HomeMy WebLinkAbout3/6/2018 - MinutesCommissioners Present: Mr. Wayne Bower Mr. Rick James Mr. Troy Henderson Commissioners Absent: Mr. Paul Mahoney 91=111111TIT101 MARCH 6,2018 Staff Present: Mr. Philip Thompson Mr. Peter Lubeck, Senior Assistant County Attorney Ms. 'Tara Pattisall Ms. Susan McCoy, Recording Secretary Call to Order Mr. James called the Public Hearing to order at 7:01 p.m. Mr. Bower gave the invocation and led the pledge of allegiance. Approval of Agenda Mr. Bower made a motion to approve the agenda, which passed 3-0. Public Hearing 1. The petition of Diana England to obtain a Special Use Permit in a R-1, Low Density Residential, District for a multiple dog permit for seven (7) dogs on 1.18 acres, located at 4579 Layman Road, Vinton Magisterial District, Ms. Pattisall presented the staff report, including a brief history, topography, zoning, and future land use designation. Mr. Bower inquired about the comments from neighbors., Ms. Pattisall stated all direct neighbors and the veterinarian for the dogs have written letters in, support of the request. Ms. Diana England stated all of the dogs are rescued dogs, noting they do not breed them. Mr. Art England stated they are not getting additional dogs. Ms. England stated they want to keep the dogs they currently have and not get any additional dogs. Mr. James inquired about how the petitioners acquired the rescued dogs. Ms. England discussed this issue, noting they acquired the first rescued dog six years ago. She stated she previously worked for Dominion Veterinary Office, noting she and her husband fostered the dogs. She stated when they were unable to find homes for the dogs, they ended up keeping them. She stated all of the dogs have been neutered except the two younger dogs which will be neutered soon. Mr. James noted that the letters of support are very good. He stated he has made two visits to the site, noting he has not heard the Page 1 of 3 ROANOKE COUNTY PLANNING COMMISSION MINUTES MARCH 6, 2018 dogs barking either time. Ms. England stated the dogs receive good care at their home. Mr. Bower stated his only concern is that if they approve the request what will be allowed next. He stated the staff conclusion notes indicate there have not been any issues and they have been good neighbors. Mr. James discussed the responsible and respectful manner of the petitioners' operation. He stated the neighbors have written letters of support that the petitioners have operated responsibly and without nuisance. He stated the circumstances are unique and he is respectful of that. Mr. James opened the public hearing for public comment. With no citizens requesting to speak, Mr. James closed the public hearing. Mr. James made a motion to recommend approval of the petition with the following condition: 1. The maximum number of dogs shall be limited to seven. Mr. Thompson called the roll and the motion passed (3-0) with the following vote: AYES: Bower, Henderson, James, NAYES: None ABSTAIN: None Ms. England stated she is concerned Roanoke County Animal Control will revisit their residence. Mr. Thompson, Ms. Pattisall, and the petitioners discussed this issue, noting staff will contact animal control regarding the status of the special use permit process. Citizen Comments There were none. Commissioners' and Staff Comments Mr. Thompson and the Commissioners discussed the March 3, 2018 Hollins Center Planning Study Community Meeting. Mr. Thompson stated approximately forty people attended, noting it was a favorable result with people sharing ideas. He stated another Hollins Center Planning Study Community Meeting will be held on March 8, 2018, at the Hollins Library from 4:00 p.m. — 7:00 p.m. He stated approximately 220 people have taken the Hollins survey and over 400 have taken the Oak Grove survey. Mr. Thompson and the Commissioners discussed participation of residents and stakeholders, noting statistics have not yet been calculated. Mr. Thompson stated they will continue to have stakeholder meetings, noting staff will be scheduling meetings with the Commissioners. He stated they are working with the County schools and building a positive relationship. He stated they are hoping to incorporate planning educational tasks into the school curriculum. He stated staff is being comprehensive in acquiring viewpoints. Page 2of3 ROANOKE COUNTY PLANNING COMMISSION MINUTES MARCH 6, 2018 Mr. Thompson stated VDOT will be holding a Route 3111419 Design Public Hearing on March 29, 2018, at the Roanoke Valley Regional Fire/EMS Training Center, 1220 Kessler Mill Road, from 4:30 p.m. — 6:30 p.m. Mr. Thompson discussed other upcoming County meetings and events. Mr. Lubeck provided a status update regarding Triple J Farm Events, LLC litigation.
