard, noting increased traffic will make it dangerous. She stated she was opposed to the request. Ms. Jozann Stevens, 6001 Peters Creek Road, stated she accesses her property from Burlington Road. She stated she takes care of her grandchildren at her house. She noted she had to replace her mailbox two times. She stated she is concerned about stormwater runoff issues. She stated they have blocked their driveway to keep vehicles from turning around in the driveway. She stated Mr. Seymour has not been a good steward of the property, noting that the tall grass is an eyesore. Ms. Amanda Herron, 6135 Burlington Drive, stated she bought her property because it was located on a dead-end road. She stated this use is not what the area needs, noting it does not reflect the family atmosphere of Burlington Drive. With no other citizens requesting to speak, Mr. Bower closed the public hearing. Mr. Woltz inquired about surrounding businesses and land use. Ms. Pattisall discussed the future land use designation and surrounding uses. Mr. Woltz Page 3 of 9 ROANOKE COUNTY PLANNING COMMISSION MINUTES MAY 2, 2017 inquired about compliance with Comprehensive Plan. Ms. Pattisall discussed the future land use designation. Mr. Bower inquired about potential development at the end of Burlington Drive. Ms. Pattisall discussed current zoning and by -right uses of the area, noting some of the current uses have been allowed by a special use permit. Ms. Pattisall and the Commissioners discussed the traffic analysis by Balzer and Associates, Inc. They discussed access to nearby properties. Mr. Thompson stated access for both of Mr. Seymour's properties would be from Peters Creek Road and Burlington Drive. Mr. Henderson inquired about traffic backing up on Airport Road. Ms. Pattisall discussed this issue. Mr. Bower inquired about the findings of the traffic impact analysis, including traffic counts from Bojangles and other areas. Mr. Ben Crew, Balzer and Associates, Inc., discussed the traffic impact analysis, including 2015 VDOT information. He discussed connectivity with the addition of access onto Burlington Drive. He noted VDOT has had an opportunity to review the proposed plan. Mr. Bower inquired about additional development in the area. Mr. Crew stated signals have been analyzed, noting an additional leg and additional turn lanes have been added to intersection. He discussed current traffic and growth due to new development. Mr. James inquired about the use of a trip generator. Mr. Crew stated they thought general office use is appropriate for the area, noting he does believe large retail would use the site. He reviewed zoning and uses of other nearby parcels. Mr. Woltz noted connectivity may improve traffic near the intersection. Mr. Bower inquired about stormwater management issues. Ms. Pattisall stated stormwater management requirements will be addressed during the site plan review process. Mr. Crew stated the petitioner will abide by County stormwater management regulations. Mr. Mahoney inquired about nearby commercial entrances and topography issues. Mr. Crew discussed the topography and viable access options for the property. Mr. Mahoney discussed safety concerns, noting Burlington Drive is a state road. He stated that existing traffic on Burlington Drive is not from Lexington Falls, LLC property but from other commercial properties which currently use Burlington Drive to access their businesses. He also noted the use is consistent with the Comprehensive Plan. He discussed having more than one access to the property for emergency services. Mr. Woltz stated the area is currently residential in a transition area, noting by -right uses of the property and surrounding properties. Mr. James discussed property access, by -right uses, and connectivity being a safety service. He reviewed the zoning of the area and inquired about reason C-2 was requested instead of C-1. Mr. Seymour stated he does not plan to develop the property as C-2, noting if nearby property is developed he wants to be prepared. Mr. Thompson discussed types of vehicles associated with this use and parking spaces on proffered site plan. Mr. Bower noted this area is beginning to commercialize. Mr. Bower made a motion to recommend approval of the request with the following amendment to proffered conditions and special use permit conditions: Page 4 of 9 ROANOKE COUNTY PLANNING COMMISSION MINUTES MAY 2, 2017 Amendment to Proffered Condition: The developer hereby proffers general conformance with the "Lexington Falls, LLC -Access Drive", prepared by Balzer and Associates, Inc. dated March 17, 2017. Special Use Permit Conditions (to remain unchanged on 6065 Peters Creek Road): 1. A monument -style sign shall be constructed measuring no greater than 5 - feet tall and 7 -feet wide. The sign face shall be surrounded by brick to match the building and shall include architectural features such as pre -cast concrete cap and base. 2. Signage placed on the building shall occupy less than 5 percent of the building facade area. 3. Off -premises signs shall be prohibited. 4. The building shall be constructed in a style substantially conforming to Exhibit B, an accepted proffered exterior from the approved November 2005 Seaside Heights, LLC rezoning and special use permit for a Bojangles drive- in restaurant (case numbers 32-12/2004 and 33-1212004), except that from grade to eave, all walls shall be constructed with at least two colors of red or brown brick instead of white brick. 5. Additional landscaping shall be provided. In particular, the dumpster enclosure shall be screened by tree and shrub plantings, additional trees shall be planted in the parking lot, a perimeter planting bed shall be designed in front of the parking spaces facing Peters Creek Road, additional landscaping shall be planted around the picnic area to further delineate it as a site feature, and all plants used shall conform to the Plant Palette listed in the Williamson Road Hollins Village Design Guidelines. 6. Light poles shall be black, gray, or grayish -brown. Light fixtures shall be directed downward and inward to the site, shall be no taller than 15 feet in height, and shall not be cobra --head or shoebox-style fixtures. 7. Decorative building lighting shall be used and fixtures shall be recessed wherever possible. The picnic area shall be moved northward away from the dumpster. A crosswalk shall be constructed to lead customers from the nearest building entrance across the parking lot and an identifiable path shall continue from the parking lot to the picnic area. 9. The sides and rear of the dumpster enclosure shall be brick construction to match the building. Mr. Thompson called the roll and the motion passed (5-0) with the following vote: AYES: Bower, Henderson, James, Mahoney, Woltz NAYES: None ABSTAIN: None 2. Proposed amendments to the Roanoke County Zoning Ordinance. The proposed amendments would make the following changes to Article III (District Regulations): delete sections 30-47-7(D), 30-47-8(A), 30-57-8(D), 30-57-9(A), 30-63-8(D), and 30-63-9(A) dealing with the approval of preliminary and final site development plans and the failure to begin development within PRD (Planned Residential Development), PCD (Planned Commercial Development), and PTD (Planned Technology Development) Districts, and to allow guidance services as a by -right use in the 1-1, Low Intensity Industrial, District, and 1-2, High Intensity Industrial, District. Mr. Murphy reviewed each of the proposed amendments regarding planned districts and adding guidance services in industrial districts. Mr. Mahoney inquired about the definition of guidance services. Mr. Murphy provided the definition, stating it would be similar to medical office. He stated it would be strictly outpatient services. Mr. Bower opened the public hearing for public comment. With no citizens requesting to speak, Mr. Bower closed the public hearing. Mr. Mahoney made a motion to recommend approval of the Zoning Ordinance amendments: Mr. Thompson called the roll and the motion passed (5-0) with the following vote: AYES: Bower, Henderson, James, Mahoney, Woltz NAYES: None ABSTAIN: None 3. A proposed amendment to the Roanoke County Comprehensive Plan. The proposed amendment would incorporate the 419 Town Center Plan into the Roanoke County Comprehensive Plan. Mr. Thompson provided an overview of the draft plan, including the process, vision, market analysis, design and transportation guiding principles. He discussed public outreach, including Page 6 of 9 ROANOKE COUNTY PLANNING COMMISSION MINUTES MAY 2, 2097 community outreach and workshops. He reviewed the Planning Process, noting the town center market would be a residential, walkable community which would procure higher premium rent and retain market for retail. He reviewed the Vision Statement, including the plan design principles. He discussed creating an authentic place, secure and sustain healthy future, and improve connectivity. He discussed guiding principles and objectives, including focusing on the intersections and compliance with American Disabilities Act (ADA). He reviewed draft concept design and objectives, including traffic design to move more traffic, intersection treatments, and transit integration. He discussed the public realm, including creating new public gathering spaces, streetscape amenities, improving lighting, and introducing stronger landscape standards. Mr. Thompson reviewed redevelopment priorities, including the Core Town Center and the Ridges. He also discussed catalyst development sites which are prime sites for redevelopment, including Old Country Plaza, Madison Square, and Tanglewood Mall. He discussed the implementation process, including plan approval, land use and zoning updates, land owner engagement, developer attraction, and infrastructure investments. He reviewed the next steps, including the June 6, 2017 Board of Supervisors and Planning Commission Joint Work Session at 5:00 p.m. Mr. Mahoney inquired about landscaping plan, enforcement of standards, and development of an urban design advisory committee. Mr. Thompson discussed these issues, noting the plan is currently in draft form. Mr. Mahoney stated he does not want to mislead the public. He inquired about the width of bicycle and pedestrian lanes. Mr. Thompson discussed the path dimensions and use. He stated the plan consists of concepts which would be developed gradually. Mr. Mahoney discussed the importance of being realistic with the plan. He discussed promising too many amenities to the public. Mr. James discussed prioritizing development. Mr. Woltz discussed acquiring additional funding from developers to construct trails. He noted the plan gives the County a plan and flexibility to redevelop the area. Mr. Thompson stated the plan would become the area plan. He stated the County needs to look at other corridors and introduce new concepts, noting the plan is a guide book with available options. Mr. Mahoney stated both vision and prioritization are important. Mr. Henderson stated the draft has had significant response from developers. Mr. Thompson affirmed there is enthusiasm from property owners and developers. Break from 8:56 p.m. --- 9:01 p.m. Mr. Bower opened the public hearing for public comment. Ms. Marguerite Underwood, 5348 Ryan Lane, stated she represents animal families. She provided a PowerPoint presentation regarding the importance of incorporating pet -friendly accommodations and businesses. She stated 47% of homes within a one mile radius of the plan have pets. She discussed having a walking path and pet area, including incorporating a code of conduct and adding water fountains. Page 7 of 9 ROANOKE COUNTY PLANNING COMMISSION MINUTES MAY 2, 2017 Mr. Herbert Goldstein, 3777 Forest Court, stated he operates a business at Tanglewood Mall, noting it is a good building. He stated the mall is used for walking purposes and is safe and well lit. He stated small businesses will be different, noting he does not want the development to be rushed. He discussed private and public uses in the plan, noting private use can require certain rules. He inquired about acquiring another anchor store when the J. C. Penney space is vacant at the mail. Ms. Joyce Waugh, Roanoke Regional Chamber of Commerce, stated the plan represents economic development and opportunities for others. She stated it is a guide for the future. She stated she supports the concept and direction of the plan. Mr. Taylor Stone, 4086 Bluebird Lane, stated he is impressed by the plan. He discussed the importance of aiming higher. He thanked Mr. Thompson for his hard work on the plan. With no other citizens requesting to speak, Mr. Bower closed the public hearing. Mr. Bawer invited the public to continue submitting written comments to staff. Mr. Waltz discussed public and private use areas. He stated some of the stores are still bound by lease agreements. He thanked Ms. Underwood for her presentation. He stated the pet --friendly atmosphere is a good idea, noting some issues regarding pets are regulated by the Health Department. Mr. James stated he appreciates the public's involvement in the plan. He stated we can create a vision in which to invest with the plan. Mr. Henderson stated the plan is great first step without taking away greenspace. He discussed the incorporation of mixed-use development. Mr. Thompson stated the plan has been a team effort between the Community Development Department, Economic Development Department, and the consultant. He stated the public can still submit written comments to staff. Mr. Bower stated the Board of Supervisors and Planning Commission Joint Work Session will be held June 6, 2017, beginning at 5:00 p.m. Citizens' Comments There were none. Comments of Planning Commissioners and Planning Staff Mr. Thompson stated Mr. Tori Williams will be leaving the Planning Department to pursue his career in another area. Final Orders There were none.
