Mr. Henderson called the meeting to order at 4-00 p.m,.
Approval of Agenda
Mr. James made a motion to approve the agenda, which passed 3-0.
Approval of Minutes
Mr. Bower made a motion to approve the minutes of October 1, 2019 which passed 3-0.
Consent Agenda
Ms. James provided an overview of the petition of Bane International Company, LLC,
including zoning, future land use designation, and concept plan. She stated a community
will be held on November 12, 2019, at 7:00 p.m, at the Roanoke Valley Regional Fire
Training Center, 1220 Kessler Mill Road.
Mr. James made a motion to approve the consent agenda, which passed 3-0.

Mr. Henderson called the Public Hearing to order at 7:00 p.m. Mr. Woltz gave the
invocation and led the pledge of allegiance.
Mr. Mahoney made a motion to approve the minutes of September 17, 2019 which passed
4-0-1, with Mr. Henderson abstaining.
The petition of David and Stace Todd to obtain a special use permit in a R-1, Low
Density Residential, District to comply with the use and design standards
associated with an accessory apartment in an accessory building on approximately
0.346 acre, located at 1047 Barrens Village Court, Hollins Magisterial District. Ms.
James presented the staff report, including a brief history of the petition, zoning,
future land use designation, and setbacks. She discussed the building permit
process and status. Mr. Bower inquired about the setback requirements. Ms.
James and Mr. Thompson discussed setback requirements. Mr. Bower inquired
about the building permit being suspended. Ms. James stated building permits are
suspended after six months if the construction is not completed or inspected. She
stated the petitioner was sent a letter informing them of the suspended permit. Mr.
Bower inquired about inspections. Ms. James discussed this issue. Mr. Mahoney
inquired about pending code enforcement action. Ms. James discussed the
enforcement status. Mr. Mahoney inquired about the layout of the accessory
apartment. Ms. James discussed the layout, noting the appearance of a stove in
the structure makes it an accessory apartment and a violation. Ms. ,tames and the
Commissioners discussed the building and zoning regulations and standards. Ms.
James noted if the petition is not approved, the structure could be permitted if it is
only a workshop or garage. Mr. Thompson and the Commissioners discussed the
intent, purpose, and history of the regulations and standards regarding single family
dwellings. They discussed the two driveways on the property. He stated the
regulation has been amended several times in the past. Mr. Woltz discussed the
uniqueness of the property which fronts on two roads. Mr. Thompson stated that
the property is currently in violation. Mr. Henderson inquired if the structure was
currently occupied.
Ms. Stace Todd stated her daughter is currently living in the structure. Mr. Bower
asked if the petitioner has spoken with the neighbors about the property line. Ms.
Todd stated she tried to move property line but could not. She stated the building
is almost complete, noting her husband is the contractor. Mr. Woltz noted the
petitioner wants the opportunity for the accessory apartment if their special needs
son returns home. Ms. Todd stated they have no intent to sell property.
Mr. Henderson opened the public hearing for public comment.
Mr. Thompson stated a letter supporting the petition was received from David
Jamison and Donna Jamison. He stated an email opposing the petition was
received from Chad and Jennifer King. He noted copies have been provided to the
Commissioners.
With no citizens requesting to speak, Mr. Henderson closed the public hearing.

Mr. James stated he has concerns regarding issues with the petitioner's neighbor
and the Building Commissioner. Mr. Mahoney staffed the County has been
attempting to relax some of the standards for accessory apartments. He discussed
safety concerns regarding the structure not being completed with a final inspection
in five years. He discussed issues regarding the setbacks. Mr. Thompson stated
it meets standards for an accessory building but not an accessory apartment. Mr.
Bower discussed his concern regarding an additional violation with the driveway if
special use permit is approved. Mr. Woltz suggested placing time constraints on
the project. Ms. Nash noted that issue does not fall within the purview of the
Planning Commission. Mr. Bower inquired about regulations regarding an
accessory building and accessory apartment. Mr. Thompson discussed issues
regarding the presence of a stove and the additional driveway. Mr. Henderson
noted the setback issue could be remedied with the removal of the stove.
Mr. James discussed with the petitioner the significance of the presence of the
stove. Ms. Todd stated they have already removed the stove from the structure.
Mr. Thompson discussed the violation of the stove in an accessory building, noting
it includes the building being wired for a stove. Mr. Mahoney inquired about
requesting a variance from the Board of Zoning Appeals. Ms. Nash and Mr.
Thompson discussed this issue.
Mr. Bower made a motion to recommend approval of the request.

Mr. Thompson stated the Board of Supervisors Public Hearing regarding this
petition will be held on Tuesday, November 19, 2019, at 3:00 p.m.
2. The petition of Fellowship Community Church to rezone property to remove the
proffered conditions and to obtain a special use permit for a religious assembly on
approximately 3.50 acres zoned C -2C, High Intensity Commercial, District with
conditions, located near the 6500 block of Merriman Road, Cave Spring Magisterial
District. Mr. Jones presented the staff report and a PowerPoint presentation,
including zoning, use and design standards, and a brief history of the petition. He
reviewed the current proffered conditions which the petitioner is requesting to be
removed. He discussed the concept plan and future land use designation. He noted
the use is inconsistent with the Comprehensive Plan. He discussed the suggested
conditions for the special use permit if the petition is approved.
Mr. James stated he is concerned about existing condition #1 which lists uses which
would not be permitted on the site, noting the property does not have a good record
for development. Mr. Jones discussed the history of previously planned
development of the property, noting currently there is not much commercial activity
in the area. Mr. James discussed his concern regarding unintended use of the
property if the church is not constructed. Mr. Woltz stated he is concerned about

rezoning from industrial to commercial use. Mr. Thompson discussed procedural
issues, noting two actions are necessary for this petition which includes both a
rezoning and special use permit request. He noted the suggested conditions are
applicable only if it is a church. Mr. Mahoney inquired about the special use permit.
Mr. Thompson discussed procedural changes, noting the General Assembly has
amended regulations regarding vesting rights of development. Mr. Mahoney
inquired about funding regarding the road which leads to Starkey Park. Mr.
Thompson and Ms. Nash discussed this issue. Mr. Jones noted the road is a public
road with public right-of-way. He stated he can research to see if the road is
currently a VDOT maintained road. Mr. Woltz inquired about property entrances.
Mr. Jones stated the property has two entrances with one being on Merriman Road.
Mr. Jones introduced Mr. Barney Horrell, Brushy Mountain Engineering, PLLC, and
Mr. Robbie Willard, Executive Pastor, Fellowship Community Church.
Mr. Horrell stated they had a meeting at Faith Christian School regarding the
project. He stated they agreed the proposed location seems to fit the community.
He stated Mr. John Fulton will be the architect for the project. He noted it is
important to build up out of the floodplain. He stated the floodplain maps are being
examined by Lumsden Associates, PC, noting a site will be chosen out of the
floodplain. Mr. Woltz inquired about renderings. Mr. Horrell stated they are
researching floor plans.
Mr. Henderson opened the public hearing for public comment.
With no citizens requesting to speak, Mr. Henderson closed the public hearing.
Mr. Mahoney inquired if the Commission is comfortable removing the 1998
conditions, noting if religious assembly does not move forward the property would
be a C-2 zoning with special use permit conditions. He suggested having two
actions, including an action on the removal of the conditions and an action regarding
religious assembly. He discussed the tax exempt status of a religious assembly
use. He stated the property has not developed, noting it may be because of the
current proffered conditions on the property.
Mr. Woltz stated the proffered conditions need to be removed, noting much of the
site has already been developed. He discussed removing proffers and adding the
special use permit. Mr. Bower stated he is in favor of leaving the request as is.
Mr. Mahoney made a motion to recommend denial of the request to remove the
proffered conditions and to obtain a special use permit for a religious assembly.
Mr. Thompson called the roll and the motion failed (1-4) with the following vote:

Mr. Woltz made a motion to recommend approval of the removal of the 1988
rezoning proffered conditions and to obtain a special use permit for a religious
assembly with conditions. Mr. James stated he is in agreement with the motion
with one edit that the proposed use is inconsistent with the Comprehensive Plan.
Mr. Woltz amended his motion to include that the use is not consistent with the
Comprehensive Plan and to take out any reference to the Comprehensive Plan.
The recommended special use permit conditions are:
1. The site shall be developed in substantial conformance with the Development
Conceptual Plan for Fellowship Church — Merriman, as prepared by Brushy
Mountain Engineering, PLLC and dated September 9, 2019, subject to any
changes required by Roanoke County during the Site Plan review process.
2. All freestanding light poles and fixtures shall not exceed fourteen feet in height
above grade. Lighting shall be shielded ad directed downward and arranged so
glare is not cast onto adjoining properties.
3. Any freestanding signage shall be limited to one monument style sign not to
exceed five feet in height and seven feet in width and a maximum size of thirty
five square feet.
Mr. Mahoney stated the use is not consistent with the Comprehensive Plan.

Mr. Thompson stated the Board of Supervisors Public Hearing regarding this
petition will be held on Tuesday, November 19, 2019, at 3:00 p.m.
Mr. Henderson provided a break beginning at 8:24 p.m. He reconvened the meeting
at 8:35 p.m.
Mr. Mahoney recused himself from the public hearing regarding the Roanoke Valley
Resource Authority due to conflict of interest.
3. The petition of Roanoke Valley Resource Authority to obtain a special use permit
for a sanitary landfill on approximately 8.05 acres zoned AG -3, Agricultural/Rural
Preserve, District and to amend the special use permit for an existing sanitary
landfill (Smith Gap Landfill) on approximately 886.80 acres zoned AG -3S,
Agricultural/Rural Preserve, District with a special use permit, located on the
northwest side of t=ort Lewis Mountain between Smith Gap, and Bradshaw Road,
Catawba Magisterial District.
Mr. Thompson presented the staff report and PowerPoint presentation, including
an overview of the history of the petition. He discussed the background, policies,
and operating procedures adopted in 1991. He reviewed the project site, zoning,
and future land use designation. He discussed input received from citizens at the

community meeting held on October 16, 2019, including environmental concerns,
leachate spilling onto roads from trailers, impacts to Bradshaw Road, inadequacy
of Bradshaw Road, odors air quality, water quality, groundwater concerns, landfill's
services area, operational issues, traffic safety issues, and the need to fix Bradshaw
Road. He reviewed the conditions and revisions, including access, conversion,
types of waste, operating hours, emergency operations, noise, dust, odors, lighting,
pests, citizen complaints, active fill areas, monitoring, screening and buffering, site
security, and fire protection and public water. Mr. James stated since the policies
and procedures of RVRA are governed by a board, he suggested adding verbiage
"as necessary by the board" to the document.
Mr. James inquired about the centerline of the transportation corridor. Mr. Woltz
inquired about potable water. Mr. Thompson deferred these inquires to the
petitioner.
Mr. Jim Gwynn, Esquire, stated the corridor is from Montgomery County to the
landfill facility. He stated the conditions are acceptable to the petitioner. He stated
they are highly regulated by Department of Environmental Quality (DEQ). He
discussed the length of the railroad, noting it is 4.5 miles long with 1,135 feet on the
Roanoke County side. He stated no decision has been made how to do the transfer,
noting they will do it the most economical way with the least impact on the
environment and neighbors. He stated if they had their own road there would be
no need to use Bradshaw Road. Mr. James inquired about permits. Mr. Gwynn
stated they have worked hard with staff and do not want to undue progress. Mr.
Woltz inquired about the length of time to complete the proposed road. Mr. Gwynn
stated construction would take approximately three to six months, noting they would
need to grade the railroad bed which would become the road bed. Mr. Woltz
inquired about the road. Mr. Gwynn stated the road would be asphalt. Mr. Woltz
inquired about a study to determine what would be most economical. Mr. Gwynn
stated they have done a lot of analysis, including the cost of overhauling tippers
and the life of the tippers. He discussed the obsolescence of the tippers, noting
they no longer make them. He noted they have three years remaining on the
railroad contract. Mr. Woltz inquired about water availability. Mr. Gwynn stated
they have a water well which is technically potable. Mr. Woltz inquired about fire
hydrants. Mr. Gwynn stated they do not have fire hydrants.
Mr. Henderson inquired about access which is mentioned in first paragraph of the
conditions. Mr. Gwynn stated the access would remain the same, noting the need
for secondary entrance would be less with proposed road than with the railroad.
Mr. Henderson inquired about how often they use secondary entrance. Mr. Dan
Miles, RVRA, Chief Executive Officer, stated they use it daily for approximately
seven to eight dump trucks. Mr. Bower inquired if the need for all trucks accessing
from Bradshaw Road would be eliminated with proposed road. Mr. Gwynn stated
there would be virtually no need to use Bradshaw Road. Mr. Woltz inquired about
the width of the corridor. Mr. Gwynn discussed this issue, noting it would be a
private road with gates approximately 26 feet wide. Mr. Woltz inquired about pull
off areas for the trucks on the shoulder of the road. Mr. Gwynn stated it would be
a two lane road on Williby Road.

Mr. Henderson opened the public hearing for public comment.
Steven Bandy, 3838 Bradshaw Road, President of the Bradshaw Civic League,
stated in 1991 the City of Salem did not want to join the landfill because they could
not come up Bradshaw Road. He stated there was a document stating that they
would not come up Bradshaw Road. He stated the train did a good job for
approximately twenty-five years. He stated the trucks have broken the pavement
and make traffic conditions dangerous. He stated they do not want the trucks on
Bradshaw Road.
Dale Deweese, 4664 Bradshaw Road, stated this is like David vs. Goliath. He
stated the RVRA has lawyers, He stated they do not want the trucks. He staffed
they have torn the road all to pieces. He stated Bradshaw Road is a designated
bicycle route and the trucks will hit someone. He stated the train is the only way to
go even if the cost is higher.
Courtney Abram, 8301 Berrybrook Drive, stated she lives off of Williby Road and
works at Virginia Tech. She stated it is a beautiful rural area. She stated the
primary value is our land. She stated this could have an adverse effect on property
values and roads. She stated she currently has easy commutes to Blacksburg,
Virginia. She stated she is concern about the environmental effects. She stated
she hopes the Commission will treat this request with the same gravity as the
residents.
Darryl Moore, 8801 Williby Road, stated he has seen trucks, including 18 -wheelers
with dump beds on Bradshaw Road. He stated he has already seen construction.
He discussed safety concerns when exiting their homes. He stated the RVRA road
will cross Williby Road in Montgomery County. Mr. Woltz inquired about the number
of homes in the area. Mr. Moore stated approximately ten to fourteen houses are
in his area.
With no other citizens requesting to speak, Mr. Henderson closed the public
hearing.
Mr. Woltz inquired if RVRA would be studying any of the crossings in the Williby
Road area as a safety point. Mr. Gwynn stated the speed limit is low in the area.
He stated deliveries are made at certain time of the day. He stated the RVRA road
would be blocked with a gate at the intersection. Mr. Woltz inquired about the gate.
Mr. Gwynn stated he thinks it will be an electric gate. Mr. James inquired about
location that the trucks will access the landfill. Mr. Gwynn stated they currently
come through Williby Road and it will remain that way. Mr. Woltz inquired about
how many trucks come through the landfill per day. Mr. Gwynn stated the landfill
averages approximately fifty trucks per day. He stated they have exhibits in the
application regarding cost of gates and signage. Mr. Henderson discussed concern
regarding school bus issues if approximately fifty trucks per day are using Bradshaw
Road as the primary access.
Mr. James inquired about enforcement issues since Bradshaw Road is a public
roadway. Mr. Gwynn stated a third party landfill in the New River Valley would be

used during the conversion. Mr. Henderson suggested adding to the conditions
verbiage that RVRA will have their own road and will have an agreement with the
New River Valley during the conversion. Mr. Gwynn noted they are not expanding
the landfill.
Mr. Henderson made a motion to recommend approval of the request, including
providing wording to insure Bradshaw Road will not be the primary access. He
made the motion with the following conditions:
1. That the reference to the "amended landfill permit conditions and operating
policies" referenced in the 1991 Special Use Permit Resolution is now HEREBY
REMOVED; the "amended landfill permit conditions and operating policies" are no
longer incorporated into the Smith Gap Landfill SUP by reference.
2. The special use permit for a sanitary landfill on the 8.05 acre parcel located
at 8765 Williby Road (Tax Map No. 052.00-01-02.08-0000) is granted, and the
following conditions shall apply to the special use permit for 8.05 acre parcel and
the 878.75 acres for the existing sanitary landfill (886.80 total acres):
a. Access: Primary access to the Smith Gap Landfill for the delivery of
municipal solid waste shall be along the Transportation Corridor (previously known
as the Rail Corridor). In the event the primary access is unavailable for two or
more business days, the Roanoke Valley Resource Authority (or subsequent
owners) will make reasonable efforts to transport all municipal solid waste to one
or more fully permitted third -party sanitary landfills until such time as the primary
access can be resumed. In the event that the Roanoke Valley Resource Authority
(or subsequent owners) cannot through reasonable efforts contract for sufficient
immediate transportation services to transport municipal solid waste to third party
landfills, and until sufficient services can be obtained, Bradshaw Road will serve
as the secondary access for the delivery of municipal solid waste to the landfill.
b. Conversion: If the Transportation Corridor is converted from rail to a road,
then all municipal solid waste will be transported to third party landfills during
construction of this conversion.
G. Types of Waste: Only properly approved waste may be accepted, with the
main objective always being to safely dispose of materials and prolong the useful
life of the landfill. Wastes designated as "special wastes" shall be disposed of in
accordance with current waste management regulations. No hazardous waste will
be allowed at any time during the entire life of the landfill.
d. Operating Hours: Normal working hours shall be as follows: Delivery of
Waste by Authorized Vehicle — Monday through Friday from 7:00 a.m. to 5:00 p.m.,
Saturday from 7:00 a.m. to 3:30 p.m.; Delivery of Waste by Rail — Monday through
Saturday from 10:00 a.m. — 12:00 a.m.; Operation of all equipment -- Monday
through Friday from 7:00 a.m. to 8:00 p.m., Saturday from 7:00 a.m. to 6:30 p.m.
e. Emergency Operations: Emergency operations shall allow for extended
hours on all days and Sundays whenever an emergency has been duly declared
by the County Administrator of Roanoke County or his/her designee.
Circumstances for Emergency Operations include, but are not limited to, natural
disasters or short-term (less than 2 days), temporary operating interruptions
resulting from equipment failure or contract service interruptions. Emergency
operations may require use of third -party landfills or use of secondary access to
the Smith Gap Landfill (Bradshaw Road).

f. Noise: Noise levels may not exceed the following limits: 80 db (decibels) at
landfill site borders; 65 db (decibels) at surrounding residences.
g. Dust: Dust shall be controlled in accordance with the landfill's state solid
waste facility permit. Problem areas arising during dry seasons will be controlled
with water. Access roads should be cleaned and dust controlled with water if
excessive amounts of dust are generated.
h. Odors: Odors shall be controlled in accordance with the landfill's state solid
waste facility permit. If problem odors exist that adversely impact surrounding
residents, deodorizing agents may be used. All holding tanks for leachate
collection systems shall be in enclosed structures.
i. Lighting: Sufficient lighting must be maintained at all times to facilitate
normal operations and to provide adequate security over the landfill site. All
exterior lighting fixtures shall be designed, located and arranged so as not to direct
glare on adjoining streets or residential properties. The intensity at adjoining
streets or residential properties shall not exceed 0.5 foot candles. Lighting shall be
limited to fixtures attached to buildings as necessary for security and operations
and freestanding poles of not more than 16 feet in height.
j. Pests. A bonded, licensed pest control company will be retained throughout
the active life of the landfill to provide preventive inspections and treatments.
Adjoining property owners who incur pest problems that are proven to be directly
related to the landfill operation must be provided proper extermination at the landfill
owner's expense.
k. Citizen Complaints: A telephone number will be provided for use of
surrounding residents including those in the Transportation Corridor to call in
complaints (noise, dust, odor, pests, or other issues). These calls will be
recorded/logged and corrective actions documented. The complaint log shall be
open to public inspection.
I. Active Fill Areas: The active fill areas of the landfill shall comply with the
landfill's state solid waste facility permit. Fill areas should be designed as far as
practical from adjoining properties to provide maximum buffering, and in no case
should extend within 100 feet of the landfill boundary line.
M. Monitoring: The Virginia Department of Environmental Quality conducts
inspections during the year to ensure compliance with the landfill's state solid
waste facility permit. Any violations shall be reported and made public information.
The Roanoke Valley Resource Authority (or subsequent owner) shall take
whatever steps are necessary to immediately correct any violation.
n. Screening and Buffering:
i. The following buffer yard and plantings shall be established around
the perimeter of the landfill property, except adjacent to an existing
residential property or private right-of-way. Trees shall be planted in
three separate rows or in clusters, where natural land characteristics
allow within the buffer yard. 50 -foot buffer yard with three large
deciduous trees with an ultimate height of 50 feet or greater per 100
linear feet of buffer yard, five large evergreen trees with an ultimate
height of 50 feet or greater per 100 linear feet of buffer yard, and
seven small evergreen trees with an ultimate height of 15 feet or
greater per 100 linear feet of buffer yard.
ii. In areas adjacent to an existing residential property or public or
private right-of-way, the following shall be established and

maintained around the perimeter of the landfill property. Trees shall
be planted in three separate rows or in clusters, where natural land
characteristics allow with the buffer yard. 100 -foot buffer yard with
six large deciduous trees with an ultimate height of 50 feet or greater
per 100 linear feet of buffer yard, ten large evergreen trees with an
ultimate height of 50 feet or greater per 100 linear feet of buffer yard,
and fifteen small evergreen trees with an ultimate height of 15 feet or
greater per 100 linear feet of buffer yard.
iii. Buffer yards may only be used for passive recreation, such as
pedestrian, bike or equestrian trails, provided that the total width of
the buffer is maintained and all other requirements and conditions
are met.
iv. Buildings, active landfill areas, equipment storage areas and other
facilities shall be landscaped in such a manner as to enhance (but
not necessarily screen) the visual appearance from adjoining
properties.
o. Site Security: All facilities shall be surrounded on all sides by natural
barriers, fencing, or an equivalent means of controlling vehicles access and
preventing illegal disposal. All access will be limited by gates, and such gates shall
be securable and equipped with locks. All fencing utilized at the facility shall be
adequate to control unauthorized access. Gates shall be at the main entrance as
well as the entrance to additional service areas. Access to a solid waste disposal
facility (landfill) shall be permitted only when an attendant is on duty and only
during operating hours, unless otherwise specified in the facility permit, such as
for rail delivery of waste. Each solid waste disposal facility should be provided with
an adequately lighted and heated shelter where operating personnel can exercise
site control and have access to essential sanitation facilities. Lighting, heat and
sanitation facilities may be provided by portable equipment, as necessary. Dusk to
dawn lights may be placed around buildings and at each of the security gates. All
sanitary landfills will be equipped with permanent or mobile telephone or radio
communications. The main security gate should be able to communicate with all
necessary areas of the landfill. The operator is responsible for safety hazards to
operating personnel through an active safety program. Security rules and
regulations shall be posted at each gate. Security guard of landfill personnel shall
be on site 24 hours each day. All vehicle access points to the Transportation
Corridor shall be properly gated, with lock, and shall be posted with "No
Trespassing" signs. Signs will also be posted at intervals along the Transportation
Corridor.
P. Fire Protection and Public Water: Fire protection for the site shall be
provided on site with adequate storage, distribution, and hydrants to properly
extinguish fires. The system shall be designed as a potable water system. The
system shall be designed to serve all on-site water needs as well as being capable
of serving adjoining properties. Expansion of the water supply system, except
when groundwater contamination has been documented, shall be prohibited
without prior review for consistency with the Comprehensive Plan.

acres, located near the 8100 block of Honeysuckle Road, Windsor Hills Magisterial
District was approved by the Board of Supervisors at a Public Hearing on October
8, 2019.
2. The petition of Lewis Gale Medical Center to rezone approximately 1.44 acres from
R-1, Low Density Residential District, District to C-1, Low Intensity Commercial,
District for a medical office — free standing emergency room, located at 1423 West
Ruritan Road, Hollins Magisterial District was approved by the Board of
Supervisors at a Public Hearing on October 22, 2019.
