HomeMy WebLinkAbout12/14/2020 - MinutesROANOKE COUNTY PLANNING COMMISSION Commissioners Present: Mr. Wayne Bower Mr. Rick James Mr. Kelly McMurray Mr. Jim Woltz Commissioners Absent: Mr. Troy Henderson Staff Present: Mr. Philip Thompson, Secretary Ms. Rachel Lower, Senior Assistant County Attorney Ms. Rebecca James Ms. Alyssa Dunbar Mr. Isaac Henry Ms. Susan McCoy, Recording Secretary Work Session Mr. James called the meeting to order at 6:07 p.m. Approval ofAgenda Mr. Bower made a motion to approve the agenda, which passed 4-0. Zoning Ordinance Amendments Mr. Thompson discussed the process and timeline for the amendments. He reviewed the amended definition for home beauty/barber salon. Ms. James stated the amended definition is consistent with previous discussions. Mr. Thompson and the Commissioners discussed general standards for this home occupation use. The consensus of the Commission was to allow one customer or two customers at a time. Mr. Thompson reviewed short-term rental, noting they are using the State Code definition. Mr. Thompson and the Commissioners reviewed complaints received regarding the use. They discussed developing general standards. They discussed potential permitting procedures, including acquiring: a layout or the house and a zoning permit. They discussed long-term rental property regulations. They discussed having a maximum number of people which are allowed to stay in the house at a time. They discussed parking: issues. They discussed not wanting to overcomplicate the use with restrictions, They discussed requiring a licensing fee, Ms. Lower stated currently the County does not have a short-term lease registered with the Commissioner of Revenue. She discussed transient occupancy tax. Ms. James stated if a certain number of people stay in the house, a change of use with the building department would be necessary because it would be considered a commercial property. Ms. Dunbar discussed complying with building regulations. They discussed how this use could potentially benefit agritourism. They discussed registering the facility which will be used. Mr. Thompson discussed procedural issues regarding the Board of Supervisors adding the use to the County Code. Mr. Thompson, Ms. Lower and the Commissioners discussed creating a definition and criteria for this use. Mr. Thompson and the Commissioners discussed potential parking issues. They discussed giving Zoning Administrator latitude to determine if an application for this use is allowed. Ms. James stated the registration procedure for short-term rentals could be similar to registration for home occupation use. Staff and Commissioners discussed which zoning designations should still require a special use permit. Mr. Thompson reviewed the temporary construction yard amendment. He discussed adding a definition, adding a temporary use section to the miscellaneous section of Article V (Development Standards), and adding standards for temporary construction yards. Mr. Thompson and the Commissioners discussed the intent of the use. They discussed not requiring an unrealistic burden of proof of availability or monetary need to locate the construction yard. Mr. Thompson noted that currently this use cannot be allowed because it is not in the ordinance. Mr. Thompson and the Commissioners discussed replacing "shall' with "desirable" to the location standards of the 500 feet distance requirement. They discussed revising the wording in the last sentence of (B)l .b to include construction activity "for which it was required." They discussed allowing the Zoning Administrator to impose additional standards for other temporary uses if additional standards are necessary. Mr. Thompson discussed yard encroachments, including adding mailboxes. Mr. Thompson and the Commissioners discussed adding allowable encroachments into required yards, including hand icap-accessible ramps and roof and coverings over patio and stoops. They discussed the restrictions and regulations regarding allowable encroachments. The consensus of the Commission was to move forward with the amendment as discussed. Mr. Thompson reviewed some of the previous amendments which were revised. Mr. Thompson and the Commissioners discussed terms which will be revised in order to keep the language used in the ordinance consistent. Mr. Thompson stated staff will incorporate edits into the draft amendments. He stated the Planning Commission Public Hearing will be on January 5, 2021, regarding the proposed amendments. The consensus of the Commissioners was to move forward with amendments as discussed. Citizen Comments There were none. Commissioners' and Staff Comments Ms. Lower provided an update regarding litigation involving the Board of Zoning Appeals. Mr. Thompson and the Commissioners discussed upcoming meetings.
