Susan Carter, Recording Secretary WORK SESSION: Ms. Hooker called the work session to order at 4:02 p.m. Approval of Agenda Mr. McNeil made a motion to approve the agenda, which passed 4-0. Approval of Consent Agenda Ms. Mahoney provided a brief summary and Poxv8rPoiDt presentation of Clifton L Ronk special use permit request. She discussed issues regarding topography and the proposed site plan and 8|gD@g8. She reviewed the 1992 rezoning, noting the same conditions will apply. M[. Sign Regulations Ms. Pattisall and Ms. Mahoney provided a PowerPoint presentation. Ms. Pattisall reviewed the definitions of various signs, including attached, awning, banners, and construction signs. She noted portable signs are not permitted in the county. Ms. Mahoney discussed calculation of sign size and allowable signs in various zoning districts. Commissioner and Staff Comments Ms. Hooker requested a representative from IT meet with the commissioners to discuss access and software issues of their laptops. Mr. Azar requested administrative privileges be granted for access on their laptops. Mr. Thompson announced the State of County Address would be presented on November 17, 2009, at 7:30 a.m. at the Green Ridge Recreation Center. With no further comments, Ms. Hooker adjourned the work session at 5:30 p.m. EVENING SESSION: Ms. Hooker called the Public Hearing to order at 7:00 p.m. Mr. Azar gave the invocation and led the pledge of allegiance. Mr. Azar recused himself from the public hearing to avoid possible appearance of conflict of interest, due to his employment with Appalachian Power Company. Mr. Radford also recused himself from the public hearing to avoid possible appearance of conflict of interest, due to his employment with English Construction Company. The petition of Foxhall Properties, LLC, to obtain a Special Use Permit in a 1-2, High Intensity Industrial, District for the purpose of operating an asphalt plant on 16.7 acres, located at 6090 Peaceful Drive, Salem, Catawba Magisterial District. Mr. Holladay presented the staff report, including a brief history of the petition and description of the property. He reported on various letters and emails received from citizens regarding the petition. He stated the operation will be heated with diesel fuel since natural gas is not available in large quantities at the site. Ms. Hooker inquired about the suggested condition regarding administrative waivers of landscaping, screening and buffer yards. Mr. Holladay stated it is part of the Route 11/460 Design Guidelines, which insures buffers remain the same or are replaced. Mr. Jarrell inquired about the suggested proffer regarding noise regulations. Mr. Holladay discussed this issue stating noise levels need to be in compliance prior to the issuance of the occupancy permit. Ms. Maryellen Goodlatte, Esquire, stated the petitioner is a contract purchaser for the property. She stated they are a subsidiary of Adams Construction Company, She reviewed the aerial map, noting various boundaries of the property. She reviewed the history of the petition including the previous petition which was withdrawn. She stated the proposed site is more remote, currently zoned 1-2, and has nearby interstate access. She stated the asphalt is 100% recyclable. She stated 11 of the 16.7 acres will be used for the operation of the plant. She stated Adams Construction has produced asphalt since 1946. She stated the production is clean, efficient, and abides by regulations. Mr. Art Nunn, President of Air Compliance Group of Roanoke, stated minimal environmental impacts are involved with this type of operation. He reviewed the manufacturing process of asphalt, including measures taken to control pollution. He stated the petitioner would be using wet suppression to control the dust from the aggregate as recommended by DEQ. He stated the road surfaces of the plant would be Page 2 of 5 ROANOKE COUNTY PLANNING COMMISSION MINUTES November 2, 2009 paved to prevent dust from plant vehicles. He stated the equipment and odor suppression used reduces emissions significantly. He stated toxic emissions would be less than zero. He said it would be a state of the art facility and will not post a risk to the community. Ms. Goodlatte stated all recommended conditions are acceptable. She discussed the VDOT traffic analysis, noting VDOT does not feel a traffic light is warranted at this time near the plant entrance. She stated the main hours of operation would be 7:00 a.m. - 5:00 p.m., Monday-Friday, although some night operations would be needed if requested by VDOT. She discussed the noise level, noting the railway borders one side of the property. She stated none of the plant would be in the floodway and a minimal amount in the floodplain. She stated the proposed use complies with the Comprehensive Plan. Ms. Goodlatte introduced Mr. Gary Wright and Mr. Rick James, Adams Construction Company and Mr. Conley Taylor and Mr. Scott Hodge, HSMM/AECOM, Ms. Hooker inquired about signage. Ms. Goodlatte stated the plant plans to use signage as recommended by staff, Mr. McNeil asked if a sign would be installed on Route 11. Ms. Goodlatte stated a sign will not be installed on Route 11. He inquired about fuel storage. Ms. Goodlatte explained the diesel fuel will be stored above ground in containment structures for added protection. Mr. Jarrell inquired about dust collection. Mr. James stated the new 100% closed system returns dust back to the mix. Mr. Craig Turner, 6142 Stratford Way, spoke in favor of the petition, noting the company has served the Roanoke Valley since 1946 and remains a strong Virginia company, which has created jobs for the area. Mr. Darryl Prince, 5663 Club Lane, spoke in favor of the petition, stating Adams Construction is a great neighbor to the county and has had no adverse effects on the residents. Mr. Henry Bryant stated he has been a life-long resident of the area. He stated the nearby railway was underwater during the flood of 1985. He stated he did not agree with the proposed location. He provided a brief history of the area, noting the appearance of a junkyard located nearby. He stated the area zoning designation is inappropriate and should be agricultural residential. He stated a house built in the 1700's is located on the proposed site. Mr. Ron Adkins stated he owns property at 4110 Daughtery Road and is in favor of the petition. He stated the area needs basic industry and more roads. He stated he previously worked in an asphalt plant in Michigan. He stated the tax base would benefit Roanoke County. Mr. Randall Thomas, 6163 Peaceful Drive, stated he has lived in the area 55 years and is in favor of the petition. Mr. Julio Stevens, 5400 Honey Road, Elliston, VA, expressed concern regarding trucks using Route 11/460 instead of 1-81. He requested that access to Route 11/460 be restricted. He expressed concern regarding safety for children at nearby school bus stop. He also was concerned about lighting, screening, noise level, and emissions. Ms. Betty Snyder, 7018 Campbell Drive, inquired about hydrocarbon emissions from heating of asphalt. Ms. Goodlatte stated Mr. Nunn has addressed the emissions issues. Mr. James explained the heating procedure. Ms. Hooker inquired about additional emissions. Mr. Page 3 of 5 ROANOKE COUNTY PLANNING COMMISSION MINUTES November 2, 2009 Nunn stated every aspect of emissions was included in statistics provided. Ms. Hooker inquired about lighting and signage. Ms. Goodlatte stated the petitioner will comply with county regulations. She also stated they will encourage VDOT to place traffic signage near the site. She stated VDOT has studied collisions near the site but has not been able to conclude it is an issue. Mr. McNeil commended petitioner for meeting with the citizens and trying to find a good solution. Mr. Jarrell also commended the petitioner for working with county staff to find solution. He noted the history of the company is commendable. Ms. Hooker noted the company is working hard to be a good neighbor. Ms. Hooker moved to approve the petition including eleven (11) recommended conditions to the Board of Supervisors. Mr. Thompson called the roll and the motion passed (3-0) with the following vote: AYES: Jarrell, McNeil, Hooker NAYES: None ABSTAIN: None Final Orders 1. The petition of Fralin S P, LLC, to rezone 12.691 acres from C-2, General Commercial, District, and R-3, Medium Density Multi-Family Residential, District to R-4C, High Density Multi-Family Residential, District with conditions for the purpose of constructing multi-family and townhouse residential units (maximum of 115 units), located at 6044 Peters Creek Road, Hollins Magisterial District was approved with conditions by the Board of Supervisors at the Public Hearing on October 27, 2009. 2. The petition of StellarOne Bank and Bonsack Baptist Church Trustees to rezone 4.64 acres from R-1, Low Density Residential, District and R-11S, Low Density Residential, District with a special use permit, to C-1, Office, District for the purpose of constructing a bank with a drive-thru, located at 4903 and 5007 Cloverdale Road, Hollins Magisterial District was approved with conditions by the Board of Supervisors at the Public Hearing on October 27, 2009. 3. The petition of Fountain Head Land Company, LLC, to amend the Planned Residential Development Master Plan related to at-grade golf cart crossing on Pitzer Road for Fountain Head Golf Resort (Ballyhack) which measures approximately 375 acres, Vinton Magisterial District was denied by the Board of Supervisors at the Public Hearing on October 27, 2009. Commissioners' Comments There were none.
