HomeMy WebLinkAbout10/19/2020 - MinutesROANOKE COUNTY PLANNING COMMISSION 1838 OCTOBER 19, 2020 Commissioners Present: Mr. Wayne Bower Mr. Troy Henderson Mr. Rick James Mr. Kelly McMurray Mr. Jim Woltz Staff Present: Mr. Philip Thompson, Secretary Ms. Rachel Lower, Senior Assistant County Attorney Ms. Becky James Ms. Alyssa Dunbar Mr. Isaac Henry Ms. Susan McCoy, Recording Secretary Work Session Mr. James called the meeting to order at 6:04 p.m. Approval of Agenda Mr. Henderson made a motion to approve the agenda, which passed 5-0. Zoning Ordinance Amendments Mr. Thompson provided a brief background regarding the proposed special use permit amendment. He stated the phrase "as approved by the board" needs to be deleted from Section 30-19-2 of the Zoning Ordinance, He also discussed correcting the numbering in Section 30-19-4, noting subsection (F) needs to, be changed to subsection (D). He reviewed the proposed amendments to Section 30-19-1 General Standards, Section 30- 91-2 Application Requirements, Section 30-19-3 Review and Action, and Section 30-19- 4 Limitations. Mr. Thompson discussed clarifying Use and Design Standard in Section 30-81-11 (F) I in C-1 and C-2 zoning districts for multi -family dwelling, including removing the requirement that a multi -family use has to be in the same structure as an associated civic, office or commercial use, and allowed for a multi -family use to account for more than 50 percent of the gross floor area on site through the special use permit process. He stated "as a stand-alone residential project" will be included in the general standards of C-1 and C-2 zoning districts. Ms. Dunbar discussed Section 30-82-2 Home Beauty/Barber Salon Use and Design Standards and Section 30-82-3 Home Occupation Use and Design Standards., She discussed two types of home occupations and the use and design standards. She stated ROANOKE COUNTY PLANNING COMMISSION MINUTES OCTOBER 99, 2020 some citizens have expressed interest in having a home salon which offers salon services other than hair styling and barbering. Ms. Dunbar and the Commissioners discussed various salon services which have been requested. They discussed the current standards which allow only one chair and products. They discussed definitions, scale of operation, noise, and required licenses. Mr. Thompson, Ms. James, and the Commissioners discussed possibly including additional standards. They discussed the need for standards so the use does not take away from the nature of the neighborhood. Mr. Thompson stated staff is researching regulations regarding this use in other localities. The Commissioners agreed to give latitude to the Zoning Administrator to determine if the use is in compliance with the ordinance. Mr. Thompson, Ms. James, Ms. Dunbar, and the Commissioners discussed regulations regarding square footage, percentage of space, and number of chairs allowed for this use in various zoning districts. Ms. Dunbar discussed short-term rental of property when an owner is not onsite. She stated the County has received some complaints regarding this type of use. She stated owners are looking for an opportunity to earn income with short-term rentals. Ms. Dunbar and the Commissioners discussed making a new use type or expanding the bed and breakfast use and design standards. Ms. Dunbar stated most other localities have a separate definition and use and design standards for short-term rentals. Ms. Dunbar and the Commissioners discussed property rights and regulations in other states. They discussed contacting the police or property owner if there is an issue at the property. Ms. Dunbar noted this use is not currently defined in the Zoning Ordinance. Mr. Thompson and the Commissioners discussed options to regulate this use. Mr. Thompson, Ms. Dunbar, Ms. James, and the Commissioners discussed regulations and enforcement issues regarding parking, number of people, number of cars, and noise. Mr. Thompson and the Commissioners discussed allowing short-term rentals for events versus investment properties. They discussed requiring a permit for this use and applicable taxes. The consensus of the Commission was to have short-term rental as a separate use in the Zoning Ordinance. Ms. James discussed temporary construction yard for public infrastructure projects, including current options for this use type. She stated public infrastructure projects are typically linear in nature, involving multiple properties which are located in various zoning districts. She stated there is a limited amount of appropriately zoned property available for construction yards which can create time delays for projects. Ms. James and the Commissioners discussed placing this use in the temporary use section, noting regulations should not become burdensome. They discussed a permitting process for this use. They discussed storage of equipment during water and sewer projects. Ms. James stated the County does not currently regulate construction equipment storage on industrial construction. Ms. James and the Commissioners discussed construction issues including noise and dust. Ms. James stated the storage area property could be separate from the project site. Mr. Thompson and the Commissioners discussed having the same standards for all districts or separating standards according to the districts. They discussed considering the length of time for the construction project, distance the storage site could be from the construction site, and size of project. Ms. James and the Commissioners discussed screening issues, construction time constraints, and use and design standards. Page 2 of 4 ROANOKE COUNTY PLANNING COMMISSION MINUTES OCTOBER 19, 2020 Mr. Thompson provided the Commissioners a list of additional items to consider for possible amendments. Mr. Thompson discussed agricultural subdivisions/private roads. Mr. Thompson and the Commissioners discussed standards of other localities which have for this use, including lot size and number of lots on the private road. They discussed ways to maintain the rural appearance of agricultural districts. They discussed topography determining the best way to subdivide and develop the property. They discussed creating a planned agricultural zoning district with private roads which are not developed to State road standards. They discussed road width and easements needed. They discussed emergency vehicle access for the private roads and road maintenance issues. Mr. Thompson stated staff will continue researching these uses in other localities and discuss findings at future work sessions. Citizen Comments There were none. Commissioners' and Staff Comments Mr. Thompson and the Commissioners discussed the upcoming petitions. Mr. Thompson noted representatives for the petition of Milestone Tower Limited Partnership IV will be conducting an online community meeting on Wednesday, October 21, 2020, at 0:30 p.m. He stated information regarding this meeting can be found at http://www.stonebridgeparkwireless.com/town-hall/. Mr. Thompson stated the Planning Department has won three awards, including Virginia Chapter of the American Planning Association's 2020 Old Dominion Innovative Approaches Award for Public Schools Planning Workshops which were a component of the Oak Grove Center Plan community engagement strategy. He stated the program has also received a 2019 VACo Award and a 2020 NACo Award. Mr. Thompson and the Commissioners discussed the timeline and procedural issues regarding the draft Oak Grove Center Plan.
