Approval of Agenda Mr. James made a motion to approve the agenda, which passed 5-0, Approval of Minutes Mr, Mahoney made a motion to approve the February 5, 2019 minutes, which passed 5- 0. Mr. Mahoney made a motion to approve the March 5, 2019 minutes, which passed 3-0- 2, with Mr. Henderson and Mr. Woltz abstaining. Approval of Consent Agenda There were no consent agenda items. Public Hearing 1. The petition of SRW Squared LLC (dba Wolf's Den Billiards) to obtain a Special Use Permit in a C-2, High Intensity Commercial, District to operate a commercial indoor amusement facility on 3.98 acres, located at 4820 Hollins Road, Hollins Magisterial District. Ms. James presented the staff report, including brief history of the property, zoning, signage, and future land use designation. Mr. James inquired if any complaints had been receive regarding the business. Ms. James stated she has not received any complaints regarding this use. She stated building plans were approved February 26, 2019. 'ter_ �,, . ROANOKE COUNTY PLANNING COMMISSION MINUTES MAY 7, 2019 Mr. Kory Wolford stated they have had several tournaments with participants from other states. He stated they have traveled internationally to participate in tournaments. Mr. Woltz inquired about the type of pool tables. Mr. Wolford discussed the type of pool tables used. He stated they currently have twenty-one teams playing, noting they want to present a program to the local school boards to set up school teams. Ms. Trena Wolford discussed national tournaments, noting some schools have teams which compete at these tournaments. She stated her son and daughter compete in tournaments. She staffed her son has competed in both national and international tournaments and her daughter qualified for the junior national tournament. Mr. Bower inquired about other properties owned by the petitioners. Mr. Wolford stated they own Papa D's Restaurant. Mr. James inquired about space needed for this use. Mr. Wolford stated the building will meet their needs for many years. Mr. Henderson opened the public hearing for public comment. With no citizens requesting to speak, Mr. Henderson closed the public hearing. Mr. Bower stated he has been in the building, noting it was clean, quiet, and has a great atmosphere. He stated when he has driven by the property no one was gathering in the parking lot. Mr. Bower made a motion to recommend approval of the request. Mr. Thompson called the roll and the motion passed (5-0) with the following vote: AYES: Bower, James, Henderson, Mahoney, Woltz NAYES: None ABSTAIN: None Mr. Thompson stated the Board of Supervisors Public Hearing regarding this petition will be held on Tuesday, May 28, 2019. 2. The petition of Lindor Development, LLC to rezone approximately 14.90 acres from C-1, Low Intensity Commercial, District to 1-1, Low Intensity Industrial, District for a truck terminal, located near the 5100 block of Hollins Road near its intersection with Lois Lane, Hollins Magisterial District. Ms. Newcomb provided the staff report and PowerPoint presentation. She discussed zoning, future land use designation, floodplain, and concept plan. She provided a history of the property, noting the property was rezoned from industrial to commercial in 2002 for a church which was never built. Mr. James inquired about landscaping buffers. Mr. Thompson discussed use and design standards and buffering requirements. Mr. Ben Crew, Balzer and Associates, Inc., introduced Mr. Thierry Lindor, Lindor Development, LLC. Mr. Crew stated this area is currently a corridor for the operation. He stated the petitioner currently leases property in adjacent localities. He reviewed the concept plan, including shop facility. He noted the petitioner wants to locate his business in Roanoke County. He stated consideration has been given to the residential properties by using extensive landscape buffers. Mr. Lindor provided a history of the company, noting the company started in Milton, Pennsylvania. He stated they want to create a terminal to maintain equipment with office facility. He stated the proposed facility will be similar to the Milton, Pennsylvania facility. Mr. James inquired about employment. Mr. Lindor discussed this issue, noting they would employee approximately thirty to fifty employees immediately and expand the business to sixty to seventy employees including drivers. Mr. James inquired about types of trucking operation. Mr. Lindor stated the trucks will operate as a relay with their cargo trailers. Mr. Woltz inquired about the number of trucks. Mr. Lindor discussed this issue, noting they have approximately 400 trucks. Mr. Bower inquired about building maintenance. Mr. Lindor discussed this issue, noting they will have a dispatch office. He stated they will be doing inspections at this location, noting they are currently outsourcing mechanical work. Mr. James inquired about the petitioner currently running trucks from Ardaugh Group. Mr. Lindor discussed this issue, stating trucks are already running to the Ardaugh Group property. Mr. Crew discussed traffic on Hollins Road. He reviewed the current trip generation statistics, projected trip generation, and traffic flow. Mr. James inquired about VDOT regulations. Mr. Crew stated VDOT will review and advise them during the site plan review process. Mr. Mahoney inquired about warrants and requirements regarding turn lanes. Mr. Crew discussed the volume of traffic on Hollins Road and number of additional trips needed to warrant a turn lane. Mr. Mahoney inquired about the concept plan and topography of the site. Mr. Crew discussed the topography and concept plan, including access to the property. Mr. Bower inquired about reason the property entrance was moved on the concept plan. Mr. Crew discussed these issues, noting the entrance was moved to increase distance from adjoining residential area and increase distance from adjoining roads. He stated the new access is the least steep portion as you enter the property. He noted they are not sharing an access with Ardaugh Group property. He stated they have no plans at this time to connect property access with Ardaugh Group property. Mr. Lindor stated two access points would have been ideal, noting they tried to stay as far away from the residential area as possible. Mr. Bower inquired about parking spaces. Mr. Crew discussed traffic data and the trip generation standards from the Institute of Transportation Engineers (ITE) manual. Mr. Lindor discussed parking for tractors and trailers. He stated they plan to have fifty-eight parking spaces maximum to accommodate future growth of the company. Mr. James inquired if ITE standards match up to the proposed business. Mr. Lindor stated the ITE standards do match up to his business. Mr. Henderson opened the public hearing for public comment. Ms. Kathy Martin, 1309 Beaumont Road, stated refueling has not been mentioned in the presentation. She stated the business would be detrimental to the neighborhood and the environment. She stated the area is primarily residential with four homes adjacent to the petitioner's property. She stated approximately forty-eight homes are on Hollins Road. She stated approximately ninety-three Page 3 of 9 ROANOKE COUNTY PLANNING COMMISSION MINUTES MAY 7, 2019 homes would be negatively impacted. She discussed safety concerns when exiting the residential driveways with increased traffic. She discussed increased noise with the business operating twenty-four hours per day and seven days a week. She discussed her concern regarding diesel fuel affecting air quality, sediment from the diesel fuel on houses, devaluing of homes, and adversely affecting construction of new homes. She discussed safety concerns regarding cyclists and walkers since there is no shoulder on the roadside. She stated youth soccer games and practices are held in nearby Hollins Park. She stated the walking track is used by numerous people, noting entering and exiting the park will become an issue with increased traffic. She discussed environmental impacts including toxic runoff into Tinker Creek. She stated there is no information regarding what the trucks will be transporting. She stated that other areas away from primary residential areas are available to locate this type of business. She asked for her peaceful neighborhood not to be destroyed. She requested that the petition be denied. Ms. Valerie Stephens, 7015 Brookview Road, stated the terminal will be open 2417 in a residential area. She discussed her concern regarding issues with Tinker Creek, traffic, noise, leakage of gasoline, well water quality, stormwater runoff, and flooding. She stated the neighborhood has been in existence for many years and land has passed through many generations. She stated the request will degrade property and ruin a creek famous from a Pulitzer Prize winning book. She discussed a previous chemical spill into Tinker Creek, noting there still are no fish in the creek. She discussed her concern there are no zoning regulations protecting the creek. She discussed increased truck traffic, expressing concern regarding road damage, noise, air pollution, water pollution, and decreased property values. She requested the petition be denied. She requested leaving the property C-1 and finding a different use for the property. Ms. Karen Noell, 5215 Lois Lane, stated she has lived in her home forty-nine years. She stated the pond on Shadwell Drive will flood when it rains and the water runs across the road. She discussed trucks turning onto Hollins Road will run into school buses. She stated there are no sidewalks for children waiting for the bus. She discussed concerns regarding the large volume of traffic currently on Hollins Road. She stated when an accident occurs on 1-81 traffic is detoured onto Hollins Road. She discussed concerns regarding chemicals from the business affecting water wells. Mr. Robert Bowers, 5249 Lois Lane, stated he understands economic development but there are better places for the proposed business. He suggested using a nearby vacant facility which could be refurbished. He stated the proposed terminal would be detrimental to the area, including decreased property values and increased noise. He requested that the petition not be approved. Mr. Robert Hale, 1360 Carlos Drive, stated he agrees with other comments. He stated he travels and some areas have good zoning and others do not. He stated his community is mostly residential. He stated he wishes there was a masterplan Page 4 of 9 ROANOKE COUNTY PLANNING COMMISSION MINUTES MAY 7, 2019 for the area. He stated there is no consistency of zoning in his area. He stated there are more suitable sites for this company. Ms. Elaine Hale, 1360 Carlos Drive, stated access to her property is across the road from the proposed site. She stated there are forty-eight residences along Hollins Road. She stated there are two churches, four apartment complexes, and three fairly new subdivisions near this site. She stated they are very opposed to the rezoning. She stated Hollins Road is a major school route, noting the area is very congested. She asked the Commission to put themselves in the citizens' position. She discussed a previous chemical spill, noting she is concerned about water wells. She stated there are other properties available for this use. She stated industrial sites should be grouped together and not be in residential neighborhoods. She stated the large fuel tanks are scary and could pose chemical runoff or leaks. Ms. Mary Ellen Sullivan, 6535 Trevilian Road, stated she is concerned about litter coming from the trucking company, noting litter can build up. She stated the Plantation Road and Hollins Road intersection is dangerous, noting there are several accidents at this location every year. She stated currently trucks coming out of Ardaugh Group go up Plantation Road and cannot climb hill toward Hershberger Road which delays traffic. She stated she is concerned about the truck fumes causing major pollution problems. Mr. James W. Dalton, Jr., 1348 Carlos Drive, stated he is opposed to the petition. He stated that he worked at a trucking terminal. He stated he is concerned about noise, noting the trucks are left running and create constant noise. He stated the buffer will not stop the noise. He stated he lives across from the proposed site. He asked that the neighborhood be kept residential and not industrial. He stated the buffer will not prevent the property values from going down. He requested the Commissioners vote no on the proposed request. Ms. Elizabeth Bowers, 5249 Lois Lane, stated there is already noise and lights which shine into our windows at night which is disruptive. She stated this use would add to current issues and create an even more disruptive environment. She stated Hollins Road was not built for a trucking terminal, noting it was built for going to and from the City from the residential neighborhood. She stated if the request is approved, she is unsure she would want to live there anymore. She stated she is concerned about this proposed request, noting the terminal will be operating twenty-four hours a day and seven days a weeks. Mr. Carlos Resende, 1324 Carlos Drive, stated he was concerned about the impact the terminal will have on wildlife, noting a lot of wildlife is in the area. He stated traffic will increase and affect everything including Tinker Creek. Ms. Barbara Montrose stated she works at 5240 Hollins Road. She stated Hollins Road is has already been widened and is not very wide. She stated a few businesses are located on this road, noting they are quiet businesses. She asked Page 5 of 9 ROANOKE COUNTY PLANNING COMMISSION MINUTES MAY 7, 2019 not to spoil the neighborhood or overall environment with a use which would be more appropriate elsewhere. Ms. Rhonda Bowers, 5249 Lois Lane, stated she is a mother of five children. She stated she could let kids go outside and play. She stated that truckers pick-up hitchhikers, noting the residents do not know who they are bringing into the neighborhood. She discussed safety issues and concerns regarding fuel. She discussed wanting to protect the children. She stated there is a better location for this use. With no other citizens requesting to speak, Mr. Henderson closed the public hearing. Mr. James inquired about types of hauling which will be performed. Mr. Lindor stated no hazmat materials will be carried in trailers at this location. He stated the facility will have fuel and trench drains so nothing will run into public water system. He stated they will also have an oil -water separator. Mr. Crew stated there will be additional traffic but the majority of trucks are already in the area. He staffed the stormwater management plan meets State regulations. He stated they have moved the development plans as far from the creek and property lines as possible. He stated the ordinance governs littering offenses. He stated the company has a business reputation to maintain. Mr. Lindor discussed concerns regarding the safety of school buses. He stated all trucks have cameras, cell phone blocking devices for apps and texting in order to prevent accidents. He stated they do not promote picking up hitchhikers, noting the company could see if this occurs because of the cameras which are in the trucks. He discussed the fuel at the terminal, noting it would be an above ground tanks so it could be visually checked and inspected. Mr. Bower inquired about the traffic impact analysis (TIA) and congestion. He noted air pollution is covered by Federal regulations. Mr. Lindor discussed idle times and emission requirements. Mr. Bower inquired about refueling station being near Tinker Creek. Mr. Crew stated part of the process requirements will be to acquire a permit by meeting all guidelines and regulations. He stated all documents and details will be provided during the County's review process. He stated the refueling station will be contained with an adequate protection and safety plan including inspections. Mr. Bower inquired about the number of truck trips day and night. Mr. Lindor stated the trucks usually operate off peak hours depending on the schedules of the nearby manufacturing company, Ardaugh Group. Mr. Crew discussed peak hours of operation. Mr. Lindor discussed the difficulty of determining traffic peaks with manufacturing companies. Mr. Bower inquired about available properties on Plantation Road. Mr. Lindor discussed the vacant sites, noting they are trying to find a site for maintenance shops. He stated those sites are not large enough for their type of operation. Mr. Bower inquired about hazardous chemicals affecting wells from grates and spills. Mr. Lindor described the function of the trench drain and oil -water separator. Mr. Lindor stated mostly mechanics will be working through the night on long-term projects. He stated they keep doors closed to prevent noise. Mr. James inquired about shipments and age of the fleet of tractors, noting older trucks have higher emissions. Mr. Lindor stated the tractors are kept approximately ten to fifteen years, noting it is based mostly on the mileage of the tractor. He stated they have bought trucks from Volvo Trucks. Mr. James inquired about hours of operation and type of use. Mr. Lindor stated lighter transportation, maintenance, and dispatch will be operational at night. He stated this location will not be a warehouse type operation. Mr. Woltz discussed zoning history of the property, noting it was previously industrial being rezoned for a church which was never constructed. He noted there is currently a fair amount of industrial activity in the area. He stated the parcel merits industrial zoning. He stated the County has very little industrial property for growth and employment. He stated the proposed property is a favorable site for the rezoning. Mr. James discussed the industrial property which adjoins the proposed site. He noted the majority of the road frontage on Hollins Road is industrial in nature with a few parcels of high intensity commercial. He noted that if the property had not been rezoned in 2002, the proposed use would be a by - right use. He stated industrial zoned property within the County is very limited. He stated it supports a job generating atmosphere in this area. Mr. Mahoney stated the use is consistent with the future land use designation. He stated it is consistent with other commercial and industrial uses on Hollins Road. He discussed the downzoning of the property in 2002, noting it has remained undeveloped for seventeen years after the previous rezoning. He discussed industrial development areas throughout the County with residential areas near industrial uses. Mr. Woltz made a motion to recommend approval of the request. Mr. Bower discussed vehicle accidents which had occurred on Hollins Road and Shadwell Road and Hollins Road and Plantation Road in 2017 and 2018. He stated the County has to rely on the data given to them by professionals. He stated traffic issues have been mitigated based on the facts received. He discussed air pollution from tractor trailers, noting they put out less pollution than in past. He discussed water pollution regarding fueling stations near Tinker Creek, noting the petitioner will have to follow State and Federal guidelines. He discussed the potential impact on property values, noting realtors report it does not affect the values. He stated some people will want to live near their work. He stated he is still concerned about noise from the proposed terminal. He stated his concerns regarding noise were not answered to his satisfaction tonight. Mr. Henderson provided a break which began at 9:00 p.m. He reconvened the meeting at 9:08 p.m. 3. Proposed amendments to the Roanoke County Zoning Ordinance regarding the Explore Park (EP) District. The proposed amendments would revise the EP District in Article III (District Standards): by amending the purpose, applicability, and permitted use sections; by adding development regulations; and by deleting the rezoning application process. The proposed amendments would also revise the use and design standards in Article IV (Use and Design Standards) for the following uses in the EP District: public maintenance and service facilities, automobile rental/leasing, minor automobile repair services, campground, convenience store, gasoline station, drive-in or fast food restaurant, and transportation terminal. Mr. Thompson presented the staff report, including an overview of the proposed amendments. He discussed Section 30-71-3, including Purpose, Applicability, and Permitted Uses within the district. He reviewed permitted use changes regarding Agricultural and Forestry Uses, Civic Uses, Office Uses, Commercial Uses, Industrial Uses, and Miscellaneous Uses. He discussed revisions to Section B, including adding Miscellaneous Uses — Broadcasting Tower. He discussed deletion of Section C, noting these regulations were developed specifically for Virginia Living Histories, Inc. and no longer apply to the district. Mr. Thompson reviewed Section 30-71-4, Site Development Regulations, including General Standards regarding Setbacks, Height, Signage, Buffers, Lighting, Roads, and Open Space/Developed Area. He reviewed the Calculation of Developed Area ratio regulations. He discussed Article IV — Use and Design Standards revisions, including adding Section 30-85-9 — Campground standards. He discussed revisions to Section 30-85-16 — Gasoline Station general standards. He reviewed changes to standards regarding Section 3085-24 — Restaurant, Drive-in or Fast Food. Mr. Mahoney inquired about restaurant and brewery operations in the district. Mr. Thompson discussed this issue, noting it is within the general restaurant use. Mr. Mahoney inquired about map amendments. Mr. Thompson discussed this issue. Mr. Bower inquired about small wind use requirements and regulations. Mr. Thompson discussed the design standards regarding this use. Mr. James inquired about solar energy structures. Mr. Thompson discussed this issue, noting they are allowed as an accessory use to another structure. Mr. Henderson opened the public hearing for public comment. With no citizens requesting to speak, Mr. Henderson closed the public hearing, Mr. James made a motion to recommend approval of the amendments for the Explore Park (EP) District as presented. He inquired about the status of Draft 419 Town Center Plan. Mr. Thompson stated the Commission will discuss the plan at the May 21, 2019 Planning Commission Work Session. Commissioners' and Staff Comments Mr. Thompson stated a Design Public Hearing will be held regarding Fallowater Lane Extension on May 8, 2019, at the Roanoke County Administration Center, 5204 Bernard Drive, in the 4k" Floor Training Room (438), from 4-010 p.m. - 7:00 p.m. Mr. Thompson and the Commissioners discussed topics for, future meetings. Mr. Thompson and the Commissioners discussed the tentative timeline of the Draft 419 Town Center Plan. Final Orders 1. The petition of Skyway Towers to obtain a Special Use Permit for a broadcasting tower (cell tower) approximately 199 feet in height in an AR, Agricultural/Residential, District on approximately 4.00 acres, located near the 6700 block of Split Oak Road, Cave Spring Magisterial District was approved by the Board of Supervisors at a Public Hearing on March 26, 2019, With no further business or comments, Mr. Henderson adjourned the meeting at 9:40 p.m..
