HomeMy WebLinkAbout6/5/2018 - Minutese"mt* af jqoww& PLANNING COMMISSION 18313 PUBLIC HEARING MINUTES JUNE 5,2018 Commissioners Present: Mr. Wayne Bower Mr. Rick James Mr. Paul Mahoney Commissioners Absent: Mr. Troy Henderson Mr. Jim Woltz P��13 Mr. Philip Thompson, Secretary Mr. Peter Lubeck, Senior Assistant County Attorney Ms. Becky James Ms. Tara Pattisall Ms. Bailey DuBois Ms, Cecile Newcomb Ms. Susan McCoy, Recording Secretary Work Session Mr. Mahoney called the meeting to order at 4:02 p.m. Approval of Agenda Mr. James made a motion to approve the agenda, which passed 3-0. Approval of Minutes Mr. Bower made a motion to approve the minutes of May 1, 2018, and May 15, 2018, which passed 3-0. Consent Agenda Ms. James provided an overview of the, petition of Laurel Crest, LLC, including the concept plan, zoning, and future land use designation. Ms. James noted there is, an existing house on one of the parcels., Ms. James and the Commissioners discussed the proffered conditions. The Laurel Crest, LLC Community Meeting will be held on Wednesday, June 13, 2018, at the Roanoke County Administration Center, beginning at 6:30, p.m. Mr. Thompson provided an overview of the petition of Western Virginia Regional Industrial Facility Authority (WVRIFA) and Lewis Living Trust, including a brief history and proposed use of the property. Mr. Thompson and the Commissioners discussed the traffic impact analysis (TIA) which was submitted with the petition, 'includingi the proposed traffic flow. They discussed the proposed Planned Technology Development (PTD) District and the permitted uses. Mr. Thompson, noted three jurisdictions are involved in this development, ROANOKE COUNTY PLANNING COMMISSION MINUTES JUNE 5, 2098 including the City of Roanoke, City of Salem, and Roanoke County. Mr. Thompson stated the WVRIFA Community Meeting will be held in the Northside High School Auditorium at 6:30 p.m. on Wednesday, June 27, 2018. Mr. James made a motion to approve the consent agenda, which passed 3-0 Citizen Comments There were none. Commissioners' and Staff Comments There were none. Mr. Mahoney adjourned the meeting for site viewing and dinner at 4:23 p.m. EVENING SESSION Mr. Mahoney called the Public Hearing to order at 7:04 p.m. He gave the invocation and led the pledge of allegiance. The petition of Virginia Varsity Storage, Inc. to rezone approximately 2.1256 acres from C -2C, High Intensity Commercial, District with conditions to 1-1, Low Intensity Industrial, District, to remove proffered conditions, and to obtain a special use permit for a mini -warehouse facility, located at 5881 Starkey Road, Cave Spring Magisterial District. Ms. Pattisall presented the staff report, including zoning, future land use designation, current and proposed use of the property, and concept plan. Mr. John Lugar, President, Virginia Varsity Storage, Inc., introduced Ms. Andrea Minnick, General Manager, and Mr. Andrew Lumsden, Engineer. Mr. Lugar provided a PowerPoint presentation, including a brief history of the business, aerial photo of the property, and photos of the company's other properties. He discussed landscaping, lighting, and fencing. He stated a flood study was completed, noting they tried to be mindful of flooding situations. Mr. James discussed his concern regarding encroachment into the floodplain. Mr. Lumsden discussed the survey of the floodplain. He discussed the current and proposed use of the property. He stated they found minor water surface issues. He discussed the underground stormwater facility. Mr. Mahoney inquired about the floodway and floodplain within the fill area. Mr. Lumsden stated no fill material will be used within the floodway. Mr. Thompson, Ms. Pattisall, Mr. Lumsden, and the Commissioners reviewed the floodplain map and concept plan. Mr. Thompson reviewed issues which would be addressed during the site plan review process. Mr. Mahoney inquired about the construction timeline. Mr. Lugar stated if the petition is approved they plan to begin construction this fall. Mr. Bower inquired about the remainder of the property. Mr. Thompson discussed fill issues and topography issues of the property. Mr. Mahoney inquired about recent flooding in the area. Mr. Lugar discussed this issue, noting he viewed the area during the recent flooding and the water was low and did not come out of its banks near this property. He stated there would not be much useable land left on which to build any additional buildings after the proposed structures are constructed. Page 2of5 ROANOKE COUNTY PLANNING COMMISSION MINUTES JUNE 5, 2418 Mr. Mahoney made a motion to recommend approval of the rezoning request and special use permit with the following condition: 1. The site shall be developed in general conformance with the concept plan titled "Rezoning and Special Use Permit Conceptual Plan" prepared by Lumsden Associates, P.C. and dated April 4, 2018, Mr. Thompson called the roll and the motion passed (3-0) with the following vote: AYES: Bower, James, Mahoney NAYES: None ABSTAIN: None Mr. Thompson stated the Board of Supervisors Public Hearing regarding this petition will be held on Thursday, June 28, 2018. 2. Proposed amendments to the Roanoke County Zoning Ordinance dealing with agritourism activities and on a resolution regarding the zoning administrator's review of agritourism activities. The proposed amendments would: add definitions for agritourism, farm brewery, farm distillery, and farm winery in Article II (Definitions and Use Types); add agritourism, farm brewery, farm distillery, and farm winery as permitted by right uses in the AG -3 Agricultural/Rural Preserve District, AG -1 Agricultural/Rural Low Density District, AR Agricultural/Residential District, and AV Agricultural/Village Center District in Article III (District Regulations); add use and design standards for agritourism, farm brewery, farm distillery, and farm winery, and amend use and design standards for special events facility in Article IV (Use and Design Standards); and add minimum parking required standards for agritourism, farm brewery, farm distillery, and farm winery, and amend the parking area surface standards for agricultural and forestry use types in Article V (Development Standards). The proposed resolution would provide guidance to the Zoning Administrator when reviewing and determining agritourism activities. Mr. Thompson presented the staff report, including an overview of the proposed amendments. He discussed types of events and use and design standards. He discussed adding a noise provision. He discussed parking standards, noting there would be no paved surface requirement for parking in agricultural zoning. He discussed the resolution which was prepared by Mr. Lubeck. He discussed determination of substantial impact, noting a special use permit would be required if the use is determined to have a substantial impact. He noted the use would be by -right if it is not a substantial impact. He recommended the Commissioners include the resolution with the public hearing. Mr. Thompson discussed the email which was received from Mr. Scott Crandall, regarding allowing agritourism in an AR zoning district with approximately 30 acres. Mr. Crandall stated it would be beneficial to the area. He suggested restricting agritourism in AR zoning by having acreage requirements for special Page 3 of 5 ROANOKE COUNTY PLANNING COMMISSION MINUTES JUNE 5, 2098 events facility. Mr. Thompson and the Commissioners discussed the acreage requirement. Mr. Thompson discussed options regarding this issue, noting the current proposed amendments were advertised without the inclusion of AR zoning. The consensus of the Commission was to have public hearing based on the current advertised agritourism amendment which they have developed. Mr. Mahoney noted many of the AR lots are small acreage lots which are more susceptible to substantial impact issues. Mr. Thompson stated they can discuss allowing agritourism in AR at a future work session when other amendments are being discussed. Mr. Thompson noted Mr. Crandall has the option to rezone his property, noting the property is near AG -3 zoned property. Mr. Mahoney opened the public hearing for public comment. With no citizens requesting to speak, Mr. Mahoney closed the public hearing. Mr. James made a motion to recommend approval of the Zoning Amendments (Agritourism) as presented. Mr. Thompson called the roll and the motion passed (3-0) with the following vote: AYES: Bower, James, Mahoney NAYES: None ABSTAIN: None Mr. Bower made a motion to recommend approval of the resolution as presented. Mr. Thompson called the roll and the motion passed (3-0) with the fallowing vote: AYES: Bower, James, Mahoney NAYES: None ABSTAIN: None Mr. Mahoney made a motion to make a recommendation to the Board of Supervisors to revisit the noise ordinance regarding agritourism. The motion passed 3-0. Citizens' Comments There were none. Comments of Planning Commissioners and Planning Staff Mr. James stated he had spoken with Ms. Sabrina Garvin, petitioner for Southwest Virginia Wildlife Center of Roanoke, regarding her petition. Mr. Thompson and the Commissioners discussed the agenda for the June 19, 2018 Roanoke County/Roanoke City Planning Commissions Work Session. They discussed the Oak Grove Center Plan area and common interests for the two jurisdictions. Page 4 of 5 ROANOKE COUNTY PLANNING COMMISSION MINUTES JUNE 5, 2018 Mr. Thompson, staff, and the Commissioners discussed input received at the community meetings and surveys regarding the Oak Grove area. Mr. Thompson discussed the status of the Zoning Ordinance Amendments (Signs). He stated information will be forwarded to the sign companies, realtors, and stakeholders for input regarding the proposed amendments. Mr. Thompson and the Commissioners discussed the non -conforming lots of record, including the public road frontage requirement for uses permitted in AR zoning. The consensus of the Commission was to leave this portion of the.ordinance as it currently is. Mr. Thompson discussed departmental fee changes, noting as of July 1, 2018, the special use permit fee will be $150.00 and the zoning verification fee will be $50.00.
